Sample of Contract

   Party A（College of Technology）wishes to hire Party B (    ) as a foreign expert. The two parties agree to sign this contract based on the principal of friendly cooperation.

  Ⅰ. The term of the contract will be from           to             . 

  Ⅱ.The duty of Party B is as follows:

    Party B shall work 5 days a week, giving English classes no more than 16 hours.

  Ⅲ. Requirements for Party B:

      1. Party B shall observe the constitution, laws and regulations of People’s Republic of China, and regulations of Party A, and respect the customs and habits of Chinese people.

      2. Party B shall actively co-operate with Party A and make every effort to complete the tasks agreed on.

      3. Party B shall accept Party A’s directions, arrangement, supervision and evaluation in regard to Party B’s work. Party B shall accept Party A’s teaching inspection and written feedback 2 weeks after starting teaching. In case Party B’s teaching does not meet Party A’s requirements, Party B shall improve his or her teaching and meet the standard specified by Party A within 2 weeks.

   4.Without Party A’s consent，Party B shall not take part-time job irrelevant to the work agreed on with Party A.

   5. Party B shall hand in his or her Foreign Experts Certificate when the contract expires or before he or she leaves the college after the termination of the contract.

   6. Before leaving the city for private affairs, Party B must fill A Form for the Departure of Foreign Teachers from City for Private Affairs.

    Ⅳ. Party A shall provide Party B with the necessary conditions for work such as computer, internet, printer, and give due consideration to suggestions put forward by Party B for the improvement of the teaching work.

  Ⅴ. Party A shall pay Party B a monthly salary of_   _RMB Yuan. And within the term of the contract Party B shall enjoy paid holidays as prescribed by the Chinese Government and those fixed by Party A. Party B will be paid from the exact date when he or she begins to work within the term of the contract.

  Ⅵ. Party A shall provide Party B with free housing with furniture, bed linen, lighting and sanitary equipment. Party B shall pay for the electricity, water, gas, and phone call, etc by himself/ herself.

    Ⅶ. Part B shall be responsible for the expenses of medical care in case of any health problem or accident and Party A promises to offer humanitarian help. It is required that Party B should buy health and life insurances before arriving in China.

   Ⅷ. Party A is responsible for the work/expertise visa arrangements and relevant proceedings.   

   Ⅸ. Party A shall pay for a single airplane ticket for an economical class for Party B from

       to _Shanghai_. The price shall not be higher than that of the Chinese airlines at the same period.

    Ⅹ. Both parties shall abide by the contract. Neither of the two parties shall terminate or alter it ahead of time without mutual consent.

      1. If Party B wants to terminate the contract before it expires, it should hand in a written application with explanations 30 days in advance. Party B shall not stop working until Party A approves the application. Party A shall cease to pay Party B his salary and cease to provide Party B with benefits concerning living conditions after Party A approve the application. If Party B terminates the contract without any reason, it has to pay RMB3000 Yuan for breaking the contract.

      2. If Party A wants to terminate the contract before it expires, Party A shall inform Party B 30 days in advance with the reason for the termination. Party A shall pay Party B full salary of the current month as stipulated to be paid within the term of the contract.

   Ⅺ. Party A shall have the right to terminate the contract without paying Party B salary of the current month if any of the following cases happens:

      1. If Party B violates any of the stipulations under ArticlesⅡ and III of the contract and fails to correct such a behavior after Party A’s warning, Party A will have the right to terminate the contract and to enjoin Party B to return to its own country within 15 days.

      2. If Party B fails to resume his or her regular work after 15 days’ sick leave granted by a doctor after his diagnosis, Party A may, considering Party B’s health, terminate the contract and arrange for Party B to return to its own country within 15 days.

   Ⅻ. The contract comes into effect from the date Party B signs it and becomes void upon the expiration of the contract. Either Party that makes a proposal for the extension of the contract should put forward the request on 60 days’ notice prior to the expiration of the contract. Upon agreement by both parties through consultation, a new contract of extended term shall be signed.

   XIII. If any dispute that is not specified in this contract arises with in the term, both parties should settle it through consultation.

  XⅣ. The contract is written in Chinese and in English, with both texts being equally valid.

  ⅩⅤ.The contract is signed in duplicate. Each of the parties keeps one copy.
