Brief Introduction about Employer

Introduction

This Institute is a regular, full-time, vocational school directly subordinate to the Jiangsu Provincial Department of Education. The school is located in the center city of the Yangzi Delta, Changzhou, where the national higher vocational education teaching reform experimental area, Changzhou science park. The institute was founded in 1958, and is characterized by its own specialties and leadership. And now a new pattern for the coordinated multi-discipline development of humanities, sciences, technology, and art has emerged. It covers an area of 825 mu or 2,802,ooo square meters, which is a garden style, digital, ecotype, development modern green campus. At present, it has 8528 full-time students, 7578 of whom graduated from high school. The number of students is expected to reach 12,000 in the eleventh “Five-Year Development” plan.



With the inspiring motto “pursue morality, develop careers, study wholeheartedly, act wholesomely”, the institute maintains its uniqueness in its leadership, its majors with superior characteristics, and its skilled students. The institute consists of the following departments: Textile & Chemical Engineering, Art, Fashion, Business & Trade, Foreign Language, Mechanical & Electronic Engineering, Information Technology, General Education, and Continuing Education. Within these departments there are twenty-three majors, among which dyeing-finishing technology and fashion design are prioritized by the Ministry of Education of China.



The institute has 508 employees, 387 of whom are professional teachers. On the teaching staff there are more than 30 education experts, excellent teachers and national title of top ten fashion designers who share the State Department subsidy.124 senior titled teachers, and 197 “double-typed” teachers with both academic and practical knowledge. In addition, the institute has also invited 40 visiting professors and 8foreign teachers.

The institute also boasts various kinds of advanced teaching equipments and instruments worth 43,000,000 yuan, including the advanced textile production design system and computer color matching system. The scientific research capacity is strong, especially in the mechanical and physical quality testing and experimentation of fabric fibers; testing and analyzing dyestuff and auxiliary agents, and is superior in developing new types of textile products, fashion design. As a result, the outstanding quality of teaching is reflected in the students' works and innovative achievements, which are frequently rewarded at municipal, provincial, and national competitions. Lots of students of fashion show win various national competitions every year. Graduates are spoken of highly by enterprises and the rate of employment upon graduation is 98% annually. Among the graduates are large amounts of outstanding talents, such as: Hu Jihua and Cao Yang, who are among the top ten national fashion designers; Yin Bolin, one of the ten excellent youth of Beijing city, (with over one million in income, called “the fashion designer of national highest salary”, and the design director of Beijing “Jessica” Garment Ltd. Corp.); Bian Jiawei and Xiang Wenjun, top ten fashion designers in Jiangsu Province; Wu Changmei, the national model of hard working; Tao Yongchun, doctor of Nanjing University; Zhang Qian, famous movie star (called “the best temperament lady in Asia” by the Japanese media); and many others.


The institute has signed cooperation agreements with the French European-Asian Management College, I.I.S.S. D. Fioritto in Italy, and Singapore Raffles International College. Raffles Changzhou International College was established in 2003. The two parties have jointly invested and founded six specialties: Fashion Design, Interior Design, Graphic Design, Multimedia Design, Fashion Marketing, and Business Administration. The college has adopted bilingual classes and the credit hour system. Students will receive a diploma and certificate from both institutions.



The achievements of the institute over the years have been widely recognized by society. Consequently, it has won more than 100 glorious awards, such as the National Advanced Vocational Institute, Jiangsu Civilization Campus, and Changzhou Civilization Unit. Foreign Teacher’s Contract


 


. Party A This Institute wishes to engage the service of Party B as                   . The two parties, in a spirit of friendly cooperation, agree to sign this contract and pledge to fulfill conscientiously all the obligations stipulated in it.

.Party A’s Obligations


1.     Party A shall introduce to Party B the laws, Decrees and relevant regulations enacted by the Chinese government, the Party A’s work system and regulations concerning administration of foreign experts.


2.     Party A shall conduct direction, supervision and evaluation of Party B’s work.


3.     Party A shall provide Party B necessary working and living conditions.


4.     Party A shall provide co-workers.


5.     Party A shall pay Party B’s salary regularly by the month.


 


. Party B’s Obligations


1.     Party B shall observe the laws, decrees and relevant regulations enacted by the Chinese government and shall not interfere in China’s internal affairs.


2.     Party B shall observe Party A’s work system and regulations concerning administration of foreign experts such as “Foreign Teacher’s Rule” and shall accept Party A’s arrangement, direction, supervision and evaluation in regard to his/her work. Without Party A’s consent, Party B shall not render service elsewhere or hold concurrently any post unrelated to the work agreed on with Party A.


3.     Party B shall complete the tasks agreed on schedule and guarantee the quality of work.


4.     Party B shall respect China’s religious policy, and shall not conduct religious activities incompatible with the status of an expert.


5.     Party B shall respect the Chinese people’s moral standards and customs.


 


. Revision, Cancellation and Termination of the Contract


1.     Both Parties should abide by the contract and should refrain from revising, canceling, or terminating the contract without mutual consent.


2.    The contract can be revised, canceled, or terminated with mutual consent. Before both parties have reached and agreement, the contract should be strictly observed.


3.     Party A has the right to cancel the contract with a written notice to Party B under the following conditions:


Party B does not fulfill the contract or does not fulfill the contract obligations according to the terms stipulated, and has failed to amend after Party A has pointed it out.


According to the doctor’s diagnosis, Party B cannot resume normal work after a continued 30 day sick leave.


 


4.  Party B has the right to cancel the contract with a written notice to Party A under the following conditions :


Party A has not provided Party B with necessary working and living conditions as stipulated in the contract.


Party A has not paid Party B as scheduled.


 


. Breach Penalty


When either of the two parties fails to fulfill the contract of fails to fulfill the contract obligations according to the terms stipulated, that is, breaks the contract, it must pay a breach penalty of US $ 1,000 to 2,000 (or the equivalent in RMB).


 


If Party B asks to cancel the contract due to events beyond control, it should produce certifications by the department concerned, obtain Party A’s consent, and pay its own return expenses; if Party B cancels the contract without valid reason, it should pay its own return expenses and pay a breach penalty to Party A.


 


If Party A asks to cancel the contract due to events beyond control, with the consent of Party B, it should pay Party B’s return expenses; if Party A cancels the contract without valid reason, it should pay Party B’s return expenses and pay a breach penalty to Party B.


 


.The appendix of this contract is an inseparable part of the contract and has equal effect.


 


. This contract takes effect on the date signed by both parties and will automatically expire when the contract ends. If either of the two parties asks for a new contract, it should forward its request to another party 90 days prior to the expiration of the contract. and sign the new contract with mutual consent.


 


Party B shall bear all expenses incurred when staying on after the contract expires.


 


. Arbitration


The two parties shall consult with each other and mediate any disputes which may arise about the contract. If all attempts fail, the two parties can appeal to the organization of arbitration for foreign experts affairs in the State Administration of Foreign Experts Affairs and ask for a final arbitration.

Appendix


 


I   Work assignment


1.  Party B shall accept Party A’s work assignments, has no more than 16 working hours per week(45minutes/period), and working at office at least half a day per week, (not including teaching hours) to finish other assignments by college. If Party B accept more periods and Party A shall pay party B Rmb 60 yuan per teaching hour in accordance with Party B’s extra work periods after the discussion between them, Party A will check the extra work periods at the end of each month.


2.  Party B shall work out teaching plans according to syllabus and carry out strictly, prepare lessons carefully and apply flexible teaching methods according to the students’ level. Party B shall also prepare for class design and detailed notes before each teaching periods.


3.  The text books and other teaching materials used in class shall be agreed upon by party A. Movies, video tapes and etc. provided by party B for teaching can only be used with Party A’s permission. Party B shall not teach any content or conduct any activities irrelevant to his/her teaching.


4.  Party B should be strict with the students and prepare for all the teaching subjects adequately, make well known the students’ study situation at the time, absorb students’ good suggestion, assign and correct the students’ homework accurately, try to coach the students and answer questions in spare time, direct and join in every activity arranged by college, (such as the English corner, lectures, Christmas party as required), report the students’ study situation to the leader of teaching and research section.


5.  Party B should make a good preparation for the end-of-term examination and review, and give remarks to the students strictly and accurately according to the examination rules of the school. The remarks should be correct and objective. Meanwhile, at the end of each semester, Party B should hand in a written conclusion about teaching work.


6.  Party B should attend the activities in the teaching and research section and cooperate with Chinese teachers, discuss teaching affairs in order to improve the teaching quality.


7.  Party B should adhere to the normal teaching and living rules at school, obey the school regulations. Party B should arrive and leave our school according to the school’s arrangement. During the teaching term, Party B should not change his/her lessons or go out for travel at will.  If there is a need to change lessons, Party B must write out an application for the reasons to director of Foreign Language Department for permission. If there is a need to ask for leave in two days, Party B must write out an application for the reasons to director of Foreign Language Department for permission and inform Foreign Affairs Office. If there is a need to ask for leave more than two days, Party B must write out an application for the reasons to director of Foreign Affairs Office for permission. If emergent, please call to Foreign Language Department and then handle with the change of lessons as a supplement. If Party B should attend the foreign affairs activities, the school will arrange for the change of lessons.


8.  Party B should obey the rules of Party A’s work and rest schedule. Party B is not allowed to be absent, late or leave class early without any reasons. Without Party A’s permission, Party B shall not accept any other employment outside.


9.  Party B shall accept teaching inspections made by the principals or the leaders from departments or teaching and research sections, in either visiting classes or any other forms, and accept the objective suggestions and criticism.


10. If Party B has any problems of teaching, Party B shall discuss with the leaders of teaching and research section of Foreign Language Department. Teaching questions will be settled by relevant departments and Teaching Affairs Office.


II  The salary treatment


1.  Direct payment


1.       1)  Monetary salary for the probation period is Rmb _    _yuan /month while the salary for the rest of the contract is Rmb _     _yuan /month. The payment of Feb will be counted by the days that Party B’s worked. Salary payment after tax will be paid into a bank account agreed by Party A after the 15th of the following month. In case the time is shorter than a whole month, the payment shall be counted by day. The daily wage shall be 1/30 of the monthly salary (the same with February). According to the national regulations, no more than 50% of the salary can be changed into foreign currencies monthly (be handled in June and December each year). Party B shall pay the personal income tax in accord with the Personal Income Tax Law of People’s Republic of China. 


2) Party B shall be entitled to foreign teacher/experts treatment and under one year (one academic year) contract shall be paid Rmb 2200 yuan as travel allowance when the contract has been completed, and the whole allowance can be changed into foreign currency.


2.       Indirect Payment


    Party A will guarantee adequate living conditions for the Party B in China:


1)      Dwelling 


Party A shall provide Party B with free housing equipped with working and reliable furniture, bedding, a bath room, a computer, a washing machine, a TV set, a DVD set, free Internet connection, a micro-wave oven, a refrigerator, washing machine, air-conditioner, water dispenser, cooker and Chinese kitchen utensils. The meals should be arranged by Party B choose school cafeteria or cook himself/ herself. When Party B is leaving China, upon the expiration of the contract, Party A shall inspect the housing. If there is any damage, Party A shall ask Party B to pay for the loss according to the seriousness of damage. If Party B requires more electrical appliances, he/she will ask Party A for permission, and the costs will be covered by Party B.


2)       Medical care


Providing Party B with free medical care on the school clinic. On completion of the contract Party A shall reimburse Party B Rmb 500 yuan maximum based on the receipts. Expenses for registration, tooth inlaying, dental cleaning, face lifting, massage, glasses, meals in hospital, tonics not for medical purpose, and doctor’s house calls shall be covered by the Party B. Any other elective surgery or illnesses expenses shall be covered by Party B.


3)  Transportation 


Party A shall provide cars freely for Party B on trips concerning Party A’s business.


4)  Telecommunication


Party A shall provide Party B telephone & Internet connection. Any extra expenses shall be borne by Party B himself/herself.


5)  Water & Electricity


Party A shall pay Rmb 400 yuan for water, electricity& Internet connection to related government departments for Party B per month, the extra expenses shall be borne by Party B himself/herself.


6)  International air ticket


    Party B will be reimbursed an international airfare allowance after finishing the 10-month teaching. The cost of the plane ticket cannot be converted into foreign currency.


7Party A should help Part B go though the necessary procedures of Chinese goverment needed to teach in Party A including health check, Z visa  etc., and shoulder the expense needed.


III   Work Time, Rest and Holidays


1.       The work time of Party B shall be 5 days every week.


2.       If Party A arranges overtime work for the Party B, it will pay Party B Rmb 60 yuan per teaching hour. Party A will check the extra work periods at the end of each month.


3.       Party B is entitled to have the same holidays as Chinese teachers in the school. And in addition he/she will have -two-day leave at Christmas with lessons changed. (paid leave).


4.       Party B under over-one-year contract is entitled to be paid a winter vacation (the length of the vacation depends on the date and length of the winter vacation of the college)


5.       If Party B wants to go traveling on vacation, he/she has to inform Party A in advance. And Party B should be responsible for expenses and his/her own security. During the vacation, Party A will not reimburse telecommunication, water & electricity fee if Party B is not at Party A’s school.


IV  Sick leave and private affairs leave


 1.  Sick-leave Certificates from doctors for foreigners appointed by Party A should be presented when the Party B asks for sick leave. If the sick leaves amount to less than 4 hours in one month, no salary will be deducted. If the sick leaves amount to 4 hours in one month, a deduction by day will be made for Party B’s sick leaves. If the sick leaves amount to more than 20 days within one contract term (one year or one academic year), Party A has the right to terminate the contract.


 2.  Private affairs leave of Party B shall be approved by Party A. Party A will deduct the salary by day. In the contract term (one year or one academic year), the private affairs leaves should not exceed 4 days, continuous private affairs leave shall be no more than 2 days, and two days’ salary will be deducted for each day thereafter.


3.  Party B should make up the missing classes after private affairs leave.


4.  In case of any absence from work without Party A permission, 3 days’ salary will be deducted for each day absent A fine of Rmb 20 yuan will be imposed for being late or leaving class early without Party A’s permission.


5.  Party A has the right to terminate the contract and investigate the liability of Party B for violation of the contract.


V  Accommodation


Party B shall use all electronic appliances in the dormitory properly and be aware of any electrical hazards. Party B cannot accommodate a guest for the night without permission of Party A. Party B cannot indulge in excessive drinking. Party B cannot raise pets on campus.


VI  The Probation period of the Contract


  The probation period of Party B shall be 30 days. In the probation period, if Party A finds out that Party B is unfit for the assignment specified in the contract for reasons of health or professional ability, it has the right to terminate the contract.


VII  Resignation


1.       In the event of Party B wishing to resign from the employment of Party A any time prior to the completion of their contract period, a formal letter of resignation shall be submitted to Party A not less than 3 months before his/her last day of work, which should be specified.


2.       In the event of Party B resigning from the employment of Party A, Party A reserves the right to replace Party B earlier than stated in the letter of resignation.


3.       In the event of his/her leaving, Party B shall return all books and materials given to him/her by Party A. Any materials not returned will be charged to Party B.


VIII The terms and conditions of this Contract are strictly confidential. Without Party A’s permission Party B is not allowed to disclose the terms and conditions of this Contract to any third party. Should Party B fails to comply with the terms and conditions of this Contract, Party A is entitled to terminate this Contract and the breaching party shall bear the responsibilities according to actual situations.


Confirmation and change of every term of the appendix of the standard contract must be stipulated in written form through negotiation between the two parties. Any oral agreement will be regarded as invalid. This appendix has equal validity of the standard contract and comprises an integral part of the contract.
