I. Working Assignment
1. Working Situation
1.1 The teacher should teach 20 periods per week.
1.2 Any basic materials required for teaching will be provided by the employer including books, a tape recorder, etc.
2. Teacher Responsibility
2.1 The teacher is responsible to plan lessons carefully and responsibly.
2.2 The teacher is to accept the instruction, supervision and evaluation of teaching matters by the head of department.
2.3 The teacher is to complete the teaching task and students’ assessment on schedule.
II. Salary and Remuneration
1. Salary
1.1 It will be paid once a month by the responsible office of the employer. If the contract is for one year, the teacher will work the two normal terms, having the standard winter and summer holidays free. The teacher will be paid for 11 months if he/she finishes his work and does not renew the contract. If the contract is renewed for the following year, August will also be paid.
2. Basic Living Conditions
2.1 A furnished flat will be provided. This includes a kitchen with a fridge and gas cooker, a bathroom with a shower/bath. Other basic appliances and furniture including a TV, a telephone, a tape recorder and a washing machine are to be provided.
2.2 The electricity, water and heating fees are to be paid by the employer. An air-conditioner or adequate fan will also be provided.
3. Medical Concerns
Free medical treatment will be provided, that is, it will be paid by the employers. The teacher must go to the assigned hospital or must bear the responsibility of the cost themselves. The teacher will pay the fees for registration, transportation, false teeth, face lifts, massage, glasses, meals in hospital, medicine for general nourishment and charges for a house visit. Any medical treatment received in Taiwan, Hong Kong, Macao or outside of China must be paid by the teacher.
4. For teachers signing a one year contract, a round-trip international, economy, flight ticket from the city of employment to the nearest airport to their point of origin in the home country will be provided by the employer.
III. Working Time and Vacation
1. Standard working time as applies to the college terms will apply to the foreign teacher. The teacher is expected to teach according to the usual college term of work. Any exceptions to this must be cleared with the employer beforehand, and will not be allowed without good reason.
2. The teacher will be free to enjoy the following holidays: New Years Day, Spring Festival, International Labour Day, National Day and Christmas Day and other holidays according to law.
3. The teacher can enjoy the winter semester break with pay. If the contract is renewed for the following year, the teacher may also enjoy the summer break with pay. The teacher is free during the standard semester breaks.
IV. Sick Leave, Compassionate Leave, and Missed Work
1. Sick Leave: If the teacher wants to ask for sick leave he/she must show proof from a doctor at the assigned hospital that such is necessary. For one contract period, if the employee’s accumulated sick leave is less than 30 days, the salary will be paid in full. If the total sick leave is more than 30 days, the employer may terminate the contract. If it is agreed to continue with the contract, the employer will continue to pay 70% of the salary until the teacher can work normally again.
2. Compassionate Leave: When the employee asks for compassionate leave, it must be allowed by the employer, and the employer will subtract the salary according to the work missed. During a contract period, accumulated compassionate leaves mustn’t exceed ten days. Consecutive leaves mustn’t exceed 3 days unless pre-arranged and agreed upon by the employer. Otherwise, the penalty will be double for the work missed.
3. Missed work: If the teacher misses classes without permission or without a very good reason that can be substantiated, his/her wages will be docked three times what they have missed. If such occurs more than once, the employer has the right to terminate the contract with the employee bearing the responsibility.
4. Contract Probation Period
The probation period for a teacher is 60 days. The college authorities have the right to terminate the contract if they find the teacher in poor health or unqualified to do the work he/she is responsible for.
V. Both of the parties, the employer and the employee, hold that the standard employment contract does not include other matters.
VI. The determination of and any alteration of the appendix provisions of the contract should be discussed by both parties and the agreements written into the official appendix.
This appendix has the same validity as the standard employment contract and is an inseparable part of it.
