Brief Introcduction to the This University

                   This University established in 1947, is located in the north bank of Songhua River in Harbin, famous known as the “Ice City”. This University is a public high-educational comprehensive institution, chiefly majors in engineering as well as combines with science, art, humanities, management, economics and law. Occupying an area of over 1000,000 square meters with floorage of 550,000 square meters in Harbin and Jixi, HIST has 10 departments, 3 colleges and offers students 49 majors with bachelor’s degree and 4 majors with master’s degree. The newly built digitalized library has a floorage area of more than 40,000 square meters. At present, there are now over 16,000 enrollments with a teaching staff of 1687 including more than 500 professors and associate professors, 30 postgraduate tutors, 60 faculties with Ph.D degrees and 300 with Masters as well as other 132 high-professional persons. Many famous experts, home and abroad, are the specially invited guests of HIST, including Honorary Professor Song Zhenqi of the Chinese Academy of Science and Honorary Professor Chen Qingru of the Chinese Academy of Engineering. So far, there are more than 40,000 students graduated from HIST, who are now working on many areas in China. Some of them are working or studying in America, Japan, Canada, Russia and other countries as well. All the graduates are well-recommended and acknowledged by all walks of life because of their high moral standards; the high rate of passing English exams; the high efficiency in computer application; the high employment rate and so on. There are twp provincial principal subjects: mining engineering and mineral separation engineering; provincial key majors: mining engineering, mineral separation engineering, electrical engineering and mechanical engineering, etc. There are This University Clean-coal Research Center; the provincial Hi-tech Park; This University Coal Machinery Quality Supervision office; the State Coal Security Training Center and International Education Center. Recently, HIST has won more than 30 Science and Technology Progress Prizes both at national and provincial levels, some of which are nationally or even internationally advanced. HIST has its own publications: This University Institute of Science and Technology Academic Journal, Coal Technology, Coal Mechanics and This University Institute of Science and Technology Newspaper. HIST has set up academic relationships and teaching cooperation with US North Dakota Energy and Environment Research Center and more than 20 other foreign research institutes and high-educational institutions. HIST has been cooperating with Far-Eastern State Technical University in Russia and Northern Alberta Institute of Technology in Canada in exchanging students studying abroad and in joint- cultivation of professional students and the broad exchanges in terms of education and research. Meanwhile, HIST works jointly with China University of Mineral and other key universities in China in the cultivation of graduate and doctoral students. HIST will endeavor to build itself into an up-to-date and famous university nationally and internationally.

Contract
I. Party A ___________________________________________ wishes to engage the service of Party B_______________________________ as English teacher.  The two parties, in a spirit of friendly cooperation, agree to sign this contract and pledge to fulfill conscientiously all the obligations stipulated in it.
II. The period of service will be from the _____day of _______, 20___to the _____day of ________, 20____.
III. The duties of Party B (see attached pages)
IV. Party B’s monthly salary will be RMB________
V. Party A’s Obligations
1.    Party A shall introduce to Party B the laws, Decrees and relevant regulations enacted by the Chinese government, the Party A’s work system and regulations concerning administration of foreign experts.
2.    Party A shall conduct direction, supervision and evaluation of Party B’s work.
3.    Party A shall provide Party B necessary working and living conditions.
4.    Party A shall provide co-workers.
5.    Party A shall pay Party B’s salary regularly by the month.
VI. Party B’s Obligations
1.      Party B shall observe the laws, decrees and relevant regulations enacted by the Chinese government and shall not interfere in China’s internal affairs.
2.      Party B shall observe Party A’s work system and regulations concerning administration of foreign experts and shall accept Party A’s arrangement, direction, supervision and evaluation in regard to his/her work. Without Party A’s consent, Party B shall not render service elsewhere or hold concurrently any post unrelated to the work agreed on with Party A.
3.      Party B shall complete the tasks agreed on schedule and guarantee the quality of work.
4.      Party B shall respect China’s religious policy, and shall not conduct religious activities incompatible with the status of an expert.
5.      Party B shall respect the Chinese people’s moral standards and customs.
VII. Revision, Cancellation and Termination of the Contract
1.      Both Parties should abide by the contract and should refrain from revising, canceling, or terminating the contract without mutual consent.
2.      The contract can be revised, canceled, or terminated with mutual consent. Before both parties have reached and agreement, the contract should be strictly observed.
3.      Party A has the right to cancel the contract with a written notice to Party B under the following conditions:
(1)       Party B does not fulfill the contract or does not fulfill the contract obligations according to the terms stipulated, and has failed to amend after Party A has pointed it out.
(2)       According to the doctor’s diagnosis, Party B cannot resume normal work after a continued 30day sick leave.
4.      Party B has the right to cancel the contract with a written notice to Party A under the following conditions:
(1)       Party A has not provided Party B with necessary working and living conditions as stipulated in the contract.
(2)       Party A has not paid Party B as scheduled.
VIII. Breach Penalty
   When either of the two parties fails to fulfill the contract or fails to fulfill the contract obligations according to the terms stipulated, that is, breaks the contract, it must pay a breach penalty of US$500 to 2000(or the equivalent in RMB).
   If party B asks to cancel the contract due to events beyond control, it should produce certifications by the department concerned, obtain Party A’s consent, and pay its own return expenses; if Party B cancels the contract without valid reason, it should pay its own return expenses and pay a breach penalty to Party A.
   If Party A asks to cancel the contract due to events beyond control, with the consent of Party B, it should pay Party B’s return expense; if Party A cancels the contract without valid reason, it should pay Party B’s return expenses and pay a breach penalty to Party B.
IX. The appendix of this contract is and inseparable part of the contract and has equal effect.
X. This contract takes effect on the date signed by both parties and will automatically expire when the contract ends. If either of the two parties asks for a new contract, it should forward its request to another party 90days prior to the expiration of the contract, and sign the new contract with mutual consent.
   Party B shall bear all expenses incurred when staying on after the contract expires.
XI. Arbitration
   The two parties shall consult with each other and mediate any disputes which may arise about the contract. If all attempts fail, the two parties can appeal to the organization of arbitration for foreign experts affairs in the State Administration of Foreign Experts Affairs and ask for a final arbitration.

Monthly Salary (RMB):
The salary of        RMB will be paid on the 25th of each working month or if the 25th falls on a weekend or holiday, payment will be made within three working days after the weekend or holiday. (Payable by cash at the end of every month.)_    _% of the salary may be changed into USD.

If Party B elects to accept additional teaching hours, compensation will be provided in the amount of 100 Yuan per class hour.
 
Holidays: Party B enjoys the Chinese holidays as well as 2-day holiday at Thanksgiving Day (last Thursday of November) and 3-day holiday at Christmas Day (the 25th of December).
 
Sick leave:
When on sick leave for over 3 consecutive days, the teacher should produce a doctor’s certificate. When asking for a personal leave of absence, Party B should ask the director in charge one week in advance. When requesting a personal leave of absence for over 3 days, the Foreign Affairs Office of HIST should be consulted. Lessons missed should be made up after the afore-mentioned sick and/or personal leave. Failure to do so shall result in a deduction in the following month’s salary on the basis of 1/30 of the month’s salary for each day of lessons missed.
 
 
Responsible for: the Invitation Letter, Resident’s permit.
Party A shall ensure that all the teaching facilities are in good order and that they get promptly serviced and maintained.
 
Round Trip Airfare: Yes (*)  
The school will offer two single plane tickets separately for your arrival at the beginning of one contract period and leaving at the end of the same contract period. (the tickets type are the economy class and the two tickets’ destinations are the place where you teach--Harbin and the nearest airport to where you live in your country.)
                
Travel Allowance: Yes (*)
2200 RMB per year.(RMB 1,100 will be payable upon Party B’s completion of each term .)

Luggage allowance: Upon the ending of contract, Party A shall cover the shipping cost of 25 kilos of Party B’s personal belongings from China to his or her residence overseas.
 
Miscellaneous: Party A has the responsibility to keep Party B informed regarding planned water or power outages, and other similar matters. Party B has the responsibility to inform Party A timely in case of an emergency that Party B must attend to with as much notice as possible. Party B will pay any damages to the furniture and appliances caused by improper use according to its real value.
