This University of Technology , founded in 1955, is a public college of higher education run jointly by the state and Henan provincial government. Through the endeavors of several generations, the institute has developed into one of the key comprehensive institutes of science, economics, management, arts and law with engineering as its dominating sector. At present, the institute consists of 18 schools and departments and offers 19 postgraduate programs and 37 undergraduate programs to over 14,000 full-time students.
The university boasts an excellent faculty experienced in teaching, research and administration. Among the 815 full-time teachers, 240 are professors and associate professors and 330 are lecturers. There are also 40 visiting professors and part-time teachers working for the university. The University is one of the first group of colleges approved by the State Administration of Foreign Expert Affairs and the Ministry of Education to employ foreign experts and enroll foreign students. With a total area of 0.9 square kilometers the university is based on three campuses (the base, the west and the south). Two of the campuses (the base and the west) are located on Zhongyuan Road close to Zhengzhou Municipal Government. The newly-built Longhu campus is situated to the south of the city in the Longhu Development Zone of Xinzheng City. Sample Contract
Ⅰ.Party A: This Institute of Technology wishes to engage Party B: as the school’s English teacher. According to the mutually agreed principle of friendly cooperation, the two parties enter the contract willingly and agree to earnestly meet their obligations.
II. Party B's working visa will be from ,year to ,year.
III. Party A's Obligations
1.Party A shall introduce Party B the Laws, decrees and relevant regulations enacted by the Chinese government, the Party A's work system and regulations concerning administration of foreign teachers.
2.Party A shall conduct direction, supervision and evaluation of Party B's work.
3.Party A shall provide Party B with a co-worker.
4.Party A shall provide Party B necessary working and living conditions. Party A shall provide Party B with a standard room including a bathroom and a kitchen in the Party A's campus free of charge. The apartment is furnished with all necessary apparatus, such as telephone, cable TV, washing machine, microwave oven, refrigerator and computer. Party A also provides Party B with access to a teaching faculty canteen.
5.Party B's working period is from the day of to the day of .
Party B's monthly working salary will be 4000 Yuan RMB with 22 working hours per week. 30% of which can be converted into American dollars every six months. If Party B works extra hours with Party A's consent, party A will pay Party B 50 Yuan RMB per hour.
6.Party A shall provide Party B with a free return way international airline ticket (economy class, return ticket from teacher’s home country to China and return by shortest most economical route) if Party B works in Party A for one year and finishes all the teaching works. Party A shall offer Party B visits to some tourism spots around Henan province free of charge and pay 1100 Yuan RMB to party B for traveling expenses every half year.
7.Party A shall guarantee free medical services in Party A's clinic. Any other hospital expenses undertaken without Party A's permission shall be charged to Party B's account. While Party A will reimburse Party B for the medical expenses if no more than 1000 Yuan RMB with Party A's written confirmation.
IV. Party B's Obligation
1.Party B shall observe the laws, decrees and relevant regulation enacted by the Chinese government, and shall not interfere in China's internal affairs.
2.Party B shall respect China's religious policy, and shall not conduct religious activities incompatible with the status of an expert or take part in any activities unfavorable to Party A. Party B shall respect the Chinese people's moral standards and customs.
3.Party B shall observe Party A's work system and regulations concerning administration of foreign experts and shall accept Party A's arrangement, direction, supervision and evaluation in regard to her work. Without Party A's consent, Party B shall not render service elsewhere or hold concurrently any post unrelated to the work agreed on with Party A.
4.Party B shall teach speaking and written English 22 hours per week assigned by Party A and fulfill other assistant teaching works and guarantee the quality of teaching work.
5.Party B shall accept the rewards or punishments given by Party A for Party B's good or bad teaching work.
6.Party B shall pay US $500 cash deposit to Party A against fulfilling the contract when Party B reaches Party A within one month. After the contract is fulfilled normally, party A shall return all the deposit.
V. Revision, Cancellation and Termination of the Contract
1.Both parties should abide by the contract and should refrain from revising, canceling, or terminating the contract without mutual consent.
2.The contract can be revised, canceled, or terminated with mutual consent. Before both parties have reached an agreement, the contract should be strictly observed.
3.Party A has the right to cancel the contract with a written notice to Party B under the following conditions:
(1)Party B does not fulfill the contract or does not fulfill the contract obligations according to the terms stipulated, and has failed to amend after Party A has pointed it out.
(2)According to the doctor's diagnosis, Party B cannot resume normal work after a continued 30-day sick leave.
4.Party B has the right to cancel the contract with a written notice to Party A under the following conditions:
(1)Party A has not provided Party B with necessary working and living conditions as stipulated in the contract.
(2)Party A has not paid Party B as scheduled.
VI. Breach Penalty
1.When either of the two parties fails to fulfill the contract or fails to fulfill
the contract obligations according to the terms stipulated, that is, breaks the contract, it must pay a breach penalty of US $500 (or the equivalent in RMB).
2.If Party B asks to cancel the contract due to unforeseen circumstances, it shall produce certifications by the department concerned, obtain Party A's consent, and pay its own return expenses. If Party B cancels the contract without valid reason, it shall pay its own return expenses and pay a breach penalty to Party A.
3.If Party A asks to cancel the contract due to unforeseen circumstances, with the consent of Party B, it shall pay Party B's return expenses; if Party A cancels the contract without valid reason, it shall pay Party B's return expenses and pay a breach penalty to Party B.
VII.This contract takes effect on the date signed by both parties and will automatically expire when the contract ends. If either of the parties asks for a new contract, it shall forward its request to the other party 60 days prior to the expiration of the contract, and signs the new contract with mutual consent. Party B shall bear all expenses incurred when staying on after the working period is over.
VIII. Arbitration
The two parties shall consult with each other and mediate any disputes which may arises about the contract. If all attempts fail, the two parties can appeal to The State Bureau of Foreign Experts in China and ask for a final arbitration.
This Contract is signed by , in duplicate, on the day of ,in English and Chinese languages. The two texts in English and Chinese are equally valid.
