CONTRACT
I. 甲方愿聘请_____________________任我校外籍英语教师。双方友好地达成共识并签署此合同，同时将认真履行所有的规定与义务。
Party A wishes to engage the service of party B _____________________as foriegn teacher. The two parties, in a spirit of friendly cooperation, agree to sign this contract and pledge to fulfill conscientiously all the obligations stipulated in it.
II. 本合同起始时间为2011年______月______日至2012年______月______日。
The period of service will be from the _________ ,2011 to___________ ,2012.
III. 乙方责任
The duties of Party B
u 乙方额定工作量为24小时/周。在征得乙方的同意下，甲方可以根据课程需要临时安排乙方24小时以外的工作，同时甲方将根据小时支付乙方计时工资。
Rated workload is generally 24 hours per week.Party A have to get party B’s permission and offer appropriate compensition if there’s any extra tasks Or hours more than 24 hours.
u 如果乙方因为自身原因而不能完成指定的教学任务，甲方将酌情扣减工资。
Party A can deduct the salary appropriately if party B cannot finish the teaching hours assigned because of party B’s own reason.
IV. 薪资与福利
Salary and Benefits
u 标准：人民币8，000元/月
Level: 8，000RMB /Month
薪资标准根据乙方的教育程度、工作经验和教学效果评价而定。
Salary standard is based on Party B’s academic qualifications , work experience and teaching effect assessment.
u 薪资的计算与支付。薪资计算从乙方第一天开始担任教学工作至最后一天结束教学工作。乙方领取工资的日期为每月的15日至18日之间。
salary calculation and payoff: Start to calculate salary at the first day party B teach and stop calculating at the last day of teaching. Party B get paid by days if work less than one month. The pay day is every month 15th-18th.
住宿：
Hoursing：
Level：2，000RMB/Month
标准：人民币2，000元/月
u 甲方不提供公寓，仅提供给乙方每月2，000元的住房补贴。如果乙方想要租住条件超过2000元/月标准的公寓，差额部分将由乙方自行承担。
Party A will pay Party B RMB 2,000/Month housing allowance instead of offering an apartment. Party B have to pay the part that more than 2,000RMB by themselves if ask for better living conditions.
u 乙方需自行承担水电费、宽带费和电话费及其他费用。
Party B shall pay fee of electricity，Internet and telephone and other expenses.
u 乙方在圆满完成一年全职教学工作的情况下，甲方将支付给乙方往返机票补贴，即人民币6，000元整。
Return air-ticket will be reimbursed with satisfactory completion of one-year full-time service for party A. The return air tickets should be under 6,000RMB.
u 乙方享有中国的法定节假日
Party B have the chinese legal festivals and vacation.
1）每年的7月至8月之间，乙方将享有3周无薪暑假。
party B enjoy the summer vacation (3 weeks) without pay From July to Augst every one year.
Ⅴ 奖金
Bound bonus
u 甲方将对乙方进行季度考核。如果通过考核，乙方薪资将增加人民币500元。如果乙方连续2次未通过考核，甲方将有权终止合同。
Party A will assess the teaching effect every three months. Party B will get 500RMB pay raise if pass the examination. Party A has the right to terminate the contract if Party B can‘t pass the examination for continuous 2 times.
Ⅵ 病假/事假
Sick /private affair leave
u 病假累计不得超过10天，且乙方需出具医院开具的诊断证明。工资将扣除缺少课时数按月发放。若乙方请病假超过30天，甲方有权延长合同30天。
Party B need doctor approvement if ask for sick leave. Cumulative days shall be less than 10 days. Get paid by month as usual if sick leave days are less than 10 days. Get paid by days if sick leave days are more than 10 days but less than 30 days. Party A have right to terminate contract if the sick leave days are more than 30 days.
u 如果乙方请事假天数累计少于10天或连续请假大于3天，甲方将扣除此阶段乙方额定课时费用。如果乙方在未征得甲方的同意下而矿工，甲方有权根据情况延长合同。
Deduct salary by days if party B ask private affair leave. During the period of contract, days shall be less than 10 and continuous days shall be less than 3. Deduct 3 days salary if party B are away from duties without the permission.party A have the right to terminate the contract if it is serious.
Ⅶ 其他规定
Other regulations
u 乙方应遵守员工规定，切忌体罚学生或辱骂学生。乙方应积极参与到课后解答家长疑问、与家长沟通并积极参与到学校组织的各项活动中。
Party B shall obey the stuff regulation, not hit or abuse students, finish every routine work as a teacher. Solve the problems of the parents after calss and join the school activity, act with professional morality.
u 如果因不可抗力而导致合同结束或中止合同时，乙方应做好调整。
party B shall make appropriate transition(including things and working content)when contract finished or terminate the contract with unavoidable reasons.
Ⅷ 甲方义务
Party A’s Obligations
u 甲方须向乙方介绍中国政府制定的法律法规及有关规定，同时甲方需要向乙方说明学校关于外籍教师的管理规定。
Party A shall introduce to Party B the laws, decrees and relevant regulations enacted by the Chinese government, the Party A’s work system and regulations concerning administration of foreign teachers.
u 甲方应指导、监督和评估乙方的工作。
Party A shall conduct direction, supervision and evaluation of Party B’s work.
u 甲方应按规定时间支付乙方工资。
Party A shall pay part B on time.
u 甲方不负责乙方在华期间的人身安全。
Party A shall not be responsible for Party B’ safety of the period in China.
Ⅸ 乙方的义务
Party B’s obligations
u 乙方须遵守中国的法律、法规、法令和中国政府的其他法律规定，并且不得做有影响中国法律和甲方规定的各项管理制度。如违反，乙方须自行承担后果，并对甲方进行补偿。
Party B shall observe the laws, decrees and relevant regulations enacted by the Chinese government and shall not observe Party A’s administrative regulations. Otherwise ，The consequences shall be borne by Party B. And Party b must indemnify Party A for his loss.
u 乙方须接受并严格遵守甲方的有关外籍教师的工作制度和管理规定，并且接受和参加甲方组织的培训与考核。在未征得甲方的同意下，乙方不得涉猎本职工作之外的学校其他事务。并接受甲方在工作中对乙方的指导、监督和评估。
Party B shall observe Party A’s work system and regulations concerning administration of foreign teachers and shall accept Party As agreement, direction, supervision and evaluation in regard to his/her work. Without Party As consent, Party B shall not render service elsewhere or hold concurrently any post unrelated to the work agreed on with Party A. At the same time, Party B should accept the direction, supervisor and assessment.
u 乙方须按时并且保质保量地完成甲方分配的工作。
Party B shall complete the tasks agreed on schedule and guarantee the quality of work.
u 乙方须严格遵守中国的宗教政策，不得从事和从事与教师身份不相符的宗教宣传活动。
Party B shall respect Chinese religious policy, and shall not conduct religious activities incompatible with the status of a teacher.
u 乙方须尊重中国的道德规范与风俗习惯。
Party B shall respect the Chinese peoples moral standards and customs.
Ⅹ 本合同附件为正式合同不可分割的一部分，与合同具有相同的法律效力。若出现歧义，则以中文示意内容为准。
The appendix of this contract is an inseparable part of the contract and has equal effect. If there is ambiguity in the contract,should be subject to the Chinese translation.
ⅩⅠ 本合同自签字之日起生效，合同期满将自动失效。如果甲、乙任意一方需要重新签订合同，须在合同期满前30天提出，并在30天内签订新合同。
This contract takes effect on the date signed by both parties and will automatically expire when the contract ends. If either of the two parties asks for a new contract, it should forward its request to another party 30 days prior to the expiration of the contract, and sign the new contract with mutual consent.
Party B shall bear all expenses incurred when staying on after the contract expires.
ⅩⅡ 仲裁
Arbitration
若甲乙双方出现分歧、发生争端时，双方应先就出现的每一个问题进行协商。如协商失败，双方当事人可上诉外国专家局、国家工商局要求最终仲裁。
The two parties shall consult with each other and mediate any disputes, which may arise about the contract. If all attempts fail, the two parties can appeal to the organization of arbitration for foreign experts affairs in the State Bureau of Foreign Experts and ask for a final arbitration.
