VI. Applicants apply for work visa to China in local Chinese Embassy or consulate and come to This University as the time suggested byinternational office .
VII. Applicants retest the physical examination in Shaoguan Entry-Exit Inspection and Quarantine Bureau with all the related documents taken from the local public or state hospital of applicants.
VIII. Sign the formal contract. The university will apply for the Foreign Expert Certificate in one month after the Applicant arrives.
CONTRACT
I. Party A This University wishes to engage the service of Party B as .
The two parties, in a spirit of friendly cooperation, agree to sign this contract and pledge to fulfill conscientiously all the obligations stipulated in it.
II. Contract Duration
The period of service will be from the 1st day of September , 2011 to the last day of July, 2012
III. Party A’s Obligations
1. Party A shall introduce to Party B the laws, decrees and relevant
regulations enacted by the Chinese government, the Party A’s work system and regulations concerning administration of foreign experts.
2. Party A shall conduct direction, supervision and evaluation of
Party B’s work.
3. Party A shall provide Party B necessary working and living
conditions.
4. Party A shall provide co-workers.
5. Party A shall pay Party B’s salary regularly by the month.
IV. Party B’s Obligations
1. Party B shall observe the laws, decrees and relevant regulations enacted by the Chinese government and shall not interfere in China’s internal affairs.
2. Party B shall observe Party A’s work system and regulations concerning administration of foreign experts and shall accept Party A’s arrangement, direction, supervision and evaluation in regard to his/her work. Without Party A’s consent, Party B shall not render service elsewhere or hold concurrently any post unrelated to the work agreed on with Party A.
3. Party B shall complete the tasks agreed on schedule and guarantee the quality of work.
4. Party B shall respect China’s religious policy, and shall not conduct religious activities incompatible with the status of an expert.
5. Party B shall respect the Chinese people’s moral standards and customs.
V. the duties of Party B
1. Party B teaches in Foreign Language Faculty. Party B will give a maximum of 16 periods of classes per week.
2. Party B has an obligation to help his students English and give his Chinese colleagues lectures on some subjects in his spare time. Party B has an obligation to help the teaching working in some schools which are the teaching practice bases of SGU.
VI. Treatment
1. Party A pays Party B a monthly salary of RMB 8000 Yuan. Any raise by Party A in the salary standard of foreign teachers in 2010 will be added to the salary of Party B according to the qualifications of Party B.
2. Party A pays the fees for getting residence permit for Party B. Party A provides Party B, free of charge, with a flat furnished with a TV set, a refrigerator, an air conditioner, a washing machine, a telephone and cooking utensils. Party B pays the water, electricity bill and telephone bill.
3. Party A buys Party B the medical insurance and casualty accident insurance which can cover the fee of Party B’s medical and casualty accident payment during his working in This University. Party B pays the fee out of insurance proceeds. Party B pays for himself for medical transportation, artificial tooth insertion, massage, hospitalization meals and tonic. Party B also pays for himself when he sees a doctor in a non-appointed hospital.
4. Party A will pay Party B RMB 2000 Yuan as traveling fee and RMB 6500 Yuan for airplane ticket after one-year teaching service.
VII. Working time and holidays
1. Party B works eight hours a day, five days a week, from Monday to Friday. Any changes for holidays will be re-scheduled.
2. Party B enjoys the following Chinese paid holidays: The New Year’s Day, Chinese New Year, Labor Day, National Day and other holidays as permitted by law.
3. Party B enjoys the following paid holidays according to his nationality and belief: 2 days for Christmas.
4. Party B has an obligation to finish the occasional work assigned by International Office, for which he will be compensated.
VIII. Sick leave and Compassionate Leave
1. Party B has to show medical certificate from the foreign-related hospital when he asks for sick leave. Party B’s salary will be 100% offered if he asks for sick leave totally less than 30 days during his one school year service.
Party A has the right to terminate the contract if Party B’s sick leave is more than 30 days. If the contract is not terminated, Party B’s salary will be paid 70% until Party B resumes his normal work. Party A has to pay the local foreign-related hospital medical fee when Party B is sick on an official trip. Party B self-pays when he is on a private trip.
Party B pays for himself when he sees a doctor in Taiwan, Hong Kong, Macao and foreign countries during the contract period.
2. Party B should get Party A’s permission when he asks for compassionate leave. Party A will deduct Party B’s pay per day. Party B cannot have compassionate leave more than 10 total days and more than 3 continued days. If Party B prolongs his leave every one more day, his two days’ pay will be deducted during his service (one school year).
If Party B is absent from duty without permission, his pay will be deducted 3-day salary for every single day. If it is more serious, Party A has the right to terminate the contract and investigate and affix his fault.
3. During workdays if Party B wishes to travel outside of Shaoguan, he must ask for leave from the International Office beforehand.
Any outside activities in which Party B involves himself with downtown or further field need to be told to the International Office asked permission beforehand.
4. If Party B wishes to ask for leave, he must write a formal letter asking permission from the International Office.
IX. Revision, Cancellation and Termination of the Contract
1. Both parties should abide by the contract and should refrain from revising, canceling, or terminating the contract without mutual consent.
2. The contract can be revised, canceled, or terminated with mutual consent. Before both parties have reached an agreement, the contract should be strictly observed.
3. Party A has the right to cancel the contract with a written notice to Party B under the following conditions:
a) Party B does not fulfill the contract or does not fulfill the contract obligations according to the terms stipulated, and has failed to amend after Party A has pointed it out.
b) According to the doctor’s diagnosis, Party B cannot resume normal work after a continued 30 days sick leave.
4. Party B has the right to cancel the contract with a written notice to Party A under the following conditions:
a) Party A has not provided Party B with necessary working and living conditions as stipulated in the contract.
b) Party A has not paid Party B as scheduled.
X. Breach Penalty
When either of the two parties fails to fulfill the contract or fails to fulfill the contract obligations to the terms stipulated, that is, breaks the contract, it must pay a breach penalty of US $500 TO 2,000(or the equivalent in RMB).
If Party B asks to cancel the contract due to events beyond control, it should produce certifications by the department concerned, obtain Party A’s consent, and pay its own return expenses; if Party B cancels the contract without valid reason, it should pay its own return expenses and pay a breach penalty to Party A.
If Party A asks to cancel the contract due to events beyond control, with the consent of Party B, it should pay Party B’s return expenses; if Party A cancels the contract without valid reason, it should pay Party B’s expenses and pay a breach penalty to Party B.
XI. This contract takes effect on the date signed by both parties and it is conditional upon successful completion of the working visa and residence permit application process. The contract will automatically expire when the contract ends. If either of the two parties asks for a new contract, it should forward its request to another party 90 days to the expiration of the contract, and sign the new contract with mutual consent.
Party B shall bear all expenses incurred when staying on after the contract expires.
