This is a contract of employment between This high schoolGAC Program (set up by This high school and an Education Service co.,ltd of Jiangsu Province) ,referred to below as “the School”, and ­­     _____referred to as “the Teacher”.
这是该中学GAC项目(由该中学和江苏省某公司合作举办),以下称“学校”和_­­__________ __,以下称“教师”的聘用合同。
 1WORK DUTIES 工作职责
The Teacher shall carry out duties as assigned by the school and as specified in the school’s Work Regulations for Teachers.
教师需履行的职责包括:学校规定的职责,学校《教师工作守则》中规定的职责。
 
2. SALARY 基本工资
The Teacher shall be paid a monthly salary of RMB _ ___   Yuan before tax. Salary payment, after deductions for tax, will be paid to the teacher’s personal account on 28th on banking day.
教师的基本月薪为_ __元人民币。工资在扣除税收后,将由学校方在每月28日(银行工作日)支付在教师个人账户上。
 
3.ADDITIONAL PAYMENT 额外报酬
 
3.1.If the Teacher fulfils the contract, he/ she can also be given _4000__ RMB completion bonus  as set out in the Work Regulations for Teachers. The School will pay 1500 RMB for the teacher’s medical insurance and all the expenses for visa (including the foreign expert certificate and working visa).
根据《教师工作守则》,若教师完成合同, 将得到完成合同奖金_4000__元。学校将支付1500元为教师办理医疗保险,并将承担办签证所需费用(外专证及工作签证)。

Notice: the Teacher will receive training for 2 days with no salary, so the teacher should arrive at the School 2 days ahead.
备注:教师将接受2天的培训,学校不支付额外报酬。因此教师需提前两天到校报到。
 
5. NOTICE 备注
 
5.1 The Teacher must give the school at least one month’s notice of any intention to leave the School before the completion of the contract period indicated above. Leaving this employment with less than one month’s notice will be considered a breach of contract. If the contract is broken, as per above, a 500 US dollar penalty will be incurred., which must be paid immediately upon breach of contract.
教师如在上述合同期限期满前有离职意向时,需提前一个月通知学校。如教师未能提前一个月通知学校便离职,即被认为是违约,支付违约金500美金。
 
5.2 Such payments and benefits described in paragraphs 3.1 above are not due, and any payments or benefits already made will be forfeited if the Teacher does not fulfil this contract.
如教师未完成合同,则不能得到上述3.1条款中所述的费用及福利,并将丧失已经得到的费用及福利。
 
5.3   Every teacher has a trial period of two months. During these two months, if the teacher’s teaching performance is not satisfactory, the School will inform the teacher in spoken or written form and give guidelines for improvement. If the problem has not been solved within two weeks, the School reserves the right to end the contractual agreement between the Teacher and the School during the trial period.
每个教师均有两个月的试用期, 在这两个月中,如教师的教学表现不能令人满意,学校将以口头或书面形式告知教师,并给其指导以帮助其提高。如两周内还不能令人满意的,学校将保留在试用期内终止教师聘用合同的权利。
 
5.4 All other terms and conditions are in the Work Regulations for Teachers.
其他的条款和规定见附件《教师工作守则》。

WORK REGULATIONS FOR TEACHERS

教师工作守则
 
1. 总则CHAPTER ONE - “GENERAL PROVISIONS”
 
1.1宗旨(“Purpose”)
The following Work Regulations (the “Regulations”) define terms of employment and other conditions for a teacher (the “Teacher”) employed by Jiangsu Province Changshu High School GAC Program (the “School”). Those events that are not defined in the Regulations shall comply with all the Chinese applicable laws and ordinances.
本工作守则(以下称守则)对该中学GAC项目(以下称“学校”)聘用教师的条件和条款作出明确界定,本守则中未作界定内容,将按照中国所有适用法律、法规执行。
 
1.2教师定义(“Definition of a Teacher”)
In these Regulations, “Teacher” means an individual who has entered into a Teacher Employment Contract (the “Contract”) with the School, in order to undertake instruction in the English language.
本守则中,“教师”一词指为用英语从事教学工作,与学校签订教师聘用合同的个人。
 
1.3遵守(“Observance”)
The Teacher shall observe the provisions in the Contract, the Regulations, as well as work instructions and orders, and faithfully undertake his/her work duties.
教师应遵守合同条款、守则及其它工作要求,并切实履行他/她的工作职责。
 
1.4文件(“Documents”)
The Teacher shall provide the School with all required documents or copies of documents for visas and other legal obligations. The Teacher shall also provide the school with any other documents which the School may request, in accordance with such form(s) and style as the School may specify.
教师应向学校提供所有为办理签证及其它官方手续所需的文件,以及学校可能要求的其他文件,并按照学校要求的格式和形式。
 
1.5告知(“Disclosure”)
The Teacher must ensure at all times that the School has full details of the Teacher’s current home address and the Teacher’s contact telephone number. It is a requirement of employment by the School that the Teacher has a telephone number at which the Teacher can be contacted.
教师必须保证学校知道其完整详细的居住地址和联系电话。教师向学校提供联系电话号码是学校聘用教师的一项基本要求。
1.6离职后事项(“Transfer of Duties”)
Upon departure (including dismissal), the Teacher shall not only promptly return to the School all instruction materials and all other items which the School may have lent to the Teacher. The teacher should also finish job handover.
离职时(包括解职),教师应及时将所有教学材料及其它学校借给教师的物品交还给学校。并做好移交工作。
 
1.7 离职手续(“Leaving Procedures”)
1) Both reception staff and clients of the School are usually notified by the School one month before a Teacher’s departure. Reception staff and clients of the school should always know about a teacher’s departure before students do. If the Teacher is leaving the School, his/her students should not be told by the Teacher.
学校通常在教师离职前一个月通知学校教务人员。他们有必要在学生之前知道教师离职的情况。如教师离职,不得由教师本人告知学生。
2) Before the Teacher leaves the School’s employment, he/she will be issued detailed instructions of what is required to be done before departure.
在教师离职前,学校会明确告知教师临走时所应做事项。
 
2. 工作职责及工作小时 CHAPTER TWO - “WORK DUTIES, WORK HOURS”
2.1 职责(“Work Duties”)
The Teacher shall execute such work duties as the School may assign. Work duties shall in general mean the following:
教师应按学校要求完成自己的工作职责和义务,工作职责一般指:
1)      To provide English language instruction to teach courses at the School
在学校用英语教授课程。
2)      The teacher must teach under the guidance and requirements of GAC program.
教师必须完全按照GAC项目的课程要求执教。
3)      To participate in such promotional and student recruitment campaigns as the School may organise, including giving demonstration lessons and attending organised school events.
参加学校组织的招生和有关宣传活动,包括上公开课和参加其它学校组织的活动。
4)  Having his/her teaching periodically observed by DOS, and any other persons authorised by the School.
教学过程要定期接受教学总监及学校授权的其他人员监督。
5) Attending and fully participating in training sessions and workshops organised by the School to improve the quality of teaching.
参与由学校举行的旨在提高教师教学水平的培训及活动。
6) The teacher should finish course plan and students’ assessment on time under the requirement and present to DOS on time.
教师需按要求准时完成教学计划和测试,并及时将成绩交与DOS。
7) The teacher should not leave classrooms during teaching period freely. If wanting to change teaching time, the Teacher should tell DOS in advance and get permission.
    教师在授课期间不可随意离开教室。如需更改教学时间,需提前告知DOS并取得同意。
8) Teaching as a substitute for absent colleagues in schools when required.
如有需要,为缺席的教师代课。
 
2.2 工作日及工作时数“Work Days and Hours”
1) The Teacher shall teach not more than 20 contact hours a week..
教师每周授课不超过20课时。
2)      The School may assign the Teacher to give lessons between 7:30 am to 5:00 pm. But the Teacher needn’t stay at office if there are no lessons.
学校可以在上午7:30 到下午 5:00工作时限内安排教师教学课时。但不需坐班。
3) The Teacher’s standard schedule will be five days per week。
教师的标准工作日为一周五天。
4) The Teacher works for 10 months and has two months holiday(5 weeks for summer holiday and 3 weeks for winter holiday)and other national holidays.
    教师工作时间为10个月,享受两个月假期(暑假5周,寒假3周)以及其他正常的国假日。
 
2.3 事病假(“Compassionate Leave and Sick Leave”)
1) The School will grant the Teacher compassionate leave as appropriate, and the Teacher should tell DOS in advance
学校将视情况准予教师事假,但教师必须出示所需的书面证明。
2) If the Teacher needs to be absent from work for health reasons, he or she should call the assigned duty manager as soon as possible and at least two hours before the start of the first lesson of the day. It will be the Teacher’s responsibility to contact the standby teacher to give instructions to him/her as to what should be taught in the class being covered.
如教师因为健康原因不能到校授课,他/她必须尽快---至少在当天第一节课开始前两小时通知指定的负责人。教师有责任与代课的教师联系,并及时给予上课所需的信息。
3)If the Teacher is absent from work, the School may require a doctor’s certificate or other documentation. Inability to submit such documentation may lead to disciplinary action being taken by the School. Disciplinary action will consist of one verbal warning followed by a written warning. If misconduct by a Teacher, the School can terminate his/her contract.
如教师缺席上课,学校可要求其出示医生证明及其他文件。如不能出示这些证明,学校可书面警告教师. 合同期内发生如三次警告,学校可解除合同。
 
2.4 保险(“Insurance”)
The School will pay 1500 RMB toward the cost of the Teacher’s health insurance coverage during the period of the Teacher’s employment with the School. It is a condition of employment with the School that the Teacher have health insurance.
在教师在职期间,学校将支付1500元人民币购买教师的医疗保险。体检合格, 体检费用由学校承担。在教师工作期间拥有医疗保险是本学校的就职条件。
 
2.5 住宿(“Accommodation”)
The School will arrange for necessary furnished accommodation on campus for the Teacher. The Teacher will be charged RMB 300 Per month for utilities of water and electricity. The School will deduct these charges from the Teacher’s salary.
学校将为老师安排校园内的含基本设施的住宿。老师需要自己支付每月300元人民币水电费。这些费用将从教师薪水中扣除。
2.6 签证和注册(“Visas and Registration”)
1) The Teacher should be aware that he/she may require a medical check in China within one week. Failure to pass this medical check will result in the refusal of a Foreign Expert’s Certificate. The Teacher shall pay the fee for the medical check. The Teacher shall then be required to leave China at his/her own expense and his/her Teacher Employment Contract shall become invalid.
教师必须注意在抵达中国之后一周内就应进行体检。未能通过体检者将不予授予外专证,并将自费离开中国,先前的教师就职合同也将作废。
2) The School shall sponsor the Teacher for a Foreign Expert’s Certificate. The School shall pay the costs for the visa (including the foreign expert certificate and visa). The Teacher shall be responsible for the submission of all relevant documentation to the proper authorities and for all actions necessary to maintain the validity of the visa and documentation. If the teacher can’t offer the legal materials to get the Foreign Expert’s Certificate, he or she will be responsible.
学校将为教师获得外国专家证书做担保人。学校将支付在中国的教师为获取外专证及签证所需的费用。教师有责任向政府有关部门提供相关证件,并有责任保证自己的签证和文件有效。如因教师无法提供合法的材料而导致无法办理外国专家证,责任自负。
3) In the case that the Teacher leaves the employ of the School, in accordance with governmental regulation, all such visas and foreign expert’s certificates will be cancelled.
如果教师离开学校,按政府规定,所有的相应证件,签证和外专证都将被取消。
 
3. 职业行为 CHAPTER THREE - “PROFESSIONAL CONDUCT”
 
3.1   General Conduct 基本行为
1) The Teacher must adhere to the School dress code and dress properly as a teacher.
教师的衣着应符合学校规定准则和教师身份。
2)      The School places great importance on the creation of an ‘English language environment’.
Only English may be used by the Teacher in class, in the reception area, and the school premises in general.
学校方会对尽力营造一个“英语语言环境”给予足够的重视。在教室里及接待区,教师
只能用英语。
3) The Teacher shall behave with courtesy and consideration towards all colleagues, other teachers, and local supporting staff. Teachers shall also follow the instructions of the school. Any misunderstanding shall be resolved with patience and under the benefit of students and the school.
教师需谦虚,需关心同事,包括其他教师和中方工作人员,并能按学校的要求工作。任何误解都应耐心解决, 以学校和学生的利益为重。
4) The Teacher shall not ask students to carry out any private tasks and mustn’t promote sales.
教师不得让学生做私事,严禁向学生推销商品。
5) It is essential to remember the position of professional trust in which the Teacher finds him/herself. Behaviour that might be interpreted as sexual harassment must be strictly avoided.
教师要做到为人师表。任何会被认为是性骚扰的行为都应严格避免
6) Smoking is not allowed on school premises or at any teaching locations and in view of the Teacher’s professional status must be avoided in front of students, especially child students, during the Teacher’s working hours. 
在学校或任何其他的授课地点都不得吸烟。出于教师身份的考虑,教师在工作时间必须避免在学生,特别是在孩子面前吸烟。
 
3.2 禁止事项(“Specific Prohibitions”)
The Teacher is specifically prohibited from the following:
教师应特别禁止下列事项
1) Leaving the work place at a time when required to work. Having meetings at the work place that are not related to the School’s business.
工作时间离开工作场所或在工作场所和与学校业务无关的人会面谈话。
2) Working for another school, or carrying out any private paid employment, without the School’s permission.
未经学校明确许可,为另一学校工作,或做其他赚取报酬的工作。
3) Divulging any School secrets, or any other matters about the School that may harm the School’s interests. Using the School’s name or address, or the fact of being employed by the School for conducting any private business for personal gain.
泄漏学校机密,或任何可能会损害学校利益的事情发生。使用学校名称或地址,或以学校雇员名义做取得个人利益的工作。
4) Using any School property for matters not connected with the Teachers work duties without permission.
   未经学校明确许可,使用学校资源做与教师职责无关的事情。
5) Pursuing any political or religious activities at the workplace. Working whilst under the influence of alcohol or drinking alcoholic beverages during working hours.
    在工作场所从事政治或宗教活动。醉酒工作或在工作时间饮用酒精饮料。
6) Damaging the School’s reputation or betraying its trust or causing material harm to the school in any other way.
以任何其它方式损害学校名誉,或辜负学校重托或给学校造成实际损失。
4. 处罚CHAPTER FOUR - “SANCTIONS”
 
4.1处罚(“Sanctions”)
A Teacher who engages in any of the activities described below will be subject to sanctions.
教师有下列行为之一者将受到处罚。
1)          Intentionally or excessively breaking School rules and regulations.
有意或严重违反学校规定和制度
2)          Not preparing for lessons, not teach under the guidance. Refusing to prepare classes after repeated admonition.
教学不备课,不按要求上课。经提醒屡教不改。
3)          Frequently arriving at work late, or leaving work early, or being absent from work without any valid reason.
     经常迟到早退,无正当理由不上班。
4)          Obstructing other School employees from carrying out their duties by force, by violence, or by threats.
      以强制、暴力或威胁阻碍其他学校雇员工作。
5)          Refusing to work or deliberately failing to carry out work duties.
      拒绝工作或故意不履行职责。
6)          Corrupting public morals at work.
      在工作场所破坏公共道德。
7)          Endangering safety in the workplace, especially by removing or deliberately damaging safety equipment.
造成工作场所不安全,尤其是拆除或有意损坏安全设备。
8)          Providing the School with inaccurate and misleading details about his/her personal history at the time of being hired.
     受聘时,向学校提供不准确和含糊不清的个人背景资料。
9)     Any activities specified under 3.2 above.
上述3.2条列述的行为。
 
4.2 处罚形式与程度(“Types and degrees of Sanction”)
In the absence of extenuating circumstances, the School reserves the right to enact the following sanctions.
如果无可宽大处理因素,学校保留下列处罚的权力。
1)   开除Dismissal
In the case of serious, person who blatant infringements three times, the Teacher will be dismissed.
严重违反规定三次者,予以开除。
2) 不够开除时Where dismissal is not appropriate
(a)        First time: By issuing a verbal warning.  
第一次:口头警告
(b)        Second time: By issuing a written reprimand and requiring that the Teacher give a written explanation of his/her conduct and a guarantee that the behaviour will not be repeated. 
第二次:书面批评,并要教师就所作所为写出书面解释并保证不再犯。
(c)        Third time: Making deductions to the Teacher’s salary of no more than 1/10 of the total month’s salary in any one month.
第三次:从任何一个月的工资内扣除不超过工资总额1/10的罚金。
 
4.3   处罚的执行(“Implementation of sanctions”)
1) The School will give the teacher opportunity to explain and excuse his/her behaviour before any sanction is taken.
执行处罚前,学校将给教师进行解释的机会。
2) The School reserves the right to make public any sanctions imposed and the reasons for them.
    学校有权将处罚和处罚的原因公之于众。
3) If the Teacher causes material damage to the School, the School may demand that the teacher bear the cost of redemption.
如果教师给学校造成实际损失,学校可以要求教师承担损失费。
 
5         申诉Grievance
In cases of grievance against the School, the Teacher should make a written representation to the school, or talk to the School authority. The authority will then try to resolve the situation to both parties’ satisfaction. 
在对学校感到不满的情况下,教师可以书面形式向学校发出信函,或可与具有最终解释权的负责人直接对话。以解决争端。
