Brief Introcduction to the This Medical University
This Medical University, the former First Military Medical University, was founded in October 1951 and notarized as one of the premier medical universities in 1978. The university was handed over to the local government of Guangdong Province and meanwhile renamed as This Medical University, in line with the command by the State Department and the Central Military Committee of PLA in August 2004. At present, the university has been authorized by the Department of Education as a key medical university.
This Medical University is located at the foot of picturesque Baiyun Mountain in Guangzhou. The main campus, together with its south campus in the southern suburb of Guangzhou, covers an area of nearly one million square meters. The university has been awarded the first-class garden-like university, for rows of green trees nourish and bouquets of flowers blossom on the campuses all through a year.
This Medical University has established a complete system for fostering talent candidates of Bachelor's Degree of Medicine (M.B.), Master's Degree of Medicine (M.M.) and Doctoral Degree of Medicine (M.D.), with eight academic fields covering medicine, technology, science, law, management, arts, pedagogy and economics. The university system comprises 7 affiliated hospitals and 16 schools or colleges such as school of basic medicine, school of clinical medicine, school of biomedical engineering, school of Chinese traditional medicine (TCM) and school of public health. Apart from offering 23 majors for undergraduates, the university grants M.M. degree in 55 subjects, M. D. degree in 36 subjects as well as in another 4 first-class subjects, even with 4 academic stations for postdoctoral research. Besides, the university houses a group of state-level key subjects, key subjects by the State Management Administration of Traditional Chinese Medicine, state-level base of clinical pharmacology and state-level base of TCM pharmacology. The university has developed a superior subjects group, with medical science as a backbone and with combination of medicine and engineering, combination of Western and Chinese medicines, tropical medicine and bio-high-tech as supportive subjects.
This Medical University takes pride of the faculties. At present, working on its campus are a large group of well-know experts and professors, among whom there is one academician of Chinese Science Academy and one academician of Chinese Engineering Academy (there are totally 3 academicians in medical field in Guangdong Province), as well as 2 premier scientists of State “973 Project” (there are only 2 in the filed of life science in Guangdong Province). Among the total number of over 700 professors or associate professors in the university, more than 500 are supervisors of M.D. degree candidates and M.M. degree candidates, 4 are the members of State Academic Degree Appraising Committee, 4 are appraised as State-level Middle- or Young-aged Experts, 9 have won Military Great Achievement Award or have been specially invited as Professor of Changjiang Scholarships or the State Backbone Teachers and besides, 54 faculties have been honorably given the titles of State Outstanding Workers in Science and Technology or State Outstanding Teachers.
This Medical University owns its full infrastructure. The total asset of the university amounts to 4.000 billion yuan. The informationalized teaching facility has built its ground on the abundant teaching buildings housing all kinds of teaching rooms and medical laboratories which are equipped with air conditioners, connected to Internet and even electronically integrated. The student's apartments with 4 beds in a room accommodating 15,000 students are also equipped with telephone sets and even linked to Internet. Besides, there is a football ground covered with artificial grass, a plastic-tracked ground and a standard swimming pool in the university. Up till now, the library of This Medical University has a book collection of 1 million volumes as well as a total number of 100,000 volumes of 2,300 Chinese and foreign periodicals.
This Medical University goes strong in teaching and scientific research. By now the university has gained 1 first-grade prize and 2 second-grade prizes of State Excellent Teaching Achievement Award, plus 7 first-grade prizes of Military Excellent Teaching Achievement Award. The university is ranked on the top among the medical universities and colleges in China in view of the number of research projects and the prizes. From 2001 to 2003 during “the Tenth Five-year Project” in China, the faculties of the university undertook 643 programs funded by the Central Government, Guangdong Provincial and Guangzhou Municipal governments, with a total amount of 138 million yuan, and thus was ranked at the first place among the medical universities in Guangdong Province. From 1996-2003 (since the Ninth Five-year Project), the university won 9 second prizes of State Scientific and Technological Advances Award, accounting for half of the total 19 second prizes which all the universities and institutes in Guangdong Province gained during that period (no first-grade prize was awarded). During the period of “Tenth Five-year Project”, the university won 9 first-grade prizes of Guangdong Scientific and Technological Advances Awards appraised among the provincial filed of medicine and hygiene, accounting for 53% of the total 17 first-grade prizes awarded at the provincial level.
This Medical University flourishes along with its handover from the military system to the civilian one. Its 7 affiliated hospitals are Nanfang Hospital, Zhujiang Hospital, Hua'nan Hospital, Nanhua Hospital, Stomatology Hospital, Pingxiang Hospital and Jiangdu Hospital, 6 of which have been appraised as “First-Class Hospitals at Grade III”. The hospitals have gained superiority and developed their own distinctive features in diagnosis and treatment of digestive diseases, hematology, cardiology, neuromedicine, nephrology, organ transplantation, microsurgery, orthopedics, combined therapies of carcinomas and rescue of neonatal severe diseases. The hospitals have established the large-scale medical centers for overseas patients. Huiqiao Buildings of Hanfang Hospital, a 400-bed facility is the largest in scale and earliest in admitting overseas patients. Huiqiao Buildings has gained its reputation in China and South-east Asia and was conferred the honorary title of “Model Medical Faculty: Department of Hui Qiao Buildings” by the Central Military Committee of PLA, for up to now it has treated over 80,000 patients from 85 countries or regions.
This Medical University has established long-term cooperation in clinical teaching with more than 100 military or civilian hospitals and institutes in a large or middle scope, among which Guangdong Provincial People's Hospital, Guangdong Provincial Stomatology Hospital, Guangdong Provincial Second People's Hospital and other 4 general hospitals of PLA in Guangzhou, Wuhan, Nanjing, Fuzhou become the schools of clinical medicine.
In academic exchanges, the university has invited and employed more than 100 experts and scholars known in China or internationally, as honorary professors or visiting professors and meanwhile carried out cooperative research and academic exchanges with the universities or institutes in more than 30 countries or regions like the United States, Britain, Japan, France and Australia and Hong Kong. At present, the university has admitted international students from more than 20 countries. Besides, the university is expanding such programs as mutual visits of faculties and exchanges of students with foreign academic institutions.
Sample Contract
This Employment Contract (“Contract”) is made and effective
Ⅰ. Party A wishes to engage the service of Party B as . The two parties, in a spirit of friendly cooperation, agree to sign this contract and pledge to fulfill conscientiously all the obligations stipulated in it.
Ⅱ.The period of service will be
from (dd) of (mm), (yyyy) to (dd) of (mm), (yyyy).
Ⅲ.The duties of Party B (see attached pages)
Ⅳ. The monthly salary of Party B will be¥ Yuan RMB (before tax ).
Ⅴ.Party A’s obligations:
1. Party A shall introduce to Party B the laws, decrees and relevant regulations enacted by the Chinese government, the party A’s work system and regulations concerning administration of foreign experts;
2. Party A shall conduct direction, supervision and evaluation of Party B’s work;
3. Party A shall provide Party B necessary working and living conditions;
4. Party A shall provide co-workers;
5. Party A shall pay Party B’s salary regularly by the month.
Ⅵ. Party B’s Obligations:
1. Party B shall observe the laws, decrees and relevant regulations enacted by the Chinese government and shall not interfere in China’s internal affairs;
2. Party B shall observe Party A’s work system and regulations concerning administration of foreign experts and shall accept Party A’s arrangement, direction, supervision and evaluation in regard to its work. Without Party A’s consent, Party B shall not render service elsewhere or hold concurrently any post unrelated to the work agreed on with Party A;
3. Party B shall complete the tasks agreed on schedule and guarantee the quality of the work;
4. Party B shall respect China’s religious policy, and shall not conduct religious activities incompatible with the status of a scholar;
5. Party B shall respect the Chinese people’s moral standards and customs.
Ⅶ. Revision, Cancellation and Termination of the Contract
1. Both parties should abide by the contract and should refrain from revising, canceling, or terminating the contract without mutual consent;
2. The contract can be revised, canceled, or terminated with mutual consent. Before both parties have reached an agreement, the contract should be strictly observed;
3. Party A has the right to cancel the contract with a written notice to Party B under the following conditions:
1) Party B does not fulfill the contract or does not fulfill the contract obligations according to the terms stipulated, and has failed to amend after Party A has pointed it out;
2) According to the doctor’s diagnosis, Party B cannot resume normal work after a continued 30 day sick leave;
3) During the period of the contract, Party B and its dependants breach the laws and regulations of China;
4. Party B has the right to cancel the contract with a written notice to Party A under the following conditions:
1) Party A has not provided Party B with necessary working and living conditions as stipulated in the contract;
2) Party A had not paid Party B as scheduled.
Ⅷ. Breach Penalty
When either of the two parties fails to fulfill the contract or fails to fulfill the contract obligations according to the terms stipulated, that is, breaks the contract, it must pay a breach penalty of US $500 to US $2,000 (or the equivalent in RMB).
If Party B asks to cancel the contract due to events beyond control, it should produce certifications by the department concerned, obtain Party A’s consent, and pay its own return expenses; if Party B asks to cancel the contract due to its personal reasons, it should inform Party A at least 2 months in advance, obtain Party A’s consent, and pay its own return expenses, in that case the penalty can be deducted; if Party B cancels the contract without valid reason, it should pay its own return expenses and pay a breach penalty to Party A.
If Party A asks to cancel the contract due to events beyond control, with the consent of Party B, it should pay Party B’s return expenses; if Party A cancels the contract without valid reason, it should pay Party B’s return expenses and pay a breach penalty to Party B.
IX. The appendix of this contract is and inseparable part of the contract and has equal effect.
X. This contract takes effect after Party B successfully obtains work permit, working visa and residence permit which are issued by the concerned departments of the government of China and after the commencement of Party B’s work. This contract will automatically expire when the contract ends. If either of the two parties asks for a new contract, it should forward its request to another party 90 days prior to the expiration of the contract, and sign the new contract with mutual consent. Party B shall bear all expenses incurred when staying on after the contract expires.
XI. Arbitration
The two parties shall consult with each other and mediate any disputes which may arise about the contract. If all attempts fail, the two parties can appeal to the organization of arbitration for foreign expert affairs in the Sate Administration of Foreign Experts Affairs and ask for a final arbitration.
This contract is signed, in duplicate, in the Chinese and English languages, both texts being equally authentic.

The Duties of Party B
During the Contract period, Party B shall fulfill the following requirements:
1. Teaching courses at least 20 learning hours each week;
2. Attending the teaching and researching activities required and fulfilling the academic tasks assigned by Party A;
3. Other temporary tasks agreed by the two parties.
4. Timetable is settled and should not be changed without the consent of Party A. In case that there were any addition or deduction of the classes, Party A should inform Party B beforehand and that there were any changes of the classes on Part B side, Part A should be informed at least one day ahead of the schedule.
Supplementary Contract
I. Salary
- Calculation of Payment:
Party B’s salary shall be paid regularly by the month. It shall begin from the day of Party B’s commencement of its work in China till the expiration of the contract. If the work to be done takes less than a month, the payment shall be made by the day, each being one thirtieth of the monthly salary, the same as for February. The payday is the last day of each month.
If Party B’s period of service is over one (academic) year, Party A shall offer Party B one month paid summer or winter vacation.
If Party B’s period of service is less than one (academic) year, Party B shall not have paid summer or winter vacation
- Percentage of Foreign Currency in Salary:
Foreign Currency here refers to US dollars. It’s based on the Chinese official exchange rate released on the pay day that Party B’s salary can be converted into foreign currency.
Party B may change seventy per cent of its monthly salary into foreign currency.
If party B comes to China with its spouse and child, it may convert fifty per cent of its monthly salary.
If Party B is invited as a foreign teacher and its spouse is invited at the same time, but not as a foreign teacher, and they have no children living in China, only the one invited as a foreign teacher may convert seventy percent of its salary into foreign currency.
II. Probation
At the beginning of Party B’s period of service, Party A will grant Party B a one-month probation. Party A has the right to cancel the contract with a written notice to Party B under the following conditions.
1. During probation, Party B does not fulfill the contract or does not fulfill the contract obligations according to the terms stipulated.
2. During probation, if Party B was verified with any infectious disease included in China’s Quarantine Law.
No probation is required to foreign teachers who get the contracts renewed.
III. Travel Expenses
1. If Party B’s period of service is over one (academic) year, Party A shall provide the reimbursement for Party B’s economy class international round-trip air tickets between Hong Kong or Guangzhou (Beijing for the teachers from the Commonwealth of Independent States, CIS countries) and a two-way train ticket from Guangzhou to Hong Kong (Beijing for the teachers from the CIS countries).
The reimbursement for the round-trip air tickets and the two-way train tickets shall be no more than 1200 US dollars for Europeans, 1100 US dollars for Americans, Canadians, Australians and New Zealanders, 1000US dollars for teachers from the CIS countries in Europe, 800 US dollars for teachers from the CIS countries in Asia; 800 US dollars for teachers form Japan and Southeast Asia.
2. If Party B’s period of service is over half a (an academic) year, Party A shall provide Party B with half of the travel expenses mentioned above.
3. Party A shall grant the above reimbursement for tickets at the end of every semester.
IV. Cost of Luggage Transportation
Party A shall pay for the cost of transportation of twenty-four kilograms per person (but no more than a total of forty-eight kilograms for a family) of luggage by no-accompanied mail incurred by Party B and its family for the same distance as mentioned above, on their return after the expiration of the period of service. Expenses for packing and delivering the luggage between Party B’s permanent residence and the airport when coming to China and on his\her return home shall be borne by Party B. The cost of the luggage transportation shall be no more than 200 US. Dollars.
V. During the period of contract, Party A shall bear the following expenses on behalf of Party B:
Housing (with kitchen, bathroom, furniture, beddings, television set, refrigerator, telephone, air-condition, washing machine). Party A gives Party B 500 Yuan RMB allowance each month. Party B should pay for all its life expenses including telephone, internet, gas, transportation, water and electricity supply. As soon as the contract is terminated, Party B will be given a one-week notice to move out of the apartment provided by Party A.
VI. During the period of contract, Party B shall bear the following expense:
1. Income tax;
2. Party B shall buy insurance for accidence and critical illness(critical illness hereby refers to those included in the insurance contract) before Party A apply the work permit for Party B.
3. All expense occurred due to the applications of Work permit, Work Visa, Foreign Expert Certificate and Residence Permit.
VII. Vacations
If Party B’s contract is for one (academic) year, it is entitled to a four-week vacation with salary as scheduled by the university.
Party B shall have a 20-day maternity leave from the day of delivery (female) or a 3-day paternity leave (male) from the day of delivery.
VIII. Sick Leave
When asking for sick leave, Party B should produce the certificate of the doctors who work in the hospitals designated by Party A. Its salary shall be paid as usual if the sick leave is within 30 days. After 30 days, Party A can terminate the contract, and if Party A does not terminate the contract, Party B shall receive 50% of its salary until the day it resumes regular work. Or, after 30 days, if Party A asks to terminate the contract, Party A will take consideration for paying a certain part of the expenses for its departure from China according to Party B’s period of service.
IX. Absence
If Party B asks for leave of absence and obtains Party A’s consent, a deduction in salary shall be made according to the number of days Party B is absent during one (academic) year’s period of contract, Party B should not ask for leave of absence for an accumulative total of 10 days and should not ask for leave of absence for continuously 3days. If Party B is absent from its post without Party A’s consent, a deduction of 3 days’ salary will be made for each day Party B is absent.
