Party B: The Employed Party ( Foreign Teacher Passport No. )
I Work Assignment
1. Party B should teach according to the arrangement of Party A, and guarantee his teaching is of high quality.
2. Party B will teach a maximum of 20 hours each work.
3. Party B is not allowed to take any other job without permission from Party A.
II The Treatment
1. Direct Payment
Party B’s salary is RMB 4000 per month. The salary will be paid monthly in RMB from the day of starting work to expiration of the contract .In case the time is shorter than a whole month; the payment shall be counted by day. The daily wage shall be 1/30 of the monthly salary. 70% of the salary can be changed into foreign currencies.
2. Indirect Payment
Party A will guarantee the fundamental living conditions for Party B in China,which include apartment, heating, TV, telephone, fridge, washing machine, air-conditioner, computer, cookers, furniture etc.. Party B should take good care of these things, and use them properly. In case of any loss or damage caused by improper use, party B should compensate according to the actual value.
Party A will cover the fees of water, electricity, gas, local calls and internet, while long-distance calls should be covered by Party B.
3. Medical Care
Party A should buy medical insurance for Party B during the contract time. Party B enjoy free medical care in the college hospital. The medical expenses in other hospital shall be covered by Party B. Expenses for registration, transportation for medical care, tooth inlaying, face lifting, massage, glasses, meals in hospital, tonics not for medical purpose etc. shall be covered by Party B. If Party B gets serious disease during contract time, Party A should reimburse part of his medical expenses, while the total amount should be no more than RMB 2000.
4. Travel Allowance
Party A will give Party B travel allowance RMB 1100 before the end of each semester.
III Work Time, Rest and Holidays
1. Party B is entitled not to work on the following holidays and festivals in China: New Year’s Day, Spring Festival, May Day, National Day and other holidays stipulated by Chinese laws and regulations.
2. Party B is entitled to enjoy paid vacation during the winter vocation of the college.
IV Sick Leave and Private Affairs Leave
1. Certificate from doctors in college hospital should be presented when Party B asks for sick leave, and party B should inform foreign affairs office and English Teaching and Research Office in advance. Sick leaves should amount to less than 10 days during the contract time. In case the leaves exceed 10 days, Party A has the right to terminate the contract, or, if the contract is not terminated, 70% of the salary will be paid until normal work is resumed.
2. Private affairs leave of Party B shall be approved by Party A. Party A will deduct the salary by day. During the contract time, the private affairs leaves should not exceed 7 days, and the continuous private affairs leave shall be no more than 3 days, and 2 days’ salary will be deducted for each day’s leave thereafter.
3. In case of 1 day’s absence from work without Party A’s permission, 3 days’ salary will be deducted. If the situation is serious, party A has the right to terminate the contract and investigate the liability of Party B for violation of the contract.
V Other Affairs
1. Party A should arrange a Chinese English teacher to assist Party B’s work and daily life.
2. Party A should get Party B Foreign Experts Certificate and residence permit, and cover the corresponding expenses.
3. Party B should abide by regulations of the college, should not get addicted to drug, alcohol etc., or fight with other people, otherwise Party A has the right to terminate the contract.
4. If Party B wants to leave Shijiazhuang for certain reason, he should tell Party A his plan at least one week in advance, and leaves the city after getting Party A’s permission.
5. Party B should never take anybody else into the college, or allow anybody else to sleep in his apartment.
6. When Party B is not in the college or attending any activity that is not organized by Party A, Party A is not responsible for Party B’s security.
7. If for the sake of Party B, the contract cannot be fully carried out and the English learning of the cadets in the college is influenced, Party B should pay breach penalty of $ 1000-$3000.
VI Any change of terms of this appendix must be stipulated in written form through negotiation between the two parties. Any oral agreement will be regarded as invalid.
This appendix is signed at Shijiazhuang, in duplicate, this _______day of _________, 2007, in Chinese and English, both texts being equally authentic.
This appendix has equal validity as the standard engagement contract and composes an indiscerptible part of the contract.
