Brief Introcduction to the This University
This University has a history of 50 years. She is the only comprehensive general higher educational school in the west of Heilongjiang Province. She lies beside the Nen River, the famous homeland of red-crowned crane- -the Labor Lake in the city of Local. She covers an area of 1.15 million square meters, and the building area is 620,000 square meters. She enjoys the good name ---"The University Enriched by a Lake". In recent years, This University successfully realized the leaping development. Now there are 13 institutes or colleges (information science and electric engineering institute, chemistry and chemical engineering institute, science of life and engineering institute, the Faculty of science, human culture science college, school of art, economic institute, foreign language college, mechanical engineering institute, light textile industrial institute, physical education college, higher vocational technology institute and adult education institute) , 4 centers (computer center , network and audio-visual education program center, external Chinese language training center and analytical test center), and 3 independent research institutes (organic synthesis research institute, science of materials research institute and machinery research institute). There are 7 subjects that can award Master's degree. These include applied computer technology, applied chemistry, analytical chemistry, chemical technology, science of materials, genetics and Marxism theory and ideological and political education. Applied chemistry and applied computer technology are the provincial level key subjects. The fine-chemical engineering laboratory is that of key laboratory. The majors, high-polymer material and engineering, inorganic nonmetal material and engineering, computer science and technology, math and applied math, English and biological science , history, light textile engineering and chemical engineering are provincial key subjects .There are 49 undergraduate specialities and 13 specialized subjects ,which cover literature , technology ,engineering, education, history ,management , law ,agriculture ,and economics. The university is abundant in teachers and efficient in structure. They are 2,100 faculty, which includes more than 680 professors and associate professors, 470 lecturers, 30 doctors’ and masters’ supervisors, 13 specialists who enjoy the prestige of national allowance and 2 enjoy that of province, 16 foreign teachers who come from America, Austria and Russia. There are more than 21,500 graduates, undergraduates and special course students, which includes over 50 foreign students. In addition, there are more than 8,000 adult education students. A system of multiple administrative levels has been constructed. It includes graduates, undergraduates, special course students, correspondence, and night university students. The university possesses advanced educational conditions and equipments. The library has a collection of over 1.6 million, 4 new electrical reading rooms and 6 special reading rooms for social science and foreign language materials etc. There are 63 modern language labs, multi-media rooms, CAI, and CAD rooms and audio-visual aids rooms, 2 long-distance rooms for network teaching and 14 long-distance network classrooms. The provincial first-rate gymnasium, stadium and natatorium provide a better environment for educating students in This University. The university publishes 3 kinds of internal and external academic journals. They are “This University Journal” (philosophy and society edition) (natural science edition) and “Higher Teaching Science Journal”. Sample Contract
Party A This University wishes to engage the service of Party B ___________ as an English teacher. The two parties, in a spirit of friend cooperation, agree to sign this contract and pledge to fulfill conscientiously all the obligations stipulated in it.
Ⅱ The period of teaching will be from the Sep. 1 2005 to the 30th of June. 2006.
Ⅲ The duties of Party B:
Teaching load: 14 hours/per week.
Courses: English Literature and writing.
Students: College Students and teachers.
Ⅳ 1. Party B’s monthly salary will be 4,000-yuan RMB , 70%, of which can be converted into foreign currency monthly.24th of each month is the pay-day.
2. Party B will be paid round way ticket from Qiqihar to Party B’s city..
3. Party B will enjoy free boarding: apartment on campus (furniture, bedding, telephone, television, refrigerator, toilet, internet), and share a dining-room or a kitchen with other teachers.
4.Part B will be paid 3000-yuan RMB as winter vacation allowance.
Ⅴ Party A’s Obligations
1. Party A shall introduce to Party B the laws, decrees and relevant regulations enacted by the Chinese government, the Party A’s work system and regulations concerning administration of foreign experts.
2. Party A shall conduct direction, supervision and evaluation of Party B’s work.
3. Party A shall provide Party B with necessary working and living conditions.
4. Party A shall provide co-workers.
5. Party A shall pay Party B’s salary regularly by the month.
Ⅵ Party B’s obligations
1. Party B shall observe the laws, decrees and relevant regulations enacted by the Chinese government and shall not interfere in China’s internal affairs.
2. Party B shall observe Party A’s work system and regulations concerning administration of foreign experts and shall accept Party A’s arrangement, direction, supervision and evaluation in regard to his/her work. Without Party A’s consent, Party B shall not render service elsewhere or hold concurrently any post unrelated to the work agree on with Party A.
3. Party B shall complete the tasks agree on schedule and guarantee the quality of work.
4. Party B shall respect China’s religious policy, and shall not conduct religious activities incompatible with the status of an expert.
5. Party B shall respect the Chinese people’s moral standards and customs.
Ⅶ Revision, Cancellation and termination of the Contract
1. Both parties should abide by the contract and should refrain from revising, canceling, or terminating the contract without mutual consent.
2. The contract can be revised, canceled, or terminated with mutual consent. Before both parties have an agreement, the contract should be strictly observed.
3. Party A has the right to cancel the contract with a written notice to Party B under the following conditions:
(1) Party B does not fulfill the contract or does not fulfill the contract obligations according to the terms stipulated, and has failed to amend after Party A has point it out.
(2) According to the doctor’s diagnosis, Party B cannot resume normal work after a continued 30 day sick leave
4. Party B has the right to cancel the contract with a written notice to party A under the following conditions:
(1) Party A has not provided Party B with necessary working and living conditions as stipulated in the contract.
(2) Party A has not paid B as scheduled.
Ⅷ Breach Penalty
When either of the two parties fails to fulfill the contract or fails to fulfill the contract obligations according to the terms stipulated, that is, breaks the contract, it must pay a breach penalty of US$500 to 2,000 (or the equivalent in RMB).
If Party B asks to cancel the contract due to events beyond control, it should produce certifications by the department concerned, obtain Party A’s consent, and pay its own return expenses; if Party B cancels the contract without valid reason, it should pay its own return expenses and pay breach penalty to Party A. If Party A asks to cancel the contract due to events beyond control, with the consent of Party B, it should pay Party B’s return expenses; if party A cancel the contract without valid reason, it should pay Party B’s return expenses and pay a breach penalty to Party B.
Ⅸ The appendix of this contract is an inseparable part of the contract and has equal effect.
Ⅹ This contract takes effect on the date signed by both parties and will automatically expire when the contract ends. If either or the two parties asks for a new contract with mutual consent. Party B shall bear all expenses incurred when staying on after the contract expires.
Ⅺ Arbitration
The two parties shall consult with each other and mediate any disputes, which may arise about the contract. If all attempts fail, the two parties can appeal to the organization of arbitration for foreign experts affairs in the State Administration of Foreign Experts Affairs and ask for a final arbitration.
