         This College---the only public professional college that endorsed by Jiangxi People’s Government. It specializes in international business and foreign languages. Its precursor was Jiangxi College of Foreign Trade, which was established in 1964. Through a training program named Jiangxi International Economic Relations & Trade Training Center under the supports of the United Nations Development Program (UNDP), it has provided excellent education to students, many of whom have become leaders in foreign trade and foreign languages in southern region of China. The college also maintains close affiliations with other top universities such as Shanghai Institute of Foreign Trade and University of International Business and Economics (Beijing). These affiliations are include joint sponsorship and effort in teaching and research programs.
       The college is located in Nanchang, Jiangxi province, P.R. China. It covers a total area of six hundred and ninety mu (which 50,000 square meters are occupied by college buildings and other facilities) and constituted by three campuses. The fixed asset has summed up to seventy million RMB yuan. It has state-of-the-art teaching and living facilities, such as Teaching Buildings, Comprehensive & Practical Buildings, Net Office Building, Student Apartments, Teacher Flats, Library and Electronic Teaching Building, Indoor and outdoor gymnastics ground. The college is also equipped with Technical Speech Hall, International Trade Simulated Lab E-commerce Simulated Lab and Computerized Accounting Simulated Lab in which students can learn and practice the whole procedures, Language Labs, Multimedia Classrooms, TV Performance and Broadcasting Studio, Computer labs, etc. The college now boasts twenty departments: International Trade, E-commerce, Business English, Business Japanese, Business German, Applied Computer Science, Accounting, Commodity Inspection in International Business, International Finance, International Marketing, Foreign Public Relations and Secretary, International Accounting, Hotel Service and Management, etc. Mainly, high-school graduates are recruited to three-year program for the college diploma. The college also has an active recruitment program for middle school graduates: they can directly obtain the diploma of college level by enrolling in five-year program, while can obtain the certificate in three-year program. The enrollment is large in recent years. As to September 2003, among total 4,200 students in the college, more than half of them were recruited in 2003. Currently, there are 260 employees, 166 of them are full-time teachers who have their Bachelor’s or Master’s degrees, and 46 are senior lecturers. More than 80 teachers have been sent abroad for scholarship. Each year, 6 foreign teachers from America, England, Australia, and Japan are employed to offer language courses. Besides, it has a wide network of international teaching and training organizations complemented by well-known professors, executives and experts at home and abroad who act as adjunct faculty to assure its teaching success.
       In the past forty years, many senior qualified persons are trained to provide broad-based technical assistance and consultation on foreign trade issues in the public and private sectors at local, state, national, and international levels. Some have become the indispensable employees in foreign trade line; some have grown to be the directors or managers of a factory or bosses of community-run enterprises; some have become experts or scholars of great attainments after continuing development abroad. Others have been government policymakers. Recently, the college has expended its employment market for their graduates by adding more human and material resources. Meanwhile, it manages to improve the graduates’ skills in performing a task, imbuing them with the idea --- “Starting and developing one’s career only after one obtains an occupation”. The employment rate of graduates is up to 100% this year.

        The mission statements of This College are “Being rigorous; Seeking knowledge developing; Achieving excellent”. The purpose of running school is “Recruit in; Educate well; Employ capably”. The general goal is “Educate the students; Assure the parents; Satisfy the society”. The vision statement is “Basing upon Jiangxi; Facing the whole nation; Targeting the entire globe”. Through deepening reform all-out, it insists on quality first and strengthens management, constantly “Make green, Beautify, Lighten, Clean-up” the environment of the campuses. Its educational level and quality have been widely affirmed by various bodies. The Education Ministry of P.R. China once conferred the title “ Key polytechnic school at state level” to the college. The People’s Government of Jiangxi province conferred the title “Provincial Civilized Unit “to the college two times (from the year 1998 to 1999 and from 2000 to 2001). In recent years the college has been keeping on getting titles, the Ministry of Foreign Trade and Economic Cooperation P.R. China and the Personal Ministry of P.R. China jointly conferred the title “Advanced Unit in the National Economy and Trade Organizations”; Jiangxi Provincial Educational Department conferred the titles “Advanced College in Teaching Management” and “Advanced College in Environment and Hygiene”; Jiangxi Economy and Trade Committee gave the title “Advanced Unit of Carders Training work”; The people’s Government of Nanchang city conferred the titles “ Garden Unit”, “Advanced Unit in School’s forestation”, “Advanced Unit of Comprehensive Administration” to the collage.
    After P.R. China joined WTO, many new opportunities had been available for This College. Sample of German Teachers' CONTRACT:

.Party A  This University  wishes to engage the service of Party B     -         as          . The two parties, in a spirit of friendly cooperation, agree to sign this contract and pledge to fulfill conscientiously all the obligations stipulated in it.

 

. The period of service will be from the   10th   day of Feb,2012  to the 30th  day of  January ,2013  .

 

. The duties of Party B (see attached pages)

 

. Party B’s monthly salary will be 5300 Yuan RMB, 70 % of which can be converted into foreign currency monthly.

 

. Party A’s Obligations

1.       Party A shall introduce to Party B the laws, decrees and relevant regulations enacted by the Chinese government, the Party A’s work system and regulations concerning administration of foreign experts.

2.       Party A shall conduct direction, supervision and evaluation of Party B’s work.

3.       Party A shall provide Party B necessary working and living conditions.

4.       Party A shall provide co-workers.

5.       Party A shall pay Party B’s salary regularly by the month.

6.       Party B enjoys health insurance purchased by Party A.

 

7.       Party A pays a round-way international travel expense for Party B.

 

. Party B’s obligations

1.       Party B shall observe the laws, decrees and relevant regulations enacted by the Chinese government and shall not interfere in China’s internal affairs.

2.       Part B shall observe Party A’s work system and regulations concerning administration of foreign experts and shall accept Party A’s arrangement, direction, supervision and evaluation in regard to his /her work. Without Party A’s consent, Party B shall not render service elsewhere or hold concurrently any post unrelated to the work agreed on with Party A.

3.       Party B shall complete the tasks agreed on schedule and guarantee the quality of work.

4.       Party B shall respect China’s religious policy, and shall not conduct religious activities incompatible with the status of an expert.

5.       Party B shall respect the Chinese people’s moral standards and customs.

 

. Revision, Cancellation and Termination of the Contract

1.       Both parties should abide by the contract and should refrain from revising, canceling, or terminating the contract without mutual consent.

2.       The contract can be revised, cancelled, or terminated with mutual consent. Before both parties have reached an agreement, the contract should be strictly observed.

3.       Party A has the right to cancel the contract with a written notice to Party B under the following conditions:

(1)    Party B does not fulfill the contract or does not fulfill the contract obligations according to the terms stipulated, and has failed to amend after Party A has pointed it out.

(2)    According to the doctor’s diagnosis, Party B cannot resume normal work after a continued 30 day sick leave.

4.       Party B has the right to cancel the contract with a written notice to Party A under the following conditions:

(1)    Party A has not provided Party B with necessary working and living conditions as stipulated in the contract.

(2)    Party A has not paid Party B as scheduled.

 

.  Breach Penalty

When either of the two parties fails to fulfill the contract or fails to fulfill the contract obligations according to the terms stipulated, that is, breaks the contract, it must pay a breach penalty of US $500 to 2,000 (or the equivalent in RMB).

If Party B asks to cancel the contract due to events beyond control, it should produce certifications by the department concerned, obtain Party A’s consent, and pay it’s own return expenses; if Party B cancels the contract without valid reason, it should pay it’s own return expenses and pay a breach penalty to Party A.

  If Party A asks to cancel the contract due to events beyond control, with the consent of Party B, it should pay Party B’s return expenses; if Party A cancels the contract without valid reason, it should pay Party B’s return expenses and a breach penalty to Party B.

 

.  The appendix of this contract is an inseparable part of the contract and has equal effect.

 

. This contract takes effect on the date signed by both parties and will automatically expire when the contract ends. If either of the two parties asks for a new contract, it should forward its request to another party 90 days prior to the expiration of the contract, and sign the new contract with mutual consent.

 Party B shall bear all expenses incurred when staying on after the contract expires.

 

. Arbitration

  The two parties shall consult with each other and mediate any disputes which may arise about the contract. If all attempts fail, the two parties can appeal to the organization of arbitration for foreign experts affairs in the State Bureau of Foreign Experts and ask for a final arbitration.

一、  本学院  聘请 日本     (译名)为          。双方本着友好合作精神,自愿签订合同并保证认真履行合同中的各项义务。

二、合同期自 20122 10 日起至  2013  130 日止。

三、受聘方的工作任务(另附页):

四、受聘方的月薪为人民币5200 元,其中 70 %可按月兑换外汇。

五、聘方的义务:

1.   向聘方介绍中国有关法律、法规和聘方有关工作制度以及有关外国专家的管理规定。

2.   对受聘方的工作进行指导、检查和评估。

3.   向受聘方提供必要的工作和生活条件。

4.   配备合作共事人员。

5.   按时支付受聘方的报酬。

6.        受聘方生病时,享受聘方为受聘方购买的医疗保险。

7.        学校为聘请的外教提供一张往返国际机票。

六、受聘方的义务:

1.   遵守中国的法律、法规、不干预中国的内部事务。

2.   遵守聘方的工作制度和有关外国专家的管理规定,接受聘方的工作安排、业务指导、检查和评估。未经聘方同意,不得兼任与聘方无关的其它劳务。

3.   按期完成工作任务,保证工作质量。

4.   尊重中国的宗教政策。不从事与专家身份不符的活动。

5.   尊重中国人民的道德规范和风俗习惯。

七、合同的变更、解除和终止:

1.   双方应信守合同,未经双方一致同意,任何一方不得擅自更改、解除和终止合同。

2.   经当事人双方协商同意后,可以变更、解除和终止合同。在未达成一致意见前,仍应当严格履行合同。

3.   聘方在下列条件下,有权以书面形式通知受聘方解除合同:

(1)        受聘方不履行合同或者履行合同义务不符合约定条件,经聘方指出后,仍不改正的;

(2)        根据医生诊断,受聘方在病假连续30天后不能恢复正常工作的。

4.   受聘方在下列情况下,有权以书面形式通知聘方解除合同:

(1)        聘方未按合同约定提供受聘方必要的工作和生活条件;

(2)        聘方未按时支付受聘方报酬。

八、违约金:

    当事人一方不履行合同或者履行合同义务不符合约定条件,即违反合同时,应当向另一方支付5002000美元(或相当数额的人民币)的违约金。

    受聘方因不可抗力事件要求解除合同,需出具有关机构证明,经聘方同意后,离华的费用自理;受聘方若无故解除合同,除离华费用自理外,还应当向聘方支付违约金。

    聘方因不可抗力事件要求解除合同,经受聘方同意后,离华费用由聘方负担;聘方若无故解除合同;除负担受聘方离华费用外,还应当向受聘方支付违约金。

九、本合同附件为合同不可分割的一部分,与合同具有同等效力。

十、本合同自双方签字之日起生效,合同期满即自行失效。当事人一方要求签订新合同,必须在合同期满90天前向另一方提出,经双方协商同意后签订新合同。

    受聘方合同期满后,在华逗留期间的一切费用自理。

十一、仲裁

    当事人双方发生合同纠纷时,尽可能通过协商或者调解解决。若协商、调解无效,可向外国专家局设立的外国文教专家事务仲裁机构申请仲裁。

附件:

工作任务

 

1、为学生上日语课,每堂课时间为45分钟;

2、用日语作为交流媒介,指导学生的课外活动;

3、编纂教学辅导材料,承担音像资料的录制工作,以及其他与日语教学有关的工作;

4、组织并辅导学生年度日语短剧艺术节和/或学生团体表演的小品;

5、参加由日语系组织的日语角活动和讲座;具体安排由日语系决定;

6、接受校领导、教务处或日语系领导以听课或其他形式进行的教学检查。乙方在得到事先通知的情况下,应接受其他教师的听课要求;

7、做好与教学岗位有关的所有工作,如布置、批改作业,安排考试,评分以及辅导学生等。

 

工作条件

 

1、乙方一周工作五天,星期一至星期五共十六至二十节课(共1215个小时)的正常课堂教学。有需要的话,甲方为乙方提供必要的设施和仪器,以提高工作效果和教学质量。

2、乙方享有和中国政府规定的法定节假日,另外,乙方在圣诞节有两天假日(24日和25日两天)

3、乙方的月工资是人民币5000元整,每月的15日前发放。如果合同结束后外教直接回国,六月份的工资将在七月前日到账。

4、每月提供给乙方300元(叁佰元整)人民币的水电补贴。该补贴随工资发放。

5、乙方须支付其公寓内所有的电费、煤气费和电话费用。这些费用将从乙方的每月工资中扣除。 

6、乙方工作满一学年,学院外事办将安排国内旅游项目(标准为每人人民币2200/年)。如学院因特殊原因不能安排出行,将给予旅游津贴人民币2200(发到最后一个月的工资卡里,不发现金);如外教因个人原因不能出行,将视为自动放弃该旅游津贴项目。 

7、甲方为乙方提供免费的住宿并提供如家具,彩电,冰箱,空调,个人电脑(免费互联网接入服务)和厨房设施(包括电饭煲和微波炉)。如果在使用过程中,彩电、冰箱、空调和电脑等任何物品有损坏,乙方应自行承担维修的责任。合同到期离开中国之前,甲方必须进行检查, 如房内设施有损失,甲方可以要求乙方根据损坏程度进行赔偿。如果乙方需要更多的电器,必须事先得到甲方的允许,并自行支付费用。

8、对于一学年的合同,甲方为乙方支付从南昌到乙方所在家乡最近的国际机场的来回程经济舱机票,且甲方为乙方支付的单程机票费最高不超过人民币4000超过的部分乙方须自行支付。乙方有义务向甲方提供必须航班与价格信息,没有事先得到甲方有关机票费用的批准,乙方能从甲方得到的机票补偿最多为50美元。甲方为乙方支付机票费兑换人民币时,汇率以甲方报账日为准。

9、乙方在到达本学院后,须出示未使用的回程机票。同时将获得来程票款的补偿。未使用机票归还乙方自行保管,返程机票款将在合同结束后支付给乙方。如果乙方在合同开始前和\或合同结束后不直接回国,甲方将根据航空服务公司提供的机票报价给予机票款80%的补偿费。

10、甲方必须为乙方的执教提供合法的居留手续。

 

 

 

特殊条款

 

1、未经甲方允许,私自在校外从事第二职业将视为违反合同,并有可能引起乙方的被解雇;

2、甲方不承担乙方由于交通事故,疾病或自然灾害引起的任何责任;

3、公寓内的所有物品都是甲方的财产,教学资料(包括书,磁带,录音机等)也属于甲方。他们必须在合同期满后归还甲方;合同期满后,乙方须清理房间并将物品摆放整齐;否则乙方将支付人民币150元作为洗涤费用。

4、如果乙方请病假,需向甲方提出书面申请,得到甲方的批准后才能请假,并且需要提供医生的相关证明给教务处。但是,乙方需在以后的日子将耽误的课时补上。

5、在紧急情况下允许乙方请假。但乙方必须提前一天获得同意并自行找人调课。换句话说,乙方必须为紧急情况下的请假提供证明。任何未被批准的请假将导致工资的扣除。乙方因私人原因的请假并获得同意,工资将按以下标准扣除(注:指未能补调课者),

6、在一个合同期内允许总计30天的请假(包括病假)。超过30天将有可能导致乙方的被解雇。

7、乙方必须遵守中国政府的规定,不得在校内从事任何形式的宗教传播或活动。同时,乙方在进入,居住,离开或过境中国领土时,必须遵守中国有关外国人居住,工作,工资,福利或旅行的法律法规。乙方应该了解甲方有关教师及师生关系方面的指导规定。

8、乙方在受聘期间享受由学院为外教购买的医疗保险。

9、乙方的工作试用期为一个月,自正式执教之日起计算。如果乙方在试用期间不能胜任甲方的教学工作或出现违规行为,本合同将自动失效。甲方将有权依照本合同规定追究乙方的赔偿责任。

Appendix

 

JOB DESCRIPTIONS

1. Conducting German classes for students, each teaching period is understood as 45 minutes.

2. Advising students on extracurricular activities and using German as the medium of communication.

3. Compiling supplementary teaching material, undertaking audio or video recording and other works related to German teaching or teaching in general.

4. Organizing and coaching skits to be performed by students for the annual German theatrical festival and/or school reunion.

5. Joining the German corner activities and German lecture organized by our Foreign Languages Department. The schedule will be decided by the Foreign Languages Department.

6. Accepting teaching inspections made by the principals or the directors from departments or teaching and research sections, in either visiting classes or any other forms. Party B shall accept other teacher’s attending a lecture under prior notice.

7.Doing well all the work related to his\her teaching post such as assigning and correcting exercises, conducting examinations, scoring and coaching students, etc.

 

WORKING CONDITIONS

 

1. Party B’s formal teaching hours is from twelve to fifteen hours per week, five days from Monday to Friday. Party B is provided with necessary facilities and technical equipment upon request required to improve the job performance and quality of teaching process.

2. Party B has statutory holidays as specified by the Chinese government. In addition, Party B enjoys a two-day Christmas holiday ( 24th and 25th of December) .

3. Party B’s salary is CNY 5300 (CNY FIVE THOUSAND AND THREE HUNDRED ONLY) per month, and is delivered before the fifteenth day of every month.Except the salary of August)。Salary of January,2012 will be delivered on February,2013.

4. CNY300 (CNY THREE HUNDRED only) is given as allowance for electricity, water, gas, and phone bill for each. It will be delivered with salary.

5. Party B is expected to pay all the bills for water, electricity, gas, local and long-distance call. If arrangement can be made, those bills may be deducted directly from Party B’s month salary.

6. When Party B has worked for an academic year, Foreign Affairs Office will arrange the domestic tourism project for Party B by the standard of CNY2,200 (CNY TWO THOUSAND and TWO HUNDRED) per person / year. If school can’t arrange a tourism project due to some special reasons, a travel allowance of CNY2,200 (CNY TWO THOUSAND and TWO HUNDRED) shall be granted to Party Bdistributed by a paycheck, not by cash; If Party B can’t travel due to personal reasons, it is considered a voluntarily relinquish of the travel allowance.

7. Party A will provide Party B with free housing equipped with furniture, a washing machine, a TV set, a refrigerator, an air-conditioner, a PC with FREE access to internet and kitchen utensils (including rice cooker, microwave oven and range hood). During the using process, if any of the items were damaged, Party B shall bear the maintenance responsibility. On leaving China, upon the expiration of the contract, Party A shall inspect the housing. If there is any damage, Party A may request compensation according to the seriousness of damage. If Party B requires more electrical appliances, he/she must obtain the prior permission of Party A, and Party B covers the costs.

8. Party A will pay Party B a round trip discounted economy class airline ticket from Nanchang to a nearest international airport to Party B’s hometown for at least one schooling year contract. And the maximum one-way ticket cost paid by Party A is CNY 6000 (CNY SIX THOUSAND ONLY), Party B should pay for the extra cost. Party B is responsible for supplying Party A the necessary flight and price information. Without prior approval of the airfare from Party A, the maximum reimbursement Party B can get from Party A is USD500 (US DOLLARS FIVE HUNDRED ONLY), which will be converted into CNY as above mentioned. The exchange rate is subject to the reimbursement date.

9. Party B will get half of the air-ticket reimbursement upon arrival of This University after presentation of Party A the unused half of the round trip ticket. The unused half of the ticket will be returned to the Party B and the second half of the reimbursement will be given to Party B at the end of this contract. If Party B shall not come from and/or go back his/her hometown, this compensation will be in basis of the quotation from an airline service company.

10. Party A is obligated to take legal residence permit for Party B’s teaching.

 

SPECIAL CONDITIONS

1. Working part time without approval from Party A is regarded as violating this contract and may result in the dismissal of Party B.

2. Party A will not be responsible for any result arising from traffic accident, disease or natural calamities for Party B.

3. All household items and appliances at the apartment are properties of Party A. So are all the teaching materials (book, tapes, recorders, etc.). They must be returned to Party A at the end of this contract. Party B shall clean the apartment up and keep all things in order before leaving. Otherwise, Party B is required to pay CNY150 for lavation.

4. When asking for a sick leave, Party B is requested to present a doctor’s certificate to the administration office of Party A. However, Party B is expected to make up someday later.

5. Leave of absence can only be granted for urgent personal reasons. Party B is expected to obtain consent one day in advance and try to find substitution for him/herself if possible. In other words, Party B must provide evidence proving that absence is caused by emergency. Any unapproved leave of absence will result in a deduction of pay. Party B asks for a leave of absence on private business (including sick leaves) and obtains Party A’s consent, a deduction in salary shall be made according to the amount of teaching hours lost when Party B is absent—just for those who failed to make up or find substitution.

 (If Party B is absent without Party A’s consent, the deduction of salary shall be made on the basis of the average daily pay of the month--22 working days per month.)  Repeated unapproved absence (2 days or 10 teaching hours during the period covered by this contract) is sufficient reason for the dismissal of Party B.

And a deduction in salary of CNY30.00 will be imposed for being late or leaving class early within 10 minutes. Over 10 minutes is regarded as being absence.

Arbitrarily exchanging or combining class is prohibited; otherwise triple daily salary will be deducted.

6. A total of 30 days of leave (including sick leaves) will be allowed during the period covered by this contract. Leave over 30 days will result in the dismissal of Party B.

7. Party B must observe the regulations of the Chinese Government and must not carry out any religious propaganda or religious activities in the school, also he/she must also abide by the laws of china concerning residence, work, wage, benefit and travel for foreigners when entering, staying, leaving and passing through the territory of China. He/she should be aware of the College’s professional code of conduct for teachers and their relationship with students.

8. Party B enjoys health insurance purchased by Party A.

9. Party B shall take one month on probation which will start from the first teaching date. The contract will be automatically ceased if Party B is not competent for the teaching post or violates relevant rules and acts.
