Contract of Employment
1. The Parties to the Contract
Party A, This International School , Beijing, agrees to engage the services of Party
B,______________________________________________ as an Expatriate Faculty
Member. Both parties, in line with the principles of legality, fairness, equality, mutual
agreement, honesty, andtrustworthiness, on a voluntary basis, and in a spirit of friendly
cooperation, agree to sign this contract and pledge to fulfill all the obligations stipulated
hereinafter.
2. The Period of the Contract
The term of this contract shall be from _________________ to _________________.
3. Salary
3.1 Party B’s monthly salary will be RMB ___________ before tax, which includes 300 RMB
for taking part in the activities organized by school; and 200 RMB for full attendance; Party
B’s monthly salary will be reduced by the appropriate amount should either of these
stipulations not be met.
3.2 Party B’s salary will be paid on the 10th of every month. If the 10th falls on a weekend or
public holiday, the salary will be paid on the next working day. The monthly salary will be
calculated from the commencement of duties.
4. Personal Leave
4.1 Party B is entitled to 7 days of paid sick leave per year. To claim paid sick leave, Party B
must follow the regulations stipulated in the school’s leave procedures. Unclaimed sick leave
cannot be accumulated or exchanged
4.2 Party B must follow the school’s official rules for taking personal leave, whether planned
or emergency, as outlined in the school’s leave procedures.
5. Holiday
5.1 Statutory holiday will be in accordance with the Chinese Government’s holiday
regulations up to date. However, Party A reserves the right to reschedule any missed classes
for Party B.
5.2 For non-statutory holiday, Party B will receive a basic salary of _____ RMB per month.
6. Insurance
Party A will purchase accident insurance for Party B subject to the period of this contract, and
help Party B to seek reimbursement for his/her accident related expenses.
7. Visa and Foreign Expert Certificate
7.1 Party A is responsible for applying for a work visa for Party B and will pay for the working
visa. If for any reason Party B fails to complete this contract, Party B will be responsible for
the cost of the visa.
7.2 Party B must provide true and relevant documents and information for visa application
purposes and meet the application requirements. Party B shall take full responsibility, both
financially and legally, if the information provided is false and/or incomplete.
7.3 Party A will keep the Foreign Expert’s Certificate for Party B. Party B may borrow it only
with Party A’s permission and must return it immediately after use. Failure to return the
Foreign Expert’s Certificate at the agreed time will result in a ______RMB penalty for Party B.
7.4 All visas will be cancelled upon completion or termination of this contract. Party B will be
responsible for the cost of the new visa.
8. Performance Bonus
Party B will receive a performance bonus of up to _____________RMB upon the successful
completion of this contract. The bonus amount received by Party B will be subject to a
performance evaluation.
9. Responsibilities and Obligations of PartyA
9.1 Party A shall introduce to Party B the laws, Decrees and relevant regulations enacted by
the Chinese Government and Party A’s work system and regulations concerning
administration of foreign experts.
9.2 Party A shall provide Party B with necessary working conditions
9.3 Party A reserves the exclusive rights to have Party B teach in any of the schools within the
campus,namely xxxx (This International School).
9.4 Party A has the responsibility to report any serious academic and/or personal misconduct
by Party B to the relevant Government authorities
9.5 Party A reserves the right to make use of Party B’s image for school promotional purposes
10. Responsibilities and Obligations of Party B
10.1 Party B shall observe the relevant laws and regulations of the People’s Republic of China
and shall not interfere in China’s internal affairs.
10.2 Party B shall respect China’s religious policies, and shall not conduct any religious
activities incompatible with his/her status as a foreign expert.
10.3 Party B shall respect Chinese people’s ethics and customs.
10.4 Party B shall observe Party A’s work system and Regulation Guidelines for Expatriate
Teachers and shall accept Party A’s arrangement and direction.
10.5 Without Party A’s consent, Party B may not take any part-time job assigned by any other
party.
10.6 Party B shall complete the duties as specified in the attached Academic Teacher Job
description, and Party B’s academic or teaching performance will be supervised and evaluated
by Head / Deputy of Academic Affairs and the Academic Committee.
10.7 Party B has the responsibility to keep all the books and teaching materials provided by
Party A in good condition, and return them upon the expiry and/or early termination of the
contract. Party B has to pay for any damage to the books and/or teaching materials provided.
11. Revision of the Contract
This contract can be revised only by mutual consent, and must be signed by both parties.
Before both parties have reached any agreement, the terms in this contract should be strictly
observed.
12. Cancellation and Termination of the Contract
12.1 The following penalties will be paid by Party B in the event of early termination of the
contract,
(1) Immediate termination by Party B – 10,000RMB
(2) Termination at the end of the trimester by Party B (30 days notice required) – Up to
5000RMB
12.2 This contract will be null and void upon expiration
13. Confidentiality
The details of this contract are confidential and are not to be revealed to a third party. Failure
to maintain this confidentiality shall result in immediate termination of this contract.
14. Appendices of this Contract
Appendices of this contract are; A - Regulation Guidelines for Expatriate Teachers, B -
Academic Teacher Job Descriptions and C - Lease for Expatriate Teachers, and they have
equal legal effect.
15. Settlement to Dispute
Any dispute in connection with this contract shall be first of all settled between both parties
concerned through friendly consultation. In the case that no settlement can be reached
through consultation or intermediation, both parties shall submit the said dispute for
arbitration with local personnel authorities
or the local labor arbitration system. In case either party refuses to accept the arbitration
award, it may bring an action before the people’s court.

Regulation Guidelines for Expatriate Teachers
1. Teachers shall comply with the rules and regulations of the school.
2. Teachers shall comply with the laws and regulations of the Chinese Government.
3. Teachers shall not engage in any activities that may jeopardize the reputation of the
school.
4. Teachers will at all times perform their duties in a professional manner. This is taken to
5. mean that lesson plans are prepared in advance, and all required paperwork is completed
6. accurately and promptly.
5. Teachers must follow the school’s syllabus.
6. Teachers are required to be in the classrooms 5 minutes before the start of each lesson. If
a teacher is late for class, a pro-rata deduction will be made for late attendance
7. Teachers must observe the dress code while at work; smart and professional attire.
8. Outside of work hours whilst in public areas of the campus, teachers must dress and act
9. appropriately.
8. Students are to be treated with respect, consideration and kindness. However, it is
9. forbidden for teachers to form improper relationships with students.
9. Teachers need to fulfill 40 working hours every week (including 20 teaching hours).
10. Teachers’ cell phones need to be turned on during working hours, except during teaching
11. time.
10. Teachers cannot accept valuable gifts, free trips, gratuities, dinners, and other
11. entertainment from students or students’ families without prior approval from the school.
11. Teachers are responsible for maintaining in good order and returning upon request,any
12. teaching materials, resources, or equipment given to them by the school.
12. Teachers may be assigned extra hours of substitute / tutorial classes /school or program
13. promotion work if the weekly teaching hours is less than 20 hours. However, teachers will
14. be paid a standard fee of 100 RMB per hour for overtime work.

Appendix C
Lease for Expatriate Teachers
This is a legally binding contract between the school and the expatriate teacher detailed in
section 1 (Referred to as ‘the tenant’ or ‘tenant’ from hereon)

5.6 The tenant shall keep the premises in a clean and sanitary condition
5.7 The tenant is responsible for the cost of any damages of the premises properties by the
tenant or their visitors. This includes, but is not limited to, the TV, sofa, tables, chairs,
microwave, fridge, cookers, water heater, shower unit, sinks, bed and wardrobe
5.8 Any maintenance or repairs of the premises and/or the properties must be referred to the
school for approval
5.9 The tenant agrees to replace all broken light bulbs and fluorescent tubes and ensure they
are in good working order
5.10 The tenant shall not use the premises for any purpose other than dwelling.
5.11 The tenant agrees to allow the school to access the premises, with written notice, on a
reasonable number of occasions for the purpose of inspecting and regular maintenance
checks between Monday to Saturday (inclusive) between 8.30AM to 5.30PM. The school
agrees not to touch the tenant’s personal properties and leave the premises in the same
condition
5.12 The school shall provide one set of keys that enable access to the premises. The tenant
shall not copy their keys.
5.13 Should the tenant lose their keys, they will be responsible for all costs and expenses
associated with replacing the keys and / or gaining access to the premises
5.14 Painting of the apartment, including walls and ceilings, shall be undertaken by the school
5.15 Visitors and guests are allowed into the tenant’s premises after completing the request
form. However, if the tenant wishes the guest to stay overnight, prior permission from the
school must be obtained (At least 1week in advance).

1. The Parties to the Contract
Party A , agrees to engage the service of Party B , as an Expatriate Faculty Member.
The two parties, in a spirit of friendly cooperation, agree to sign this contract and pledge to fulfill conscientiously all the obligations stipulated in it. Party A reserves the exclusive right to have Party B teach in any of the school within the campus, namely NIT¡¢AISB and/ or BIS.
It is understood by both parties that any Appendices to this contract are an inseparable part of the Contract and that the matters stipulated in any Appendices form an integral part of the contract conditions.
2. The Period of the Contract
The contracted period will be from the __ __ day of __ _ to the_ _ day of _ with the first three months as probationary period.
3. Salary
3.1 Party B’s monthly salary will be _ __ Yuan RMB before tax for working 40 hours. The salary is divided into four parts.(see 3.2)
3.2 Party B’s salary is divided into four parts. 1. ____ for 20 up to 24 teaching hours per week, if the teaching load doesn’t reach the contracted hours, Party B is responsible to take substitute / tutorial classes, otherwise this payment will be paid according to the real teaching hours. 2. _ __ for at least __3__ office hours during 8:30 am to 17:30 every day. 3. ___ __ for taking part in the activities organized by school, (for example, English Corner/ any kind of competition, etc.) 4. _ _ for full attendance (for example, no personal leave / late attendance, etc.), or this amount of payment will not be paid if any occasion occurred. Each payment will be assessed according to evaluated results.
3.3 Every 10th of the month, Party B shall be paid the salary of the previous month. However, if the 10th falls on a weekend, the salary will be paid on the following working day. The monthly salary shall be accounted from the date when teaching activity commences. If the first month is not a full month, i.e., the starting date is later than the first day of the month, then a pro rata salary, based on the number of days of teaching, will be paid.
3.4 Party B must provide the medical certificate for sick leave that mustn’t be continuous for 7 days within 2 months. Otherwise, Party A has the right t o terminate this contract.
3.5 Teacher must obtain permission two weeks in advance from school for leave from work due to personal reasons, and this leave is not paid.
4. Visa
4.1 Party A is responsible for providing employment offer letter. It will also help Party B with his/her application for the work visa to the Chinese Government. However, it is the responsibility of Party B to provide true and relevant documents and information for this purpose.
4.2 Party A will provide a sum of money for Party B’s Z visa application. Party B must return Party A the fees paid for visa application including physical exam, air travel and hotel should he/she works less than half the time as indicated in the new visa. Party A will help Party B to change the work permit (new visa) into a 30-day tourist visa for the convenience of Party B to return to the point of hire.(Party B has to pay for this tourist visa, only applicable for those who change their F/L visa into Z visa.)
5. Contract Completion of Incentive
5.1 Party A shall pay Party B _RMB8,000.00_ Yuan before tax as an incentive upon the full completion of this contract and results of evaluation made at the end of school year by This International School Academic Committee. Party B’s incentive will be deducted according to the results of evaluation. There will be no pro rata payment of this incentive should the contract be terminated prior to its expiry.
6. Medical Insurance
6.1 Party A will organize and pay for medical insurance for Party B subject to prevailing insurance coverage for the period of this contract.
6.2 Party B will pay any medical expenses and then seek reimbursement from the medical insurer through the services of Party A.
7. Responsibilities and Obligations of Party A
7.1 Party A shall familiarize Party B with the laws, decrees and relevant regulations enacted by the Chinese government, Party A’s work system, and rules concerning administration of foreign experts.
7.2 Party A will keep the Foreign Expert Certificate issued by Chinese authorities for Party B. If Party B needs to borrow it from Party A, Party B should get Party A’s permission and return it on time.
7.3 Party A has the responsibility to return the Foreign Expert Certificate to the Chinese authorities, when Party B completes the contract and leaves This International School . Final payment of salary will not be made to Party B until this condition has been fulfilled.
7.4 Party A shall supervise and evaluate Party B’s work on a regular basis per the key performance indicators as specified in the attached Regulation Guidelines for This International School Expatriate Teachers and This International School Academic Teacher Job Descriptions. Party A shall terminate the contract if Party B continues to fail and comply with the key performance indicators after Party A has pointed it out and has given 3 written warning letters.
7.5 Party A has the right to inform the Chinese authorities to cancel Party B’s Foreign Expert Certificate and Visa on the contract’s expiry or termination.
8. Responsibilities and Obligations of Party B
8.1 Party B shall observe the laws, decrees and relevant regulations enacted by the Chinese government and shall not interfere in China’s internal affairs.
8.2 Party B shall observe Party A’s work system and Regulations Guidelines for This International School Expatriate Teachers and shall accept Party A’s arrangement and direction.
8.3 Party B must obtain written permission from Party A to take a part time job outside of school. If Party B breaches this condition, Party A will inform Beijing Foreign Affairs Office and the Public Security Bureau, the Foreign Expert and the Residence Card will be cancelled, and this contract terminated.
8.4 Party B shall complete the duties as specified in the attached This International School Academic Teacher Job description. And Party B’s academic or teaching performance will be supervised and evaluated by Head / Deputy of Academic Affairs and This International School Academic Committee.
8.5 Party B shall respect China’s religious policy, and shall not conduct religious activities incompatible with the status of an expert.
8.6 Party B needs to work 40 hours a week. The exact working hours from Monday to Friday is scheduled in line with Party A’s need to teach. Party B should carry out all job duties assigned.
8.7 Party B should provide Party A with true and accurate information. Party B shall take all the responsibilities, both economically and legally if the information provided is false and inaccurate.
8.8 According to China’s Foreign Affairs Administration, Party B must inform Party A about his/her wish to leave Beijing for any period of time. A __4__-week notice is needed before the trip so that Party A can inform government departments concerned as required.
8.9 Party B has the responsibility to bear all expenses incurred when staying on after the contract expires, including the fees for dorm¡¢electricity¡¢new visa application¡¢etc.
8.10 Party B has the responsibility to keep all the books and equipments provided by Party A in good condition, and return all the books and equipments upon the expiry and/or early termination of the contract. Party B has to pay for any damage to the book or equipment provided.
9. Holidays
9.1 Party B is entitled to 11 paid statutory holidays, namely, New Year’s Day (1day), Spring Festival (3days), Labor’s Day (3day), National Day (3days)¡¢Christmas Day (1 day).
9.2 The school reserves the right to schedule holidays for teachers during summer and winter with basic salary (RMB 2,500 or 30% or 15 teaching hours whichever is lower). Such scheduling will not be more than one month.
10.Accommodation
10.1 As a courtesy, Party A will supply Party B with a fully furnished accommodation on site for the period of this contract. This accommodation, which is shared with another foreign teacher, does not form part of the salary package. This accommodation is only provided if Party B stays at least 4 nights a week, should Party B breach this condition, the accommodation has to be vacated and Party B shall be charged 200 Yuan/ night. This payment should be deducted from Party B’s salary.
10.2 Party A shall apply Residence Card for Party B if Party B lives in school. Otherwise, Party B has to apply for Residence Card by themselves, and provide a photocopy to Party A.
10.3 Upon the expiry and/or termination of the contract, Party B must vacate the accommodation provided within one day.
11. Penalties for Breaches of the Contract
11.1 Any amounts paid under clauses 4.2 and 6.1 of this contract will be deducted from Party B’s salary if Party B does not fulfill the conditions of this contract for a minimum period of six months.
12. Revisions, Cancellation and Termination of the Contract
12.1 Both parties should abide by the contract and should refrain from revising, canceling, or terminating the contract without mutual consent.
12.2 The contract can be revised, canceled, or terminated only with mutual consent. Otherwise, the terms and of this contract should be strictly observed.
12.3 Immediate termination of employment occurs under following circumstances:
· The contract expires.
· Party A or B’s not fulfilling the contract obligations according to the terms stipulated
· Unacceptable personal behavior or low quality of teaching/academic performance on the part of Party B.
· According to the doctor’s diagnosis, Party B cannot resume normal work after a continued 30 days sick leave.
12.4 Both parties have the right to terminate the contract after the three month probation period by giving a one month notice. But either party will pay a penalty of 500 US dollars if the termination is for reasons other than that stipulated in item.
13. Arbitration
13.1 The two parities shall consult with each other and mediate any disputes which may arise about the contract. If all attempts fail, the two parities can appeal to the organization of arbitration for foreign expert affairs in the State Bureau of Foreign Experts and ask for a final arbitration.
13.2 In the event of a dispute, the Chinese version of this contract will prevail. Both parties can get translated version for arbitration.
14. Confidentiality
The details of this contract are confidential and are not to be revealed to a third party. Failure to maintain this confidentiality shall result in immediate termination of this contract.
15. Signing of Commencement & Completion of This Contract
15.1 This contract takes effect on the date signed by both parties.
15.2 This contract automatically expires when the contract ends.
15.3 If either of the two parties intends to renew the contract, written notice is required and must be submitted within 30 days of the expiration of this contract whereupon a new contract will be drawn up and signed by mutual consent.
15.4 This contract supersedes all previous contracts between the parties.
