                    A Survey of This University



This University in Liaoning Province, is located in Jinzhou—a well-known seaside city of historic interest, which is next to Bohai Sea. At present, This University covers a total area of 3,001,500 square meters. The school buildings cover a total area of 429,000 square meters. In This University there are 6 departments, 13 sublevel schools, and 4 research institutes. There are 13 fields (or directions) of study for master’s degree, 46 fields (or directions) of study for bachelor’s degree and pre-bachelor’s degree, and 29 fields (or directions) of study for advanced technical and vocational education. There are 846 teachers by profession, among which are 429 professors and associate professors, and 347 teachers with a doctor’s degree or a master’s degree. There are 21,182 students of all professions including postgraduate students, regularly enrolled 2-year or 3-year students, and overseas students. Up to now, This University possesses 620, 000,000 yuan (RMB) of permanent assets (approximately, 8.26 yuan is equal to US $1 according to the current exchange rate), and 51,470,000 yuan of teaching apparatuses or facilities. The new school library covers an area of 36,000 square meters, and will house 1,145,800 volumes of books. This University employs on a long term basis foreign teachers of English and Japanese, enrolls international students, and sends abroad various groups of visitors and Chinese students. ICEC now enrolls four-year undergraduate international students with Chinese language and literature as their major, and international students learning Chinese language on a long or short basis. Among the subjects are Chinese calligraphy, music, fine arts, Chinese Wushu (Kongfu), Chinese medicine, and Chinese cuisine as well as Chinese language. Here, it has well-furnished and well-equipped apartments for foreign experts and international students, which are surrounded by beautiful campus scenery.

Ⅰ.Party A                         wishes to engage the service of Party B                        as                      . The two parties, in a spirit of friendly cooperation, agree to sign this contract and pledge to fulfill conscientiously all the obligations stipulated in it.
Ⅱ.The period of service will be from the         day of            , 20       to the          day of          , 20     .

Ⅴ.Party A’s Obligations
1.Party A shall introduce to Party B the laws, Decrees and relevant regulation enacted by the Chinese government, the Party A’s work system and regulations concerning administration of foreign experts.
2.Party A shall conduct direction, supervision and evaluation of Party B’s work.
3.Party A shall provide Party B necessary working and living conditions.
4.Party A shall provide co-workers.
5.Party A shall pay Party B’s salary regularly by the month.
Ⅵ.Party B’s Obligations
1.Party B shall observe the laws, decrees and relevant regulations enacted by the Chinese government and shall not interfere in China’s internal affairs.
2.Party B shall observe Party A’s work system and regulations concerning administration of foreign experts and shall accept Party A’s arrangement, direction, supervision and evaluation in regard to his/her work. Without Party A’s consent, Party B shall not render service elsewhere or hold concurrently and post unrelated to the work agreed on with Party A.
3.Party B shall complete the tasks agreed on schedule and guarantee the quality of work.
4.Party B shall respect China’s religious policy, and shall not conduct religious activities incompatible with status of an expert.
5.Party B shall respect the Chinese people’s moral standards and customs.

Ⅶ.Revision, Cancellation and Termination of the Contract
1.Both Parties should abide by the contract and should refrain from revising, canceling, or terminating the contract without mutual consent.
2. The contract can be revised, canceled, or terminated with mutual consent. Before both Parties have reached and agreement, the contract should be strictly observed.
3.Party A has the right to cancel the contract with a written notice to Party B under the following conditions:
(1)Party B does not fulfill the contract or does not fulfill the contract obligations according to the terms stipulated, and has failed to amend after Party A has pointed it out.
(2)According to the doctor’s diagnosis, Party B cannot resume normal work after a continued 30 days sick leave.
4.Party B has the right to cancel the contract with a written notice to Party A under the following conditions:
(1)Party A has not provided Party B with necessary working and living conditions as stipulated in the contract.
(2)Party A has not paid Party B as scheduled.
Ⅷ.Breach Penalty
When either of the two parties fails to fulfill the contract or fails to fulfill the contract obligations according to the terms stipulated, that is, breaks the contract, it must pay a breach penalty of US$500 to 2,000(or the equivalent in RMB).
If Party A asks to cancel the contract due to events beyond control, with the consent of Party B, it should pay Party B’s return expenses; if Party A cancels the contract valid reason, it should pay Party B’s return expenses and pay a breach penalty to Party B.
Ⅸ.The appendix of this contract is and inseparable part of the contract has equal effect.
Ⅹ.This contract takes effect on the date signed by both parties and will automatically expire when the contract ends. If either of the two parties asks for a new contract, it should forward its request to another party 90 days prior to the
expiration of the contract, and sign the new contract with mutual consent.
 Party B shall bear all expense incurred when staying on after the contract expires.
Ⅺ.Arbitration
 The two parties shall consult with each other and mediated any disputes which may arise about the contract. If all attempts fail, the two parties can appeal to the organization of arbitration for foreign experts affairs in the State Administration of Foreign Experts Affairs and ask for a final arbitration.

Appendix to the Contract:

Employment of Foreign Teachers
1)      The monthly pay is ¥4500 for bachelor’s degree holders. RMB 5000 for master’s degree holders, and RMB 5500 for doctor’s degree holders. Monthly pay will be pre-paid in the first half of each month.
2)      A foreign teacher is required to work 18 weeks per semester/term (not including festivals and holidays), and for every week he/she is required to teach 18 class hours, 50 minutes per class hour.
3)      The contract period is at least one year. This University offers RMB 8000 airfare allowance for those who sign a one-year contract with This University. There will be no airfare allowance for the less than a one-year contract. This University offers RMB 8000 of airfare allowance for the same foreign teacher who renews his/her contract for another year; This University offers RMB 4000 of airfare allowance for the same foreign teacher who renews his/her contract for another half year. The airfare allowance will be paid to the foreign teacher on the last week of the contract.
4)      This University offers every foreign teacher insurance policy for both accidental injuries and medicare.
5)      Yearly travel allowance is RMB 2200, which will be paid as 1100 RMB at the end of each term. This University will organize free traveling twice a year around the Jinzhou area. Note: If a foreign teacher leaves This University less than half a month (including half a month) before his/her contract expires, the travel allowance will still be paid to him/her.
6)      The foreign teachers will teach This University students, and/or some part-time students (including adults and middle school learners) in the evening or on weekends. And This University will pay an extra sum of money to the foreign teachers who take part-time teaching: RMB 65 per clock hour. The courses range from Conversational English, Listening, Survey of America and Great Britain, Literature of America and Great Britain, to English Writing and so on.
7)      This University is responsible for picking up foreign teachers at Shenyang or Jinzhou Railway Station, all free of charge.
8)      This University offers a free room for each foreign teacher, in which there is a bathroom with hot water, a bed(beddings cost ¥380 paid by the foreign teacher), a combination of bookshelf and desk, a TV set, a refrigerator, an air-conditioner, a washing machine, a wardrobe, and a microwave oven. There is a shared kitchen on each floor.
9)      Each room is equipped with a 200-card phone (200-card is a special pre-paid phone card purchased by the foreign teacher).
10)   No pets are allowed.
11)   This University is responsible for obtaining an affirmation letter from the provincial government and an invitation letter from the municipal government so that the foreign teacher may apply for a work visa within his/her own country. Upon the arrival of foreign teachers, This University is responsible for getting Residence Permit and Foreign Expert Certificate, and pays for them.
12)    This University provides a free Chinese language training program for foreign teachers.
13)   Within the valid period of the contract, if a foreign teacher plans to leave This University due to some private affairs, he or she must ask Foreign Exchange Office for leave. Only after getting the permission can he or she leave, but some money will be deducted from his or her pay according to the days he or she is absent (not including Saturdays, Sundays, festivals and holidays).
14)   As to the incompetent teachers and the teachers who break the Chinese laws and/or the school regulations, This University has the right to terminate the contract. Should this matter arise all airfare and travel allowance will no longer be paid
15)   Without the consent from This University’s International Exchange College, the foreign teachers are not to take any teaching positions outside of This University, and are not to take up any job that is not listed in the contract, during the valid period of the contract (including weekdays,weekends and holidays).
16)   Foreign teachers must abide by China’s and This University’s laws and regulations, and they must strictly implement the Contract and the Appendix. They must carefully prepare and teach each class. They shouldn’t go to the classroom late, shouldn’t dismiss the class early, and shouldn’t miss any class. Should an emergency arise or an illness
occur, please ask the International Exchange College for leave.
17)   The probation is one month. If the foreign teacher turns out to be unqualifiedwithin the probation period, This University will not employ him/her, and no money whatsoever will be paid.
