This University is the chief medical science education and research centre in the joint area of Guangdong province, Guangxi province, and Hainan province. This University now has two campuses. Zhanjiang campus is situated in Zhanjiang , a beautiful seaport city. The campus covers an area of 151,334.09 square meters, and the buildings cover an area of 215,476.83 square meters. Sample Contract
Ⅰ.Party A This University wishes to engage the service of Party B
as a Foreign Expert in English Language Teaching at Dongguan Campus. The two parties, in a spirit of friendly cooperation, agree to sign this contract and pledge to fulfill conscientiously all the obligations stipulated in it.
Ⅱ. The period of service will be from September 1, 2011 to June 30, 2012.
Ⅲ. Party A's Obligations
1. Party A shall introduce to Party B the laws, decrees and relevant regulations enacted by the Chinese government, the Party A's work system and regulations concerning administration of foreign experts.
2. Party A shall conduct direction, supervision and evaluation of Party B's work.
3. Party A shall provide Party B necessary working and living conditions.
4. Party A shall provide co-workers.
5. Party A shall pay Party B's salary regularly by the last day of every month.
Ⅳ. Party B's Obligations
1. Party B shall observe the laws, decrees and relevant regulations enacted by the Chinese Government and shall not interfere in China's internal affairs.
2. Party B shall observe Party A's work system and regulations concerning administration of Foreign Experts and shall accept Party A's arrangement, direction, supervision and evaluation in regard to his/her work. Without Party A's consent, Party B shall not render service elsewhere or hold concurrently any post unrelated to the work agreed on with Party A.
3. Party B shall complete the tasks agreed on schedule and guarantee the quality of work.
4. Party B shall respect China's religious policy, and shall not conduct religious activities incompatible with the status of an expert.
5. Party B shall respect the Chinese people's moral standards and customs.
Ⅴ. Revision, Cancellation and Termination of the Contract
1. Both parties should abide by the contract and should refrain from revising, canceling, or terminating the contract without mutual consent.
2. The contract can be revised, cancelled, or terminated with mutual consent. Before both parties have reached an agreement, the contract should be strictly observed.
3. Party A has the right to cancel the contract with a written notice to Party B under the following conditions:
1) Party B does not fulfill the contract obligations according to the terms stipulated and has failed to amend after Party A has pointed it out.
2) According to the doctor's diagnosis, Party B cannot resume normal work after a continued 30 day sick leave.
4. Party B has the right to cancel the contract with a written notice to Party A under the following conditions.
1) Party A has not provided Party B with necessary working and living conditions as stipulated in the contract.
2) Party A has not paid Party B as scheduled.
Ⅵ. Breach Penalty
1. When either of the two parties fails to fulfill the contract or fails to fulfill the contract obligations according to the terms stipulated, that is, breaks the contract, it must pay a breach penalty of US $2,000 (or the equivalent in RMB).
2. If Party B asks to cancel the contract due to events beyond his/her control, he/she should produce certificates from the department concerned, obtain party A's consent, and pay his/her own return expenses; if Party B cancels the contract without valid reason, he/she should pay his/her own return expenses and pay a breach penalty of US $2,000 (or the equivalent in RMB) to Party A.
3. If Party A asks to cancel the contract due to events beyond control, with the consent of Party B, Party A should pay Party B's return expenses; if party A cancels the contract without valid reason, Party A should pay Party B's return expenses and pay a breach penalty of US $2,000 (or the equivalent in RMB) to Party B.
Ⅶ. The Appendix of this contract is an inseparable part of the contract and has equal effect.
Ⅷ. If either of the two parties asks for a new contract, he/she should forward the request to the other party 90 days prior to the expiration of the contract and sign the new contract with mutual consent.
Ⅸ. Arbitration
The two parties shall consult with each other and mediate any disputes, which may
arise about the contract. If all attempts fail, the two parties can appeal to the organization of arbitration for Foreign Experts Affairs in the State Administration of Foreign Experts and ask for a final arbitration.
Appendix
Ⅰ. Work Assignment for Party B
1. Conduct English classes for students and Chinese teachers up to average 18 teaching periods each week. “Each period” is understood as 40 minutes and “each week” as Monday through Friday.
2. Advise students on extracurricular activities using English as the medium of communication.
3. Join English Corner activities organized by the students or give lectures to the college on topics of interest to both Party A and Party B.
4. Party B are responsible for grading the final oral exams organized each semester by the Teaching Department of Foreign Languages.
5. Party B must turn in the final results of his/her students’ oral English exams electronically in addition to a physical copy to the Teaching Department of Foreign Languages for record at the end of the 18th week each semester. (P.S: Final result= average scores*40%+ final exam scores*60%; party B gives students’ average scores according to their class performance)
Ⅱ. Payment
- Direct payment
1) Party B's salary will be ¥ Yuan RMB per month, 70% of which can be converted into Foreign Currency monthly. Each month’s salary will be paid on the last day of each month as governed by this contract.
2) Party B will receive his/her monthly salary during the winter vacation.
3) Party B will receive a travel allowance of ¥2200 RMB (after taxes) upon completion of his/her contract. However, if he/she engages in any activities that lead to the termination of the contract. Party B will forfeit his/her right to receive the travel allowance.
4) Party A will reimburse Party B his/her round-trip Economy Class air fare for travelling to <This University> with a fixed amount of ¥8000 RMB (after taxes) on completion of his/her contract. However, if he/she engages in any activities that lead to the termination of the contract, Party A will reserve the right to withhold the plane ticket reimbursement.
5) Party B must pay the personal income tax in accordance with the Personal Income Tax Law of the People’s Republic of China. Any amount over ¥4800 Yuan each month is taxable.
- Indirect payment
Party A will guarantee the fundamental living conditions for Party B in <This University> during the term of contract.
1) The expenses for Party B’s resident permit and health certificate shall be covered Party A.
2) Party A will provide free on-campus accommodation with a bed-room, a living-room, a kitchen and a bathroom. The apartment is equipped with furniture, a television set, a washing-machine, a refrigerator, an air-conditioner, a telephone, a hot water heater, a computer and a printer. Party B has free access to internet.
3)Party A will buy the personal accident injury insurance and the hospitalization allowance insurance for Party B.
Ⅲ. Holidays
1. Party B will have statutory holidays as specified by the Chinese Government.
2. Party B is entitled to a paid winter vacation.
Ⅳ. Sick Leave and Private Affairs Leave
Any unapproved leave of absence will result in a deduction of ¥80 RMB per period. Repeated unapproved leaves is a sufficient reason for dismissal of Party B.
1. Sick leave
1) When asking for sick leave, Party B is required to provide Party A’s Foreign Affairs Office with a sick leave application attached with a doctor’s certificate.
2) The continuous sick leave of 15 days or above will result in a deduction of a whole monthly salary. In case the continuous sick leave exceeds 30 days, Party A has the right to terminate the contract.
2. Private affairs leave
1) Private affairs leave can only be granted for urgent personal reasons.
2) Party A will help Party B get a substitute teacher in case Party B has difficulty in finding one for himself/herself. During this period the substitute teacher will get his/her payments for the extra classes from Party B’s monthly salary, ¥80 RMB per period.
Ⅴ. Other conditions
1. Party B’s dating students and other inappropriate behaviors are not allowed. In the event this should occur, the matter will be investigated by Party A’s Foreign Affairs Office and if the events are proven to be true, the consequences will result in the termination of Party B’s employment.
2. Party B must behave in a respectable and professional manner at all times, both in and outside the classroom environment, and not engage in any activities that may damage Party A’s reputation.
3. Party B is not allowed to use inappropriate language with students and colleagues.
4. Party B must follow the teaching arrangements made by the Teaching Department of Foreign Languages.
5. Party B shall neither be late for class nor dismiss class early. Violation therein, after receiving warning by Party A, will result in the deduction of ¥80 RMB per period. Repeated violation is sufficient grounds for dismissal of party B.
6. Part B is advised to use the teaching materials selected by the Teaching Department of Foreign Languages while he/she can be as creative as he/she likes in class.
Ⅵ.Confirmation and change of every term of the appendix of the contract must be stipulated in written form through negotiation between the two parties. Any oral agreement will be regarded as invalid. This appendix has equal validity of the standard contract and comprises an integral part of the contract.
Ⅶ. This Contract is signed at <This University>, in duplicate, in the Chinese and English languages, both texts being equally authentic.
Ⅷ. This contract takes effect only after the approval is given to Party A to hire Party B by Guangdong Foreign Experts Bureau. This contract will automatically expire when the contract ends.
