AGREEMENT OF CONTRACT
This Middle School (hereafter known as Party A), wishes to engage _______________ provided by Angelina's ESL Cafe
as teaching assistants of the English Language. The two parties, in a spirit of friendship and co-operation, through consultation, agree to the following:
1.The period of service is fixed from September 1, 2009 to June 30, 2010. The exact dates will be confirmed once they are known.
For the preparation of sheltering and teaching work, Party B should arrive at the school before August 25.
2.Party B shall be responsible to the Head of the English Department, and are expected to carry out all reasonable duties given by him/her
or such other person as he/she may delegate for this purpose.
3. The duties undertaken by Party B are defined as follows:
a. Giving English lessons (teaching not over 16 periods per five-day week) to the Senior 1 students.
b. Taking part and giving guidance in extracurricular activities organized by the students, such as "English Corner", and organizing activities themselves
for the students as required by Party A.
c. Taking part in relevant teaching activities such as the sorting and recording of teaching materials, answering questions, and any other assignments
given by the head of the English Department.
4. Party B shall observe the laws, decrees and relevant regulations enacted by the Chinese Government as well as Party A's work system.
a. Party B is not allowed to do any activity incompatible with his/her status. He/she is not permitted to engage in any missionary work.
b. Party B shall not hold any concurrent post in any other institution without the consent of Party A.
5. Party A shall pay Party B a monthly salary of RMB 5000 .
a. Any variation in this amount must be agreed with each other. If he/she works less than a month, payment shall be made on
a daily basis, amounting to one thirtieth of one month's salary.
b. The salary of Party B shall be increased at the same time as the other teachers of the English Department, and this will be based on inflation only. Increases
given to the Chinese teachers for promotion or other reasons relating to the Chinese Salary System will not affect Party B’s salary.
c. 70% of the salary within can be exchanged to foreign money by the month.
6. Party A will provide Party B with a letter of invitation. This is to enable Party B to obtain a 12 month visa at the Chinese Embassy in USA .
On arrival Party A will provide a one -year's residence card.
a. If they need to buy additional entry visas the extra cost shall be borne by Party B.
b. Party A shall arrange and pay for a resident's permit, a white teacher's card, and a red card to be presented to Party B.
c. Party A will buy the return ticket for Party B from Beijing to USA . Party A is responsible for meeting Party B upon arrival in the city and conveying them to
the university/school(luggage within 24 kilos).
d. Party A will pay the cost of Party B's electricity/gas up to a maximum of 100 units in any one billing period. All international telephone calls are to be paid by Party B.
e. All holiday travel costs are the responsibility of Party B. If he is required to travel as part of his work the cost will be the responsibility of Party A.
f. Party A hold for all medical costs and when he/she is ill, he/she should go to the fixed hospital with the help of Party A. Party A is responsible for Transportation except for filling teeth,
replacing new glasses , meals in the hospital and so on will be paid by Party B as Chinese teachers do.
g. Party A has the right to refuse any extra payment beyond the terms of this contract.
7. Should Party B fall ill, he/she may take the necessary sick leave. Whenever possible Party B shall produce a signed Doctor's certificate for the Head of the English Department.
In the event of Party B's illness, Party A shall pay for other teachers to take the lessons until Party B is well enough to resume teaching.
8. If Party B miss lessons without good reason and without approval of the Head of the English Department, they shall make up the hours at a later date or have their salary reduced accordingly.
The total number of leave days for private business shall not be greater than one week in any one term.
9. Party A will provide Party B with a furnished apartment with one bedroom for each person, a kitchen, bedroom and living area. The accommodation shall be fully equipped with all
the necessary cooking, cleaning and eating equipment, (including teapots, cups, bowls, chopping, board, knife, brush, mop and bucket) bedding (including sheets, blankets and pillows)
and electric fan, television, refrigerator, electric water heater and a gas/electric cooker. Party B will have free computer use, free internet, free national telephone(except international)
10. Party B shall be granted Chinese public holidays, one month’s winter vacations in accordance with the university/school schedule, and a two day holiday at Christmas.
Salary is paid as usual. It means that the whole year Party B will work 4 months the first term and another 4 months the second term, altogether 8 months. Between the two terms,
around the Chinese Spring Festival, Party B will enjoy 2 months’ holiday, 1 month with salary.
11. If either party should decide to terminate this contract, two weeks notice shall be given, with adequate explanation. Neither party shall terminate, discontinue, or modify the terms of
this contract, without justification, consultation with Party A, and mutual agreement, prior to the agreed date of expiration.
12. Any dispute in the implementation of this contract shall be settled through consultation between Party A and Party B.
This contract is the same with the standard one and so it is equally authentic.
