Maritime College Employment Contract

Party A: Party B:
Party A wishes to engage the services of Party B as a foreign English teacher. The two Parties, in a spirit of friendly cooperation, agree to sign this contract and pledge to fulfill conscientiously all the obligations as stipulated below:
Ⅰ. The period of service will be from the day of , 2008 to the day of _ June_2009(ten months altogether) .
Ⅱ. Party B’s monthly salary will be Yuan RMB(before tax), and the pay day is on the 13th of the following month. The salary paid during the days when Party B has no classes, is for Party B’s travel expenses, airfare and luggage expenses,medical insurance, and the like.
Ⅲ. Party A’s Obligations
1. Party A shall introduce to Party B the laws, decrees and relevant regulations enacted by the Chinese government, and Party A’s work system and regulations concerning administration of foreign experts.
2. Party A shall Provide Party B with necessary working conditions;
3. Party A shall provide Party B with a free flat with furniture, electric appliances, and cooking utensils. And Party A agrees to pay the water and electricity bills and any maintenance charges of the flat during the employment period;
4. Party A shall conduct direction, supervision and evaluation of Party B’s work.
5. Party A shall provide co-workers when final examinations are carried out.
6. Party A shall pay Party B’s salary monthly;
7. Party A shall offer necessary help when Party B has difficulties in daily life;
8. Party A shall assist Party B in applying for necessary certificates and the other procedures.

Ⅳ. Party B’s obligations
1. Party B is obliged to abide by the laws, rules and regulations enacted by Chinese government, and if Party B is involved in any activities that violate China’s law, Party A has the right to cancel the contract.
2. Party B is not permitted to impose any religious beliefs on his or her students or other teachers, distribute religious books or articles, or organize religious groups.
3. Party B agrees to work for no more than 20 classes per week for Party A(One class lasts 45minutes), and agrees to accept the arrangement of the working days and working place which are decided by Party A.
4. Party B shall carry out the teaching procedure according to the textbook given. If Party B wants to add more contents to the textbook, the contents mustn’t contravene any laws of the People’s Republic of China.
5. Party B shall begin his or her classes punctually according to the schedule, and shall not dismiss any classes before the they end.
6. Party B shall not be absent from any classes without permission.
7. Party B shall prepare each lesson well before going to class.
8. Party B shall keep a record of the students’ attendance and performance. Party A shall provide a register in English for Party B.
9. If Party B’s sick leave is more than one morning, a doctor’s certificate must be presented to the Teaching Affairs Office; If Party B’s leave of absence from class is for personal reasons, it can only be granted by the Teaching Affairs Office, which must be reported to the Teaching Affairs Office at least two days beforehand. If the leave is more than two days, the salary will be deducted.
10. Party B shall test the students’ language proficiency and performance regularly and keep records. The tests, the classroom performance and attendance together make up 30%, while final examination makes up 70% of students’ final assessment of each course.
11. Party B agrees to pay for his own meal expenses, gas bill, telephone fee, internet
expense, and medical expense.
12. Party B should buy Medical Insurance, which covers the medical fees for serious disease and hospital expenses, and Life and Accident Insurance in China (including the Medical and Accident insurance of Party B’s families when they visit China).
13. Party B is encouraged to take part in extracurricular activities with students, such as sports, literary and art activities. But Party B is not allowed to take students to the places of entertainment, such as dance halls, cinemas, expensive restaurants, etc.
Ⅴ. Revision, Cancellation and Termination of the Contract
1. Both Parties should abide by the contract and should refrain from revising, canceling, or terminating the contract without mutual consent.
2. The contract can be revised, canceled, or terminated with mutual consent. Before both parties have reached an agreement, the contract should be strictly observed.
3. Party A has the right to cancel the contract with a written notice to Party B under the following conditions:
(1). Party B does not fulfill the contract or its obligations according to the terms stipulated, and has failed to correct the problem after Party A has pointed it out.
(2). According to a doctor’s diagnosis, Party B cannot resume normal work after a continuous two-week sick leave.
4. Party B has the right to cancel the contract with a written notice to Party A under the following conditions:
(1). Party A has not provided Party B with necessary working and living conditions as stipulated in the contract.
(2). Party A has not paid Party B as scheduled.
Ⅵ. Breach Penalty:
1. Party B’s teaching evaluation is to be made by the students and the experts from the Teaching Affairs Office. If Party B is firmly believed to be an unqualified teacher, Party A has the right to stop the employment or stop the contract with a written notice one month beforehand. In this case, both Parties do not pay a breach penalty.
2. If Party A wants to stop the contract unreasonably during the employment period, Party A will pay Party B twice as much as the salary for the rest of the months stipulated in this contract.
3. If Party B wants to end the contract unreasonably during the employment period, Party B will pay Party A twice as much as the salary for the rest of the months stipulated in this contract.
4. For the following situations, breach penalty is not required:
1) Party A asks to cancel the contract due to events beyond control, with the consent of Party B;
2) Party B needs to terminate the contract in advance and informs Party A in writing three months beforehand, with the consent of Party A;
3) Party B fails to fulfill the contract for serious disease or other reasons and produces certifications by the department concerned , with Party A’s consent
4) Party B asks to cancel the contract due to events beyond control, with Party A’s consent.
Ⅶ. Arbitration
In case of any dispute, and no settlement can be reached through friendly negotiations, the case will be submitted to the Office of Arbitration for Foreign Experts Affairs in the State Bureau of Foreign Experts and ask for a final arbitration.
This contract takes effect and remains effective from the day Party B obtains his/her Foreign Experts Work Permit, Work Visa and Residence Permit issued by relevant authorities of the Chinese government. This contract is written both in Chinese and English; each party keeps a copy and both versions are equally authentic.
