School system and scale:
The school has taken shape and relied mainly on education of undergraduate course, with actively developing of postgraduate education, Chinese-foreign cooperation education international student education, higher vocational-technical education and adult education. I. Both parties, in line with the principles of legality, fairness, equality, mutual agreement, honesty, and trustworthiness, on a voluntary basis, and in a spirit of friendly cooperation, agree to sign this contract and pledge to fulfill all the obligations stipulated hereinafter.
II. The term of this contract shall be from Sept. 1st , 2011… to …July. 31st, 2012…, with the first month set as probation period.
III. Tasks assigned to Party B ( see the appendix).
IV. Party B’s monthly salary shall be RMB…4500…(before tax), of which…70….% can be converted into foreign currency on a monthly basis. Please see the appendix for terms and conditions on other remunerations and benefits concerned.
V. Party A’s Obligations:
1. Party A shall inform Party B of relevant laws and regulations of the People’s Republic of China as well as any institutions and administrative stipulations concerned with Party B’s employment as herein provided.
2. Party A shall conduct regular supervision, inspection and review of Party B’s working performance.
3. Party A shall provide Party B with necessary working and living conditions.
4. Party A shall deploy fellow staff for Party B for coordination affairs.
5. Party A shall pay Party B’s salary as scheduled.
VI. Party B’s Obligations:
1. Party B shall observe relevant laws and regulations of the People’s Republic of China and shall not interfere in China’s internal affairs.
2. Party B shall observe any institutions and administrative stipulations concerned with its employment, and shall be subject to Party A’s arrangements, supervision, inspection and review of his/her working performance. Without Party A’s consent, Party B shall not conduct any part-time job assigned by any other party.
3. Party B shall fulfill the tasks assigned to him/her with high standards within the prescribed timeframe.
4. Party B shall respect China’s religious policies, and shall not conduct any religious activities incompatible with his/her status as a foreign expert.
5. Party B shall respect Chinese people’s ethics and customs.
VII. Revision, Cancellation and Termination of the Contract:
1. Revision of the contract. This contract can be revised with mutual consent. Before both parties have reached an agreement, the contract shall be strictly observed.
2. Cancellation of the contract. This contract can be canceled with mutual consent. Before both parties have reached an agreement, the contract shall be strictly observed.
(1) Under the following conditions, Party A shall have the right to inform Party B in writing of the cancellation of this contract:
a. Party B fails to fulfill this contract or the obligations and agreed conditions as herein stipulated, and fails to amend his/her actions after Party A has pointed it out;
b. On the basis of the physician’s diagnosis, Party B fails to resume normal work after a sick leave for a period of successive 30 days.
(2) Party B has the right to inform Party A in writing of the cancellation of this contract under the following conditions:
a. Party A fails to provide Party B with necessary working and living conditions as stipulated in this contract;
b. Party A fails to pay Party B as scheduled.
(3) In case either party asks to terminate this contract, it shall give a 30 day notice to the other party in writing, and the contract shall only be terminated after 30 days.
(4) This contract can be terminated upon mutual agreement by both parties.
3. Termination of the contract.
(1) This contract shall be terminated once it expires.
(2) This contract may be terminated with the mutual consent of both parties, and it shall be strictly observed until both parties reach an agreement otherwise.
VIII. Breach Penalty
When either party fails to fulfill any part or all of the obligations as stipulated in this contract, that is, in the event of breach of the contract, the said party shall pay a breach penalty of US$800-3000 or equivalent to 3 to 10 times Party B’s monthly salary in RMB. If both parties consider it necessary to determine an exact sum of the breach penalty, or to determine a breach penalty higher or lower than the above-mentioned amount, it shall be explicated in the appendix of this contract.
When Party B claims to cancel this contract due to force majeure, it shall produce certifying documents issued by competent authorities; after the contract is cancelled with Party A’s consent, Party B shall bear the traveling expenses thus incurred; and when Party B fails to provide any valid reason to cancel this contract, it shall bear the traveling expenses thus incurred and pay the breach penalty to Party A as stipulated in this contract.
When Party A claims to cancel this contract due to force majeure, and the contract is thus cancelled with Party B consent, it shall bear Party B’s traveling expenses thus incurred; and when Party A fails to provide any valid reason to cancel this contract, it shall bear the traveling expenses thus incurred to Party B and pay the breach penalty to Party B as stipulated in this contract.
IX. The appendix of this contract forms an indispensable part of this contract and shall have the same legal effect with the text of this contract.
X. This contract shall take effect upon being signed by both parties and shall be automatically terminated upon expiration. When either party requires signing a renewed contract, it shall forward its request to the other party 30 days prior to the expiration of this contract, and both parties shall sign the new contract through consultations and mutual consent.
Upon the expiration of this contract, Party B shall bear all the expenses incurred during his own stay in China.
XI. Settlement to Dispute
Any dispute in connection with this contract shall be first of all settled between both parties concerned through friendly consultation. In case no settlement can be reached through consultations or intermediation, both parties shall submit the said dispute for arbitration with local personnel authorities or the local labor arbitration system. In case either party refuses to accept the arbitration award, it may bring an action before the People’s court.

Appendix:
I. Teaching obligations of Party B:
1. Party B shall teach at least 14, at most 16 teaching hours of Oral, Listening, Reading, Literature and the other language major courses to junior college students, under-graduate students, post-graduates, doctorate students, teachers of this University and trainees from all kinds of training institutes of the school. Being abided by the teaching requirements and regulations made by Teaching Affairs Department, party B shall design the test paper and report the final results on time.
2. Party B shall give topic lectures once a week or every two weeks to students on campus; and attend school’s English corner once a week.
3. Party B shall help the students’ English club and be responsible for giving directions to the students’ activities occasionally.
4. According to the teaching requirement, Party B shall attend the meeting on teaching affairs in the institute regularly and be responsible for providing advice and suggestions on teaching affairs.
II. The salary treatment
1. Direct payment
Party A shall provide Party B monetary salary4500RMB/ month. The salary will be paid monthly with RMB from the day of starting work to the expiration of the contract. In case the time is shorter than a whole month, the payment shall be counted in this way: If the classes start after fifteenth of the first month in the contract, party A shall provide half a month salary to party B. If the classes start before fifteenth of the first month in the contract, party A shall provide a full month salary to party B. If the semester ends before fifteenth of July, 2012, party A shall provide half a month salary to party B. If the semester ends after fifteenth of July, 2012, party A shall provide a full month salary to party B. No more than 70% of the salary can be changed into foreign currencies monthly. The employed party shall pay the personal income tax in accord with the Personal Income Tax Law of the People’s Republic of China.
2. Indirect payment
Party A will guarantee the fundamental living conditions for Party B and in China.
(1).Providing lodging with furniture, bedding, telephone, television, washing machine, refrigerator, toilet, kitchen, heating and cooling facilities. Providing free water, electricity and gas every month, free local telephone call and internet service.
(2).Providing medical care service. Party B should receive medical treatment in the school clinic or in the hospital appointed by party A, otherwise, the expenses shall be covered by Party B. Expenses for registration, transportation for medical care, tooth treatment and tooth inlaying, face lifting, massage, glasses, meals in hospital, tonics not for medical purpose, and doctor’s house calls shall be covered by Party B.
(3).Providing the school shuttle bus to and from work for Party B who teaches on the sub-campuses.
(4).International air ticket. If Party B fulfills a half academic year contract, Party A shall provide Party B with an economic class international single trip air ticket. (International economic class air ticket for the nearest distance between China and the nearest major airport to Party B’s permanent residence in his country). If Party B fulfills a one-year contract, Party A shall provide Party B with an economic class international round trip air tickets. (International economic class air ticket for the nearest distance between China and the nearest major airport to Party B’s permanent residence in his country).
(5).Luggage transportation expenses: No matter by air or by ship, Party A will pay Party B the expenses of luggage for the separate transportation of 24 kilograms. Since airlines between China and the U.S. stipulate to carry two large pieces of luggage of 64 kilograms for free, party B from the United States may not bear the luggage transportation expenses.
III. Holidays
1. If Party A arranges overtime work for Party B, Party A will pay Party B RMB 100 for each overtime teaching hour. Except the courses temporarily arranged by the Department of Academic Affairs.
2. Party B is entitled to the following holidays and festivals in China:
New year’s Day, the Spring Festival, May Day, National Day and other holidays stipulated by laws and regulations.
3. Party B is entitled to the following festivals and holidays corresponding to their nationalities and religions:
One day for Christmas, three days for Corban, one day for Lesser Bairam and one day for Water-splashing Festival.
4. Party B is entitled to the paid annual vacation. Party B under one academic year contract is entitled to a paid winter vacation. Party B will be given full month salary in both January and February.
5. If Party B signed one academic year contract, Party A will supply Party B RMB¥1400.00 as holiday allowance for both winter and summer vacation.
6. Party A will provide the formal contract and appendix to Party B, and help Party B obtain the working visa, and foreign experts card to work legally in China. Party B shall pay health exam fee and the working visa fee to China and shall pay the living permit fee in China by himself or herself.
7. As a rule, Party B is supposed to work in China not longer than 5 continuous years. The next employment in China should be two years later.
IV. Sick leave and private affairs leave
1. Certificate from doctors for foreigners appointed by Party A should be presented when Party B asks for sick leave. If the sick leaves amount to less than 30 days within one contract term (one year or one academic year), party B shall be paid with 100% of the salary. In case the leaves exceed 30 days, party A has the right to terminate the contract, or if the contract is not terminated, the 70% of the salary will be paid until the normal work is resumed.
During the term of the contract, medical care expenses of Party B in the hospitals foreigners appointed by the local government during business errands shall be paid by Party A; the medical expenses incurred during private travels shall be covered by the employed party.
During the term of the contract, medical expenses incurred in Taiwan province, Hong Kong SAR, Macao SAR and the places outside of China will be covered by Party B.
2. Private affairs leave of Party B shall be approved by Party A.
Party A will deduct the salary by day. In the contract term (one year or one academic year), the private affairs leaves should not exceed 10 days. The continuous private affairs leave shall be no more than 3 days, and two days’ salary will by deducted for each day thereafter.
In case of absence from work without Party A’s permission, 3 day’s salary will be deducted for each day absent. For serious circumstances, Party A has the right to terminate the contract and investigate the liability of Party B for violation of the contract.
V. The probation period of the Contract and the Credit Bail
1. The probation period of the employed party shall be 30 days. In the probation period, if Party A finds out that the employed party is unfit for the assignment specified in the contract for reasons of health or professional ability, it has the right to terminate the contract.
2. Where Party A provides Party B with the international air ticket to China, Party B may purchase the ticket by him or herself (with the traveling expenses as the credit bail), and the expenses will be reimbursed by the expiration of the contract.
VI. Confirmation and change of every term of the appendix of the standard contract must be stipulated in written form through negotiation between the two parties. Any oral agreement will be regarded as invalid.
This appendix has equal validity of the standard contract and comprises an integral part of the contract.
