This agreement is between This English Training School (hereafter called “the school”) and (hereafter called “the teacher”). Both parties hereby agree that the Teacher’s terms of employment are as follows:

Nature of Employment:

1 The Teacher is employed to teach English to both teenager (the age from 12 to 18 years old) and pre-teenagers (the age from 3 to 12 years old).

2 The teacher may also be required to undertake presentation lessons in front of parents, open house lesson for recruiting new students, interviews, demonstrations, and media presentations, etc.
该老师可能被要求承担面对家长的展示课,招纳新生的公开课,面试,示范课和媒体展示等.
3 The teacher should write detailed teaching plan for every lesson on Kid castle class report, writing communication book for every student after the class (no more than 18 students in this school ),correcting students pronunciation before and after the lesson, when students read to them.
该老师每节课都应该在该校教师日志上写详细的教学计划，课后给每位同学（每班不超过18人）写家联本,当学生课前课后给该老师读书时应纠正学生的发音。
4 To teach a lesson the teacher should:1 arrive the school for the lesson 15 minutes before the lesson; 2already finish preparing the right schedule of the lesson well at home or at school，15 minutes before the lesson;
教授一节课，该老师应该：1 课前15分钟到达学校；2 课前15分钟，在家或在学校已经完成正确进度的备课；
5 If one teacher substitutes for another, it should not conflict with his/her own classes and must to be approved by the school principle.
如果该老师替换另一名老师的课，不能同该老师自己的课冲突，并且必须经学校校长同意。
6 Teachers are expected to teach during summer and winter vocation of local public schools in the contracted period of employment.
老师将要在合同期内的当地公立学校寒假和暑假教学。
7 Promotional activities occur irregularly，and within the teacher’s contracted period of employment.
不定期会有促销活动，但会在该教师的合同规定工作时间内。
8 The conditions of the teacher’s employment are subject to the laws of the People’s Republic of China.
该教师的雇佣状态应当遵守中华人民共和国的法律法规。

Remuneration:

1 The school will pay the Teacher6000Yuan RMB per calendar month , free of Chinese income tax., work detailed as below:
学校每公历月将支付6000元人民币，税后工资，具体如下：
Ø Teach no more than 20 hours a week. and has one day off a week；
老师一周工作不超过20个小时的情况下，月工资为6000， 每周休息一天。
Ø arrive the school for the lesson 15 minutes before the lesson; enter the classroom 5 minutes before the lesson. During break time before or after the lesson, the teacher should not refuse students reading books to them. This part has been paid in the monthly salary and should not be looked on as extra working time;
课前15分钟到达学校；课前5分钟进入教室。课前或课后，该老师不应当拒绝学生给他（她）读书。这部分已经在月薪水中付过报酬，并且不应当被认为是额外工作时间
Ø already finish preparing the right schedule of the lesson well at home or at school，15 minutes before the lesson. This part has been paid in the monthly salary and preparation time should not be looked on as extra working time;
课前15分钟，在家或在学校已经完成正确进度的备课。这部分已经在月薪水中付过报酬，准备

Ø after a lesson, the teacher should finish writing communication books before leave the school(one student has one communication book).This part has been paid in the monthly salary and writing time should not be looked on as extra working time;
课后，该老师应当在离校前写完家联本（每位同学一本）。这部分已经在月薪水中付过报酬，写
家联本时间不应担被当做额外工作时间。
Ø should have two hours meeting once a week with other teachers; This part has been paid in the monthly salary and meeting time should not be looked on as extra working time;
每周有2小时与其他老师的会议时间，这部分已经在月薪水中付过报酬，会议时间不应担被当做额外工作时间。
Ø One teaching period is 30 minutes (kinder level1-level2 and junior level1-level2 ) ， 45 minutes (for above levels). Teaching hours will not be counted according to the teaching periods, but actual teaching hours in a week. Ten or five minutes Break between two lessons looked on as extra working time; This part has been paid in the monthly salary and should not be looked on as extra working time;
一个授课时段是30分钟（幼儿一级二级和小儿童一级二级），45分钟（以上级别）。授课小时不根据教学时段来计算，而是根据一周实际的教授时间总数。两节课中间的10分钟或5分钟休息时间不被看做是额外工作时间。这部分已经在月薪水中付过报酬，不应担被当做额外工作时间。
Ø If parents want to talk to the teacher about the child in the school, the teacher should not refused, but the teacher have the right to have a translator. To show our kindness, maybe the teacher will be required to call the parents and students to solve problems, using the phone of the school. Phone time has been paid in the monthly salary and should not be looked on as extra working time;
Ø 如果家长想要在学校同该老师谈论学生，该老师不应该拒绝。但是该老师有权利有一位翻译。为体现我们的友好，可能该老师会被要求使用学校的电话给家长和学生打电话来解决问题。电话时间已经在月薪水中付过报酬，不应担被当做额外工作时间。
2 Payments day: The teacher will get month salary 15 days after the month the teacher has done, for example: If the teacher teaches from the first day of August to the day of 31st of August , then the teacher will get his/her month salary of August on the 15th of September. If the 15th day of the month does not fall on a normal workday, the teacher will be paid on the next normal workday.
该老师的月工资会在该月工作完成后的15天之后得到。例如：如果该老师从8月1号工作至8月31日， 那么该老师将在9月15日得到8月份工资。如果该月的15号不是正常工作日，则顺延至下一个工作日。
The first month, the teacher will get paid from the day to teach to the last day of the month, and he/she will get the salary on the 15th of next month.
该老师的第一个月的工资将从工作的第一天起算，截止该月的最后一天。该老师将在下一月的15号拿到工资。
The final month of the Teacher’s employment the Teacher’s remuneration shall be finalized and paid in full prior to the Teacher’s departure from China.
该老师工作的最后一个月老师的工资将在离开中国之前结算完毕。
3 The first 2 months (60days) 90% of regular salary will be paid as probation. Upon successful Evaluation of teacher performance his / her salary will increase to 100%.
前两个月（前60天）作为试用期支付正常工资的90%。根据教师的表现通过考核，工资将增至100%。
4 The School will pay a rate of 100 RMB per hour for any teaching hour exceeding the contracted teaching hours(including any work caused by extra teaching hours，like：preparing time，communication books time，etc.)
学校将支付每小时100元，对于超出超过合同规定的授课时间（包括由超出的授课时间引起的备课时间，家联本时间等等）。
5 Teacher’s will be paid for Chinese public holidays. Public holidays per academic year include: one day for New Year’s ，3 days for spring festival 3 days ，one day for tomb-sweeping day，one day for dragon
Boat day，Day one day for May 1st holiday，one day for mid-autumn day;，three days for National day. The normal lesson schedule may be adjusted before or after these dates for the convenience of the majority of students. And payments of that month need to be affected according to the total working hours in those weeks which are affected.
老师在聘用期间的带薪公共假日：每年的公共假日包括：元旦1天，春节3天，清明节1天，端午节1天，五一1天，中秋节1天，国庆节3天）由于需要方便大多数学生，正常课表可能在假期前后可能调整。该月的报酬需要根据在受影响的几周内上的总课时来计算。
6 Sometimes the school will have to stop the lessons, because the local public school change time. If the employee can make up all the missed lessons(caused by stopping lesson) with approval of the school, there will be no change to his/her salary. If classes can not be made up, payments will be affected as per number of classes missed.
由于当地公历学校改变时间，有事学校将不得不停课。如果在学校的同意下，该老师能够补上所有缺的课，他、她的薪水将不会受影响。如果课程不能被补上，报酬将会因为所缺课程数量而受影响。
7 If any reason the school stop lessons，and the teacher won’t need work， payments will be deducted.
如果因为任何原因，学校停课，该老师将不需要工作，报酬将会被扣除。
8 Open house lessons are half an hour teaching time usually.
通常公开课是半个小时。
9 If the school stops lessons to hold large activity, the teacher’s working hour can be counted as teaching hour.
学校停课举行大型的活动，老师的工作时间可以被计入授课时间。
10 The teacher cannot participate in private tutoring or any other outside employment without permission from the school Director.
没有学校校长的允许，该老师不能参与私人家教或任何外面的聘用。
11 If the teacher is ill and have made up the lesson, he/she will not be fined for being late. Being late for work and class without reason is not allowed. If the teacher is late by 10 minutes, the teacher will be fined 10 Yuan with making up the time at the end of the lesson. If he/she is more than 10 minutes late, but less than 30 minutes, the teacher will be fined 200 Yuan without making up，if make up the missed lessons，the teacher will be fined 50 Yuan. If he/she is more than 30 minutes late, but less than an hour, the fine will be 300 Yuan without making up， if make up the missed lessons，the teacher will be fined 70 Yuan. If he/she is late for more than 1 hour, the fine will be 3 times the amount of daily pay without making up. if make up the missed lessons，the teacher will be fined 200 Yuan.
如果该老师生病，并且补上课程，他、她将不会被因为迟到罚款。无任何理由上班或上课迟到是不被允许的。如果迟到10分钟，老师需要在下课后补上，并被罚款10元；如果迟到10-30分钟，并且没有补课，该老师将被罚200元，如果补课，该老师将被罚款50元。如果迟到30分钟到一个小时，并且没有补课，该老师将被罚款300元，如果补课，该老师将被罚款70元。如果迟到超过1小时，且没有补课，该老师将被罚当日三倍工资的数额，如果补上所缺课，将被罚200元。
Visa and Residence Permit for working in China:

The school will provide relevant written references for the Teacher to obtain the work Visa. The Teacher should enter China with a work visa. The School is also responsible for handling the residence permit, and pay the resulting expenses(examination fee) .
学校会提供书面资料以帮助该老师获得工作签证。老师应当持工作签证进入中国。学校同样负责办理居留许可，并需负担相关体检费。
Air-Ticket:

Upon completion of one year of satisfactory service, the School will reimburse the Teacher’s return economy airfare not to exceed 5000 RMB. The Teacher is required to provide the School with a receipt. 完成一年的满意服务，学校将付给往返机票，最高不超过5000元人民币。老师需要向学校提供收据。
Housing:
住房：
1 The School will provide the Teacher with a furnished apartment (two bedrooms, one kitchen, one bathroom with western style toilet, shower , colored TV, Sofa, air-conditioner, heating equipment , computer , clothe cabinet, and a bike, free of charge for the period of the Teacher’s employment by the school.
学校将给老师提供带家具的公寓（两个卧室、厨房、西式坐便的卫生间，淋浴，彩电，沙发，空调，暖气，电脑，衣橱，自行车），在聘用期间免费使用。
2 The Teacher must pay for the bills of gas, water, heating, electricity, telephone, internet service and housing management fee by him/herself.
老师必须自己支付天然气费、水费、暖气费、电费、电话费、互联网费、物业费。
3 The School will supply necessary equipment and utensils（Chinese food） for the teacher to cook meals. The teacher should pay for any equipment and utensils for western food, if the teacher require to buy.
学校会提供必要的中餐设备和器皿以便老师做饭。该老师应当支付西餐设备和器皿的费用,如果老师要求购买.
4 The School shall ensure the installation of a connected telephone in the apartment. The teacher should pay for the service of the phone. Teacher will be guide to know where and how to buy the service for the firs time, then he/she should do by him/herself.
学校保证在公寓内安装有连接好的电话。老师需要支付电话费。第一个月学校将安排指导老师在那里、如何交费，以后，老师需要自己负责支付。
5 The Teacher may share an apartment with other teachers（same gender）, but each teacher will have their own bedroom.
老师会与其他同性老师合住公寓，但每位老师会有自己的卧室。
6 Couples will not share an apartment with other teachers.
夫妇不会与其他老师合住。
7 The employee MUST pay a security deposit (￥1000.00 which can be deducted from wages over the first 2 months.) The deposit will be returned upon inspection of property at the end of the contract. In the event that an apartment is left in an unsatisfactory state the deposit is forfeited, any damages that exceed the deposit amount will be the responsibility if the employee.
雇员必须支付保证金（1000.00元人民币，在前两个月的工资中扣除）。合同期满，公寓品检查完好后将返还保证金。假如公寓保存非完好，保证金将被没收。如果损失程度超出保证金数额，雇员需要支付超出部分。
Teacher Responsibilities - The Teacher shall:

1 Maintain a professional manner and appearance at work and enter classroom five minutes before the lesson start.
在工作中保持专业的举止及外型，并且提前5分钟进入教室。
2 Complete all necessary preparation(flashcards, class report, marker, books, students’ name cards, etc.) before the lesson, and participate teachers’ meeting for two hours in a week. The teacher should not be late.
完成必要的课前准备(闪卡,日志,白板笔,书,学生名卡等),参与每周两小时的教师会议。该教师不能迟到.
3 The teacher should arrive at the school for the lesson 15 minutes earlier before the lesson to get teaching materials and greet with students warmly; after the lesson the foreign teacher is required to talk with students and parents, with the help from Chinese teachers.
该老师应该在课前15分钟到达学校，来准备教学材料，并且与学生热情打招呼；课后该老师被要求与学生和家长谈话，可以在中籍教师的帮助下。
4 Notify the school as soon as possible if the Teacher cannot attend scheduled classes for unexpected reasons in order that the school can deal with it, and arrange time to make up all missed lessons.
如因不可预料的原因，不能按时到岗要尽早告之学校。以便学校可以处理，并且安排补课。
5 The maximum amount of students for any given class in This training school will not exceed 18 students. But when teaching lessons in cooperated public school , there will be 50-60 students in one class. The teacher maybe will be arranged to teach in the public school，which has agreements with This.
每班的学生的最大数量不超过18人，但是在公立学校，一个班大概50-60人。该老师也许将被安排在与该校有协议的公立学校上课。
6 Abide by local law and state regulations. It is illegal to engage students in any religious or political activity in violation of the laws and regulations of the People’s Republic of China.
遵守当地及国家法律。使学生参与宗教活动或参与违反中华人民共和国法法规的政治活动是非法的行为。
7 Do not administer corporal punishment or abuse to the students. If the student stop the lesson because the teacher treat the student in a bad manner, the teacher should be responsible for that and say apology to the parents and the student，even being fined 100yuan for one student.
不能对学生进行体罚。如果一个学生因为该老师以不好的方式对待而停学，该老师需要为此负责，并且对学生和家长道歉, 甚至会被罚款,一名学生100元。
8 Do not undertake other employment in China during the course of employment with the School unless prior permission of the School Director has been obtained.
除非之前得到过学校的许可，在合同期间老师不能在中国进行其他的聘用工作。
9 The School has the right to take video programs and photos for promotion and advertisements usage when the teacher is teaching or doing promotional activities.
在老师进行课堂教学或促销活动时，学校有权摄相和照相。
10 The school has the right to evaluate the teacher’s lesson and the teacher’s lesson maybe watched by parents.
学校有权评估老师课程，并且该老师的课可能被家长观看。
11 The teacher should accept direction from senior staff of this school. Teachers SHOULD respect each other between Chinese teachers and foreign teacher.
该老师应该接受该校管理人员的领导。中籍教师与外籍教师之间应该互相尊重。
12 The Teacher SHOULD maintain good working relations and normal friendships with Chinese teachers. We highly recommend no improper relationships with Chinese teachers during this contract period, since that will bring great trouble to the school and the students.
外教与中国老师应该保持良好的工作关系和正常的友谊。我们强烈建议在合同期内不能与中国教师发生不合适的关系,因为那样会给学校和学生带来巨大麻烦。
13 If the school arranges the teacher to get trained for teaching ，summer/winter camp，cooperation，effective communication，etc., during work in This, the teacher will not be paid for the training.
在校工作期间,如果该老师被要求接受有关教学，夏令营，合作，有效沟通等,将不被支付报酬。
14 At all times, comply with the requirement of his/her duty statement to the best of his/her ability.在任何时候应尽自己最大能力完成工作任务。
15 Do not partake in the consumption of alcohol during or prior to normal operating hours of This school schools.
上课期间和上课之前禁止酗酒。
16 Do not behave in any manner that would bring discredit on either the employer or the school.
不得以任何方式影响该校及聘方的声誉。
17 At all times treat school property and accommodation facilities in an acceptable manner.
不论任何情况下都要爱护学校财产和住宿设施。
18 Read and understand all documentation provided by This school. This will include rules and regulations, policies and procedures, company history, corporate culture, teacher training materials, and anything else deemed necessary.
阅读并理解该校所提供所有文件。这将包括法规、规章、政策、学校历史、企业文化、教师培训材料、以及其他所需材料。
19 The teacher should follow ‘The Teacher Code of Conduct’ and all responsibilities as stated in this contract. The code of conduct is to be considered a critical and inseparable part of this document.

School’s Responsibilities - The School shall provide:

1 Curriculum material for the Teacher to understand the student’s needs, the School’s expectations and be able to write detailed lesson plan for the class.
必要的材料以便老师理解学生的需要，学校的期望并能够写详细教案。
2 Access to necessary teaching aids and tools to the best of the School’s ability (i.e.: photocopiers, audio/visual equipment).
尽学校最大的能力使能够获得必要的教学帮助和工具（如：复印机、摄像机等）
3 A Native Chinese Speaking Assistant should be provided in kinder level 1-2 for the foreign Teacher.
提供一名中籍教师为教授幼儿一级二级的老师提供助教。
4 One bicycle is provided to each Teacher for ease of transportation. The bicycle should be taken good care of and returned to school once the contract is finished. If it is lost or stolen, then the teacher will reimburse the school.
为交通的方便起见，给每位老师提供一辆自行车。自行车应当被妥善保管，合同结束，应当归还学校。如遗失，老师需要赔偿学校。
5 Work under the direction of the school as a teacher primarily at the _Baoji__ branch for the duration of this initial agreement but the employee acknowledges and agrees to work in other locations or branch schools as required. Traffic fees will be reimbursed provided a receipt is given upon request.
在合同开始期间，根据该校的安排，受聘方主要在_宝鸡__分校工作。但受聘方须同意按要求去其他分校工作，交通费用根据学校要求提供单据报销。
Sick Leave/Absence
病假/缺席：
1 Upon the request and agreement of the Teacher, the school shall help to call appropriate doctors for the Teacher; Or, the school will assign a Chinese teacher to go with the foreign teacher to see the doctor.
在老师的要求及同意下，学校将帮助老师叫合适的医生。或者，学校将安排一名中籍教师陪同该老师去看病。
2 If the Teacher misses 3 or more days due to sickness, he/she will need to produce a note from a doctor. If they cannot produce a doctor’s note, the Teacher will be fined two times their daily salary for the days that they missed.
如果老师因病3天或更多时间不能上班，需要向学校出具医生证明。如不能出具，老师每天将被处以当日工资两倍的罚款。
3 If the teacher return his/her country, not because he/she complete the contract, but because of special reason, school shall not be responsible for the costs of airfare to the teacher’s country.
如果老师回国，不是因为完成合同所规定的期限，而是因为特殊原因，学校将不对归国而引起的任何费用负责。
Personal leave
因私离开：
1 For less than 1 days personal leave, a written application is needed. The application must be submitted two weeks prior to the desired date of leave and is subject to permission of the school.
对于少于1天的因私离开，需要书面申请。申请必须在离开之日的两周前递交，并且需要得到学校的同意。超过1天的因私请假，在任何时候都不会被允许的。
2 For more than 1 day days personal leave，if the teacher can find a qualified foreign teacher as his/her substitute, and approved by the principle of the school, there will not be any change of salary of the teacher. The school will not pay for the substitute teacher.
对于1天以上的因私离开,如果该老师能够找到合格的外教来替换他/她，并且经校长同意，该老师的工资将不会变化，学校将不对替换教师支付报酬。
3 If the Teacher does not get the permission and still takes the leave, then a fine of three times the daily salary will be applied accordingly.
如果老师没有得到许可，仍旧离开，将被处以3倍的罚款。
Medical Insurance and Sick Pay
医疗保险及生病期间的报酬：
1 The School will provide minor medical care for the Teacher while the Teacher is employed at the School（600 Yuan RMB for those with a one year contract and 300 Yuan for a half year contract）. The school will not provide or pay for medical insurance, including repatriation insurance, for the Teacher. It is the Teacher’s responsibility to arrange for such insurance.
老师工作期间，学校会提供小额的医疗补助（一年合同600元，半年合同300元）。学校将不提供医疗保险，包括返回保险。老师应自行负责这项保险。
2 Suitable medical and travel insurance for the duration of this contract should be arranged by the employee before departure to China. The school will provide minor health care for the employee while employed at This school. The school is not responsible for the cost of medical expenses or repatriation. In the event that the school need to contact a family member，please provide a name and contact details below：
受聘方在合同期间的医疗及旅行保险应在到达中国之前办理，受聘方在该校工作时，该校提供最基本的医疗补助。当医疗情况需要时该校应为员工提供必要的支持，该校无责任支付相应的医疗费用。如果该校需与受聘方的亲属联系，请提供亲属的姓名及联系方式：

3 The Teacher may take a maximum of _1_days paid sick leave in 6 month, subject to the Teacher’s illness being verified by doctor at the largest local hospital. Additional sick days beyond this limit will not be paid without obtaining the School Director’s approval, which will not be unreasonably withheld.根据当地最大医院的医生看过病情，老师半年最多1天带薪病假。没有得到校长的同意的超出这个限度的病假将没有薪酬。
4 In the event that an employee is absent from duty for ten consecutive days or more， due to illness or injury，then the employer reserves the right to review this agreement/contract on medical grounds.
受聘方因病或受伤连续请假十天或十天以上，聘方有权重新审议合同。
Bonus:
福利:
The school will maybe give special rewards or bonus for hard working. The bonus for one month of good teaching is 50-100 Yuan RMB at the most. The teacher’s work will maybe be evaluated by the director and someone appointed by the principle every month.
校长可能会对于努力工作给予特殊奖励。老师的工作得到校长和主管的认可，一个月将会有最多50-100元的奖励，该老师的工作将被校长和被校长指定的一些人评估。
Termination of Contract:
合同的终止：
1 This requirement does not affect the employer’s right to terminate the agreement/contract of the employee if behavioral conditions outlined in this agreement/contract are breached. The school won’t give any compensation or payment of airfare.
如果受聘方违反了合同中的任何条款，聘方有权终止合同。学校将不予支付和补偿机票。
2If for any unreasonable reason either party to this agreement/contract desire that it be terminated, the party seeking such termination must provide sixty (60) days written notice to the other party，and pay 500-2000 dollars.
如果因任何不合理的原因，一方要终止合同，必须提前60天以书面形式通知另一方。并且支付违约金500-2000 dollars。
3 If this contract is terminated for any reason, the employee must vacate the apartment provided by the school within 5 days. The employee will pay for all housing costs up to the date of the apartment being vacated.
不论由于任何原因终止合同，受聘方必须在五天内搬出公寓，超出期限，房费自付。
4 This agreement may be renewed and or updated under the same or renegotiated conditions for a nominated period if all parties agree.
如果双方同意，在双方同意或谈判的基础上，本协议可在提出的期间被更新
5In the event of early termination of contract the employee will be required, due to government regulations, to bring their passport to the local PSB office, with the school representative, and cancel their VISA(s) and Resident Permit(s) provided by the school.
如果受聘方要求提前终止合同，根据政府规定：该校的代表和受聘方要去当地公安局办理该校申请的居留许可和专家证的注销手续。
6 Any discrepancies between the government requirements and this contract，the government requirements will be upheld, but all other non-affected terms within this contract portion will stand。政府要求如与该校内部规定条目有偏差，将尊重政府要求之规定，与政府要求不相冲突的其他该校内部规定都将成立。
This contract, Code of Conduct, Amendments, and Recognition of Notification are inseparable documents.
本合同、教师条例、合同修改件和通知确认书为不可分割的文件。
The Employer and the Employee, hereby, declare that they have read and understand clearly the above provisions and further agree to sign this contract and abide by such provisions. The signing parties shall retain a copy of this contract.
聘方与受聘方在此宣称双方已经读过并清楚理解以上条款，并同意签署这份合同，并遵守以上条款。签署双方均保留本合同复印件
