Introduction
This Training Center was established in 1998 with the aim of providing Chinese people a better and more effective way of learning English. To do this we have adopted some of the world’s most advanced Computer Assisted Language Learning (CALL) software. Web’s teaching system was immediately successful and we have since gone on to establish nearly 80 centers across China, in such cities as: Shanghai, Beijing,Guangzhou, Hefei, Dalian, Chongqing, Hangzhou, Ningbo, Wuxi, Nanjing, Shenyang, Urumqi, Suzhou, Changzhou, Wenzhou, Xiamen, etc.
 
Today, Web has become one of the biggest international English training centers in China. Each year it helps nearly 50,000 people, including government officials, employees in international companies ,university students and high school students. We have a vast network of current and former students around the country all using the Web method to improve their English.
The key idea behind the entire Web system is that we teach language as a skill. To do this Web uses world-class proven multimedia courseware and combines this with highly qualified foreign teachers to provide the students with a complete learning environment.
 
We are committed to small class sizes to ensure that all students get the attention they need. The maximum number of students in Private Classes is limited to 4. In the larger salon classes, where the focus is more on group work and discussion, the maximum class size is 10.
 
This Training Center offers much more though than simply computer self-study and classes. The students can also enjoy a wide range of extra activities, such as English Corners, Social Clubs, Movie Classes and Extra Curricular trips. These are events where the students can mingle with the foreign teachers that come from a range of different countries, and practice English in a totally natural, real-life way. In this way not only will the students’ language skills improve but also their cultural knowledge.
Compensation package for Full Time ESL Teachers:
7000-8000RMB salary

SAMPLE CONTRACT
ESL Teacher’s Agreement is attached to the standard contract. Should any conflicts arise, the ESL Teacher’s Agreement prevails.
The parties to this agreement are This Training Center - herein called the Employer,
and - herein called “the Employee”; and it is made with reference to the following:
The Employer is duly licensed to teach English language and has all the required governmental clearance to do so.
This agreement is subject to changes as to comply with local labor laws; when the local labor laws are not addressing specific terms of this agreement, this agreement will prevail.
The Employee is a qualified and experienced Employee and has applied to the school for employment as Employee.
The Employee and the Employer have agreed on the following terms of agreement:
Title:
The Title of the Employee is “ESL Teacher”.
Term:
The term of this agreement is one year commencing and continuing until
Duties
The duties to be performed by the Employee include:
1. Teaching English for This Training Center students. The location may be in This Training Center or outside.
2. Teaching demo classes for customers.
3 Lesson planning and preparation as well as curriculum development
4.Supervising test and exams and giving level tests
5.Assisting with administration including intake and placement of students and recording attendance
6. Counselling students
7. Participating in the school’s social program including Extra Curricular Activities (ECA’s)
8. Participating in Employee training programs and workshops organized by the school
9. Participating in promotional and marketing activities organized by the school
10. Attending all scheduled meeting where his/her presence is required.
11. Other tasks assigned by the Education Department and our school in his/her working hours, including meeting.
Employee’s Obligation
The Employee warrants as follow:
1. The statement in the Employee’s curriculum vitae, resume and references together with any other information submitted to the Employer in support of the Employee’s application for employment are true and not misleading in any way
2. The Employee is of sound mind and in good physical health
3. The Employee will devote his full working time and attention to the duties of his employment
4. The Employee will perform the duties of his employment in a professional and diligent manner
5. The Employee will obey the written and/or verbal orders and directions of the school’s management
6. The Employee will at all times comply with the terms and conditions of this agreement and the rules and regulations of the Employer in effect from time to time including the provisions in the Employee’s Handbook where applicable
7. The Employee must, at all times, comply with the laws of the PRC
8. The Employee must not harm the image of the Employer or fellow workers by his/her conduct
9. The Employer has the right to appoint the Employee to work in his franchisee schools.
Remuneration
The Employee’s remuneration will consist of the following:
1. A basic monthly salary of RMB 7000 for the first two months (probation period), which is due and payable on the 10th of each month, not in advance.. Salary review will be made after two months probation. The Employer reserves the right to extend the probation period if the employee’s performance is under expectation.. After probation, the employee’s salary will be RMB 8000 based on his probation performance.
2. Party B is responsible for accommodation him/her self as well as the related utility expenses. Party A shall only cover the monthly housing allowance of RMB 1,000 which is settled each month with the exception of the first and last months of employment, in which cases the housing allowance should only cover the actual days of employment of that month. The payment will be made on 10th of the next month. Any unused portion the housing allowance will be applied to the Employee’s salary and taxed at the appropriate rate.
3. There will be a payment toward airfare costs of RMB 3,000 after the Employee has worked for the school for six months, and, a second payment of RMB 3,000 after twelve months working. If the ESL teacher takes more than 10-day unpaid leave within six months, the airfare cost will be deducted accordingly.
4. If the unpaid leave is taken, the all remuneration, including monthly salary and housing allowance, is paid according to the actual working days.
Working Hours
Working hours per week are 40 hours at most, including 25 teaching hours between 09h00 and 21h00 Monday to Friday and on weekends.
Should the Employee not complete the total of 25 teaching hours per week but has not refused teaching, was able and willing to work; taken that it is the Employer’s responsibility to provide the Employee with the sufficient amount of hours, no deduction shall be taken from the Employee’s salary.
The Employee will be given a weekly schedule, however the Employer reserves the right to change schedule as required. The Employer will attempt to accommodate the Employee’s schedule to offer two days off consecutively. However, due to fluctuating student demand, the Employer reserves the right to separate those two days off.
Overtime teaching
Overtime will be calculated on a “per month” basis not on a weekly basis. The Employee will either be paid overtime teaching salary or take the overtime hours off in lieu after approved by hi/her supervisor/ manager or be given overtime salary. Overtime teaching salary rate is RMB 100 per hour.
Taxes
The basic salary as referred to in section titled “remuneration” is before tax, the Employee is therefore responsible for the payment of local taxes in China and in his/her country if applicable. However, according to the laws in PRC, the employer deducts the income tax from the salary for the employee every month.
Other parts of the Employee’s remuneration may be subject to taxes.
Holidays
The Employee will be given all statutory holidays. Those holidays are National Day, New Year’s Day, Spring Festival,Labor Day,QingMing Festival,Dragon Boat Festival and Mid-autumn Festival.
In addition the Employee will be granted a 1-day paid holiday around Christmas time. The holiday will be scheduled according to the actual situation of the center.
The above statutory holidays shouldn’t be counted as part of the employment term for any employee whose service days are less than 1 month.
After completion of 7 months on a year agreement, the Employee will be entitled to take paid vacation time for a total of 5 days. Annual leave could not be taken during July and August. If any extra holidays need to be taken, the employee needs to submits an application 30 days in advance and send it to HR Department for reference. He/She can take the holiday after his supervisor/manager and the school’s director approve this. The said employee, if required, shall leave a phone number for contact. The employer reserves the right to approve and specify the dates on which Employees will be on holiday.
Sick leave
The Employee is allowed 2 sick days without deduction of salary during the period of employment referred to in the section titled “Term”. Extra sick days are not paid and the Employer reserves the right to deduct an amount from the Employee’s salary for each additional day that the Employee is absent from work. This amount should be prorated to the total number of working hours the Employee has not taken.
In the case of the employee being unable to work due to illness, they must get the approval of their direct manager, advise HR and complete a form stating the need for leave (If they can not come to the office due to illness, they should ask a colleague to proceed on their behalf). If an employee is found to have left for sick leave without applying and permission from the supervisor in advance , this shall be reckoned and treated as absence without leave.
When the employee comes back to work after illness, they must send the sick leave form to HR for reference, together with the doctor’s certificate. Otherwise, this shall be reckoned and treated as absence
without leave.
Should the Employee be diagnosed as not capable of resuming work after a 30 days consecutive sick leave, the Employer reserves the right to terminate the agreement as stated in the section titled termination, unless the illness is proven to be in direct relation with the work performed by the Employee
Bereavement Leave
Three days bereavement leave will be paid for the death of member(s) of immediate family, including Mother, Father, Brother(s), Sister(s), Child, Grandparents.
Application for leave should be submitted with a copy of the death certificate.
Termination
During the probation period, both parties may terminate this agreement in accordance to the following:
The Employee is required to give notice 7 working days in advance by notice in writing to the Employer.
The Employer reserves the right to terminate this agreement in the following circumstances:
1. The Employee brings the school into disrepute by his/her conduct
2. The Employee breaches the confidentiality clause as referred to in section “confidentiality”
3. If the Employee is guilty of dereliction of duty, incompetence, insubordination, dishonesty or other breaches of the Employee’s obligations under this agreement or the rules and regulation of the college.
4. The Employee has been complained about by the students regarding his/her teaching quality for three times within two months. Further to this, a student survey will be conducted. The average result of the survey should reflect an 85% or higher student satisfaction rate. Failing this the employee will be given a chance to improve upon their performance. If the employee fails to demonstrate sufficient progress in a subsequent survey, the employer reserves the right to terminate employment.
5. The Employee has been diagnosed not capable of resuming work after 30 days consecutive sick leave
The Employee reserves the right to terminate this agreement with a two-month notice in writing.
After receiving the Employee’s notice, the Employer has the right to terminate this agreement within two months.
If either Parties wishes to terminate the agreement before the agreed date, it must give a two-month notice in written to the other party, otherwise it will compensate the other party to the amount of one month’s basic salary as referred to in section titled “remuneration.”
If the Employee is appointed to work in one of the other centers of This Training Center, this agreement will be terminated as the Employee will sign another agreement with that center when he/she begins to work with them.
In the unlikely event of a disaster such as earthquake, fire, flood, civil unrest, etc. that would make the Employer unable to continue operating business, the agreement will be considered null and void and the Employee will be under no obligation to stay.
Confidentiality
The Employee will keep all information about the Employer’s teaching methods and administration confidential,
The Employee will not disclose details of his/her agreement
The Employee will not use the Employer’s teaching method and materials in the instruction of any private student and/or with another Employer
The obligation of the Employee concerning the section titled “confidentiality” will survive the termination of this agreement.
Other Employment
The Employee acknowledges that the Employer’s business is highly competitive and to protect the Employer against unfair competition including unauthorized use or disclosure of its methodology and other sensitive information, the Employee warrants that as long as he/she is employed by the Employer, he/she will not carry on or be employed or concerned in any business, whether directly or indirectly, if that business is similar to or in competition with any part of the Employer’s business.
After termination of this agreement, the Employee will not operate a business in direct competition with the Employer within a year of the agreement termination. Additionally, due to the competitive market and in regards of unfair competition practices, the Employee agrees to not accept employment with the Employer’s direct competitor(s) who shares the similar model to our teaching style in the same city within a year of the termination date.
General
This agreement will be interpreted in accordance with and is subject to the laws of PRC. The parties submit irrevocably to the jurisdiction of the courts of the PRC in respect of any dispute relating to or concerning this agreement.
The terms and conditions of this agreement prevail over any conflicting or inconsistent provisions of the Employer’s rules and regulation in effect at any time. This agreement is effective immediately and supersedes any prior agreements, understandings or representations relating to or concerning the Employee’s employment by the Employer.
Should the Employee desire to renew this agreement, he/she should formally make the request no later than a month prior the termination date of this agreement
Each party will receive a signed copy of this agreement. Both versions are identical and equal in the eyes of the law. The Employee acknowledges receipt of a copy of this agreement.
