2- Background签订背景:
This Agreement is made between International College of This University (hereafter referred to as Party A), and Mr. /Ms. (hereafter referred to as Party B), for fulfilling the said employment term as noted in this contract.
本协议于由某某学院国际学院（甲方）和 先生/女士（乙方）共同签订，旨在完成合同提及条款。
Both contracting Parties hereby agree and accept that this contract will be legally valid, effective and legally binding from the date of signing by both Parties.
合同双方同意自签订之日起，该合同合法生效，对双方具有法律约束力。
Both Parties hereby agree and accept that this contract is drafted and signed only in both English and Chinese in the form of a Hard Copy. Each party shall keep one Hard Copy of the Contract in her /his respective file.
双方同意本合同原件仅用英文和中文制定和签署。双方各保留一份原件。
3- Recitals引言:
WHEREAS, the purpose of this employment and the basis of this contract are that Party A wishes to recruit an English teacher from August 25th 2014.
该雇用项目的目的和本合同的建立基础是：甲方希望从2014年8月25日开始雇用一位英语教师。
WHEREAS, Party B is willing to pursue a teaching position and has accepted and conditions offered by Party A. Party B hereby has agreed and accepted to render his/her service as an English teacher from August 25th 2014.
乙方愿意作为英语老师，接受甲方提供的条件，在此同意自2014年8月25日起从事英语教师工作。
The probationary period for Party B will be one month from the school start. Should Party B conduct acts during the probationary period that do not meet Party A’s recruitment requirements and Party A does not know them until the probationary period because of Party B’s intentional efforts to conceal them, then Party A has the right to terminate the Contract during the probationary period without paying any compensation to Party B. Party A’s recruitment requirements include: no criminal record; in good health condition; at the age of 23 to 60; two years of teaching related experience after Bachelor degree; teaching certificate; ability to teach the course and active working attitude.
本合同规定乙方的试用期为开学后1个月，试用期内乙方有不符合甲方录用标准的行为，由于乙方故意隐瞒原因使甲方在试用期才得以知晓的，甲方有权解除本合同，甲方不需向乙方支付经济补偿金。甲方录用标准包括：无犯罪记录、身体健康、年龄在23—60岁、获得学士学位后两年教育相关工作经验、教师资格证书、教授指定课程的能力和积极的工作态度。
4- Responsibilities and Obligations of the Parties双方责任和义务:

4.1-Party A hereby agrees to provide Party B with the following list of conditions and offers:
甲方同意提供给乙方如下条件：
1-The work load is to teach no more than 20 class hours per week as assigned by Party A.
甲方分配的工作量不超过每周教20课时。
2-Party A hereby agrees and accepts to provide Party B an apartment for free. In this dormitory or apartment, Party A will equip colour TV, fridge, washing machine, bed and bedding, furniture, kitchen, electric stove, air conditioner, heater, internet access, hot water heater, bathroom with shower. Party B will pay for the cost in the apartment including electricity, internet access etc. Repairs and maintenance of equipment and facilities caused by Party B’s misuse or found to be user’s responsibility are to be at Party B’s expense.
甲方同意为乙方提供免费住宿，宿舍或公寓内设有彩色电视、冰箱、洗衣机、床和床上用品、家具、厨房、电磁炉、空调、暖气、互联网接口、热水器和带淋浴的浴室。乙方支付公寓使用的电费、网费等。由于乙方使用不当或用户原因导致的设备和设施损害，由乙方承担维护费。
3-Party A agrees that he will not release information on this contract to other parties.
甲方同意不向其他方提供本合同信息。
4.2- Party B promises the following:
乙方承诺如下：
1-Party B hereby agrees and accepts to observe and comply with all Chinese laws, regulations, and relevant regulations of the local community and school during his/her entire service. Party B will not interfere in Chinese internal political affairs and will not conduct any religious activities on campus. Party B will not conduct other inappropriate actions on campus.
乙方同意在其任职期间遵守中国法律、法规，以及社区和学校的相关规定。乙方不干涉中国内政，不在学校从事宗教活动, 不从事其他不当行为。
2-Party B will have to respect the moral standards and customs of the Chinese people. This specially includes maintaining an appropriate professional appearance and standard of behaviour.
乙方须尊重中国人民的道德准则和习惯，特别是保持良好的职业形象和行为准则。
3-Party B hereby agrees that he/she will not be employed by other employers. Party B agrees to work according to Party A’s arrangement, and follow Party A’s management.
乙方在此同意不会受聘于其他工作单位。乙方同意根据甲方安排开展工作，并接受甲方管理。
4-Party B agrees with the requirement of Party A to engage in teaching related conducts, including the following:
To participate academic meetings;
To communicate with students and other teachers;
To taking and/ or supervise student attendance;
To design, assign and correct assignments and exams;
To collect and report to Party A the results according to Party A’s requirement;
To sample students’ assignments and exams papers;
To provide report on students’ overall results;
To join pre-term training and after-term planning;
To return all work-related files and reference books to Part A before the end the contract period.
乙方参加甲方要求的教学相关活动，包括：
参加学术会议；
与学生和其他老师交流；
记录并监督学生考勤；
布置并修改作业，组织考试；
按甲方要求上报成绩；
抽选学生的作业和试卷；
提供学生总成绩报告；
参加学期前培训和学期后计划；
合同结束前归还工作相关资料和参考书。
5- Party B will use the teaching materials provided by Party A and develop an appropriate teaching plan. Party B should always be well prepared with sound teaching plans and conscientiously apply his/her teaching plans to the best of his/her ability to ensure a high quality education for students. Party B should keep his/her teaching plans for review.
乙方使用甲方提供的教材，形成合理的教学计划。乙方应切实按合理的教学计划工作，最大限度发挥自己能力，从而保证高质量完成教学任务。乙方应不断评估自己的教学计划。
6- Party B will communicate with the students in a professional manner.
甲方应用恰当的方式与学生交流。
7-Party B hereby agrees to inform Party A before class in case Party B is sick and can not go to work. In this case, Party B needs to present Party A proof from hospitals either in advance or in a timely manner. Classes missed due to sickness must be made up at a later date. Party A reserves the right to deduct the appropriate amount of pay for Party B’s absent class hours. If missed classes are made up later, the deduction will be reimbursed.
如果乙方因病无法工作，提前应向甲方告知。此时，乙方应向甲方提前或及时提供医院病例。因病缺课必须在之后补课。甲方保留扣除乙方缺课薪酬的权利，如果缺的课在之后补课，扣除的薪酬将得到补偿。
8-In the case of either absence or a failure to attend a class on time without a prior notice and approval from Party A, for any reason except for an emergency situation, party B agrees and accepts that 150 RMB / class hour will be deducted for missing class and 50 RMB / class hour for being late.
除紧急情况外，乙方如果未提前通知和甲方同意旷课或迟到，应受到150元/课时的旷课处罚和50元/课时的迟到处罚。
9-Party A is not responsible for any of the medical expense by Party B. Party B acknowledges that he/she is responsible for all the medical expense by himself. Party A suggests Party B obtain medical insurance by himself. If Party B returns for a second school year and purchase medical insurance, Party A will offer Party B half of the medical insurance fee (before-tax) for compensation. In this case, Party B shall pay the tax involved.
甲方不对乙方的任何医疗支出负责。乙方知晓自己将承担所有医疗支出。甲方建议乙方购买医疗保险。如果乙方第二年继续任教并购买医疗保险，甲方将向乙方支付医疗保险一半费用（税前），涉及税款由乙方承担.
10-Party B is required to obtain his/her Chinese working visa (Z visa) at his/her own expenses before he/she starts work at ICBUA, and arrive at ICBUA one week ahead of school start.
乙方应在来校工作前获得来华工作签证，费用自理, 并在开学前一周到校。
11-Party B is required to register his/her residence at the local police office within 24 hours upon his/her arrival.
乙方应在到达24小时内前往在华居住地派出所进行住宿登记。
12-Party B shall be responsible for the consequences such as fines or other penalty for overdue documents such as visa and residence permit. If Party B break Chinese laws or relevant regulations and have to pay fines, Party B will take the responsibilities.
乙方对签证和居留许可等文件过期产生的罚款和处罚等后果负责。如乙方违法中国法律法规，需接受罚款时，乙方应自己承担后果。
13-Party B agrees that he/she will not release information regarding ICBUA’s teaching methods, teaching resources, and student information, etc. to any other parties.
乙方同意不向其他方提供教学方式、教学资源和学生信息等情况。
14-Party B agrees that he/she will not release information on this contract to other parties.
乙方同意不向其他方提供本合同信息。
5- Compensation报酬：
1-Party A provides Party B with 11 months’ payment at the rate of, 8,727 RMB (post-tax). The payment will be issued monthly according to the arrangement of Financial Department of Party A.
甲方分11个月向乙方支付每月8,727元（税后）的薪酬。薪酬发放由甲方财务处安排按月发放。
2-Party A provides Party B with transportation service from the pick-up place to the assigned apartment only upon Party B's first arrival.
甲方仅为乙方首次来华提供接机服务。
3-Party A will provide Party B basic accident insurance at a Chinese insurance company. Foreign teachers who want or need access to medical care at foreign clinics and hospitals will need to be prepared to cover those expenses either directly or through international medical insurance by themselves.
The basic accident insurance at local Chinese facilities includes:
*Coverage is for accidents that occur within China.
*The Chinese insurance company sets payout limits.
*Coverage is for treatment at regional-level Chinese hospitals appointed by insurance company.
甲方为乙方提供在中国保险公司的基本意外保险。如果外教需要在外国医疗机构就医，需要自己承担费用或通过国际医疗保险。
在中国医疗机构的基本意外医疗保险包括：
在中国国内发生的意外；
中国保险公司制定保险条款；
仅限于保险公司指定的中国地区级医院。
4-Party A is responsible, upon Party B’s first arrival to China, for the arrangement of medical examinations, the initial application for Foreign Expert Certificate, Residence Permit and pay the relevant fees; upon expiration of this contract, if both sides agree to extend the contract for another year, Party A shall be responsible for the arrangement for the extension or renewal of the documents mentioned above, as well as for the cost involved upon signing of renewed contract.
乙方初次来华，甲方有责任安排乙方体检，办理外专证和居留许可，并支付相关费用；如果合同到期之际，双方同意延长一年合同，甲方有责任安排办理以上证件延期手续，并支付合同延期所需相关费用。
5-Party A shall only assist Party B for the first time and the last time documents formalities application. Any documents formalities application involved during the contract period will be Party B’s own responsibility and on his/her own expense.
甲方仅负责协助乙方办理初次和最后一次的书面手续申请。合同期间其他书面手续申请由乙方个人负责，个人承担费用。
6-Party B shall enjoy Chinese public holidays during the terms of the said contract.
Chinese holidays will be specified in advance and the arrangement of holiday period will be set according to the requirements from the government.
合同期间，乙方享受中国公共节假日，中国节假日安排由政府制定和公告。
7-On the completion of Party B’s work during this contract, Party A will provide Party B 8,000RMB air ticket bonus as a reward.
如乙方完成本合同工作，作为奖励，甲方将向乙方提供8,000元人民币机票补助。
6- Violation and Breach Penalty违约处罚：
Both Parties hereby agree and accept the following:
双方同意以下条款：
1-If a Party is proved to be incompetent and continuously fails to honour any or all of the terms and conditions of the said contract despite advice/warning of the other Party, then the Party in question shall be considered to be violating the said contract.
如果任何一方被证实无法完成或持续违反以上条款和条件，提醒和警告无果时，被质疑的一方将被认为违反合同。
2-The Party who violates any or all the terms and conditions of the said contract continuously without any suitable justification shall be liable to pay the other party a sum of 8,000 RMB as a breach of contract penalty.
如果任何一方没有恰当理由，持续违反以上合同条款，应当接受8,000元人民币罚款的违约处罚。
7- Procedures for the settlement of disputes解决争议程序：
1-Both Parties hereby agree and accept that any disputes or disagreements arising from any of the terms or conditions of this said contract shall be resolved internally in an amicable, friendly and responsible manner by the Parties to this contract.
当对合同任何条款和条件存在争议时，合同双方同意用友好负责的态度内部协商解决。
2-Should the Parties not be able to resolve the problems between themselves, both Parties hereby agree and accept that their dispute will be turned over to an arbitration authority in China which is acceptable to both parties.
如双方不能自行解决问题，同意将争执移交双方同意的在华仲裁机构处理。
In the case of necessity for an arbitration of dispute by an arbitration authority, both parties hereby agree and accept to go for an arbitration at Labour and Personnel Dispute Arbitration Committee of Changping District, Beijing
如需仲裁机构解决争议，双方同意接受北京市昌平区劳动人事争议仲裁委员会的判决。
8- Termination合同终止:
This contract can be terminated before the end of working period under the following conditions.
本合同可在如下情形提前终止。
1-Party B will be dismissed with fifteen days’ notice, and this contract will be terminated, in the event of any of the following: 1. Party B uses more than two weeks of sick days; 2. Party B uses more than three personal business days；3. Party B receives evaluation ratings of ‘Unsatisfactory’ from his/her students and from the school’s English Course Manager; 4. Party B breaks Chinese law or violates the normal order of BUA.
如果发生以下情形之一，乙方会得到提前15天的解雇通知，合同将终止：1. 乙方休病假超过2周；2. 乙方使用3天以上个人事务事假；3. 乙方受到学生和英语教学主管“不合格”的评价；4. 乙方违反中国法律或扰乱学校正常秩序。
2- Party B hereby agrees and accepts to be responsible for all its living expenses after termination of the contract.
乙方同意在合同后生活花销自理。
3.1- If Party B leaves before completion of his/her required work without 30 days prior notice or proof of emergency, he/she won’t get the rest of the payment or the air-tickets bonus.
在未完成工作情况下，乙方没有提前30天通知或紧急情况证明，乙方将不能得到剩下的工资和机票补助。
3.2- If Party B leaves reasonably before completion of his/her required work with 30 days prior notice or due to the emergency of Party B, his/her spouse, parents or children, his/her payment will be prorated by the whole school year’s work completed, additionally, the international air tickets bonus will be withdrawn. In this case, Party B agrees to provide a viable replacement candidate.
如果乙方因合理原因在其工作完成前离开，并提前30天通知或因自己、配偶、父母或子女紧急情况，乙方的薪酬将按全年完成工作量的比例结算，国际机票补助将取消。在此情况下，乙方同意提供可行的替代人选。
3.3- If Party B leaves after the completion of his/her required work, yet before the end of the working period, he/she will get all his/her payment and air ticket bonus.
如果乙方在工作完成之后，工作期满前离开，他/她将得到全额工资和机票补助。
Both parties agree to renew the contract _on April 30th, 2015_ if both parties are satisfied.
如果双方同意，将在2015年4月30日续签合同。
